CSC

Facts

On May 1981, GSIS dismissed six employees as being "notoriously undesirable," for having been
allegedly found to be connected with irregularities in the canvass of supplies and materials. Out of the 6
employees, five appealed to the Merit Systems Board. It was elevated to the CSC and decision rendered
in favor of the employees, which was affirmed and modified by the Supreme Court. However, before the
Supreme Court’s decision became final and executory, Elizar Namuco and Eusebio Manuel passed away.
The decision rendered included the reinstatement of the three other employees.

On January 8, 1990, when the Supreme Court’s decision became final and executory, the heirs of
the aforementioned deceased petitioners filed a motion for execution of the CSC’s Resolution. CSC
directed GSIS to pay the compulsory heirs of the deceased Elizar Namuco and Eusebio Manuel their back
salaries from the date of their illegal separation up to the date of their demise. GSIS filed a motion for
reconsideration, but was denied by Order of the CSC dated November 22, 1990. Thus, made them file this
petition.

Issues

1. Whether or not CSC has no power to execute its judgments and final orders or resolutions.
2. Whether or not the compulsory heirs of Namuco and Manuel should not receive back salaries
from the date of their illegal separation up to the date of their demise.

Ruling

The petition has been dismissed.

Ratio Decidendi

1. CSC has the power to execute its judgments and final orders or resolutions. The quasi-judicial or
adjudicatory powers conferred by the constitution to CSC included the grant of authority to
enforce or execute judgments, unless the law provides otherwise.

2. The compulsory heirs of Namuco and Manuel should receive the back salaries from the date of
their illegal separation up to the date of their demise. The death of the employees foreclosed
the initiation or continuance of the disciplinary administrative proceedings against them. Since
they were illegally dismissed, they have the right to receive all the appropriate benefits including
the back salaries from the date of their illegal separation up to the date of their demise.
