TYPE OF INCIDENT: Information regarding camping in the Anaheim Resort Area

On Friday, November 2, 2018, the City of Anaheim reached a settlement in the case of Orange
County Catholic Workers (OCCW) vs Anaheim. The case was filed in federal court, the suit alleged
Anaheim’s enforcement of certain City Municipal Code (AMC) sections violated the rights of
homeless individuals. The settlement of the case did not include any admission of wrongdoing on
the part of the City or the Anaheim PD but it did change the manner in which the City and APD will
address the impacts of homelessness and how certain AMC sections will be enforced in public
areas. The procedure does not apply to the enforcement of other criminal laws, nor do they apply to
AMC violations on current lockable, gated and/or fenced in facilities with hours of operation.

To sum it up, the City of Anaheim will allow individuals to camp on public property such as
sidewalks, city facilities, and city parks. If individuals camp on public sidewalks, there needs to be a
36” clearance in order to comply with the America Disabilities Act (ADA).

APD is currently offering available shelter (beds) to individuals prior to any enforcement action
being taken for certain offenses, including camping. Significant work is being done by the City of
Anaheim to open 325 shelter beds in the coming months. Once those facilities are operational, it
appears APD should be allowed to conduct enforcement of camping in public areas. This is the best
information we have at this time and it is subject to change.
