RULING ON GAITE

MANILA --- The Supreme Court has affirmed the decision of the Office of the Ombuds-
man which found probable cause to charge Baao town Mayor Melquiades Gaite for graft.
In a resolution, the High
Court denied Gaite’s position
which accused the Ombuds-
man of grave abuse of its dis-
cretion in its ruling.
The Supreme Court said
that ““the Ombudsman has
full discretionary authority
in the determination of prob-
able cause during a prelimi-
nary investigation.”
“Thus, the Court cannot
substitute its own judgment
for that of the OMB, except
when there is a grave abuse
of discretion amounting to
lack or excess of jurisdic-
tion,” it stressed.
The case stemmed from
the contract Gaite entered
into with Lamver Consoli-
dated Complex Development
Corporation, Inc. (LCC).
Under the contract, LCC
was allowed to occupy the
first and second floors of the
Baao Public Market for a pe-
riod of 25 years without pay-
ment for the purpose of op-
erating a “Community Mall”
on the leased premises.
The period of the lease
contract was allegedly be-
yond Gaite’s authority.
He averred, however, that
he was authorized to enter
into the assailed lease con-
tract by virtue of Municipal
Ordinance No. 3, series of
2012, or the Revised Market
Code of the Municipality of
Baao.
The Court said “the au-
thority of Mayor Gaite to
execute a lease contract cov-
ering the Baao Public Market
is confined to the terms and
conditions expressly stated in
the ordinance.”
“It did not vest him with a
blanket authority to enter into
a contract of lease with any
natural or juridical person,
for any lease period, and un-
der any condition that he sees
fit,” it pointed out.

In a recent decision, the Supreme
Court affirmed the finding of the Office
of the Ombudsman that Baao Mayor
Melquiades I. Gaite is guilty of graft.
The case stemmed from the lease
contract of certain areas of the public
market which he entered with Lamver
Consolidated Complex or LCC.
The High Court said that the 25-year
period for the lease is way beyond
that which was provided by the town’s
market code which limits such contracts
only to 5 years.
“By ignoring the parameters provided
under Ordinance No. 3 in the award and
operation of market stalls, LCC was
obviously granted unwarranted benefits,
advantage, and preference over all other
stall holders,” it said.
Twenty-five years for a lease contract
may be just fair for a firm which will
certainly invest its capital on the venture.
However, in this particular case we
ask: did LCC ever check on the lifetime
of the contract, i.e. whether 25 years was
indeed what was allowed?
It is called legal due diligence, a
de rigueur course of action for risk
assessment, for those entering into
contracts.
Did its lawyers ever examine the
Revised Market Ordinance of the town?
For if they did, the letter of the law was
clear and unequivocal. So why did they
pursue with the contract just the same?
Certainly, it was not business acumen.
The Gaite debacle should serve as a
caveat for local chief executives.
His market committee should have
advised him of the limitations. Their
failure to have done so spelled their
superior’s downfall.
They should share the fate of their
boss.

The Constitution also states that no
member of the AFP in active service
may be appointed to a civilian position
in the government. EO No. 292, issued
in 1987 by then President Corazon
Aquino, also prohibits appointment
of active members of the military in
service to civilian offices in government,

due to financial problems.
“I have two younger sib-
lings and all of us were study-
ing in college. I knew it was
hard for our parents to finance
our school fees considering
the meager income they earn
from our small “carenderia”.
To give way for my younger
siblings, I did not pursue my

which was a requirement for
graduation,” recalled Jessie.
Three years went by be-
fore he decided to look for
work. He was hired as a wait-
er in one of the well-known
restaurants near their place.
He was then promoted as
manager because of his hard
work and dedication.
“I was happy that I be-
came a manager. All my hard
works paid off and of course,
friend and was offered a job
opportunity in Manila. It was
also a managerial position in
a restaurant. Eleven months
after accepting the offer, he
resigned again and went back
home.
“At some point, I was
thinking and asking myself
what I really wanted to do in
life. Honestly, I struggled in
finding where my heart is. I
was worried, too, because I
am getting older and my life
isn’t stable yet,” he said.

CEBU CITY – The Bi-
col Region bagged four
(4) out of the nine (9) Na-
tional Organic Agriculture
Achievers Awards during
the 15th National Organic
Agriculture Congress held
on November 13-15 at the
Waterfront Hotel this city.
Agriculture Undersecre-

National Organic Agriculture
Focal Person Engr. Christo-
pher Morales led the award-
ing ceremony.
The province of Albay
received P3 Million project
grant as National Outstand-
ing Province implement-
ing Organic Agriculture
(OA) program. Governor

RTD Rodel P. Tornilla and

The province garnered the
highest award as it has suc-
cessfully implemented the
Family Based Food Produc-
tion Program (AFBFPP) ac-
tively participated in by 100
households per barangay of
the total 720 barangays of Al-
bay which started in January
2017. The program helped
each family put up a back-
yard vegetable garden and
communal vegetable gardens
in each barangay. All these
families were trained to make
their own organic fertilizers
out of kitchen wastes and
other indigenous materials.

Vicente in the municipality of
Panganiban, which is known
for its abundant mangrove
crab and crablet resources.
According to Ms. Nelia
Teves, provincial agricul-
turist, crab production and
marketing is a multimillion
enterprise. However, Cat-
anduanes is not known for
its rich crab industry. Many
cities like General Santos,
Roxas and Masbate and other
provinces are buying crablets
in the province without data
regarding the source.
“Sa data, hindi namention
ang Catanduanes na galing sa
atin yung crabs na pinalaki
from crablets,” Ms. Teves
said.
She also shared why they
came up with the idea to have
a trading center for crablets.
“Base sa series of consul-
tation workshops na pinag-
conduct kan PRDP, it was
found out that crabs is the
third major commodity ng
province, considering the
number of people engaged
in crablets and crab produc-
tion and also the potentials sa
market,” she said.
When asked regarding the
benefits of having a Man-
grove Trading Center in Pan-
ganiban, Ms. Teves said that
with the help of the project,
the individual crab gather-
ers and traders will directly
consolidate with the Pangani-
ban Fisherfolks Association
(PFA) which will take charge
of managing the trading cen-
ter.
“In that case makakuha
kita nin tamang data and
mareregulate din natin itong
illegal transport ta duman na
talaga maagi,” she empha-
sized.
“So magkakaigwa ning
dagdag na revenue for the
province wherein itong ship-
ment permit na one peso per
piece, igwa siya nin share
na 50% sa province, 20% sa
munisipyo and 30% for the
barangay where the crablets
came from,” she furthered.
The fund to be used for the
construction of trading center
is under the Intensified Build-
ing Up of Infrastructure and
Logistics for Development
(IBUILD) component of
PRDP where 80% will come
from the World Bank, 10%
from the DA and 10% from
