JUDICIAL AFFIDAVIT OF
GERALDNATTY E. BANDEMING

I, GERALDNATTY E. BANDEMING, of legal age, Filipino, single,

employee of private company, with postal address in Brgy. Loakan, Baguio
City, after having been duly sworn to in accordance with law, fully conscious
that I am answering the following questions under oath, and that I may face
criminal liability for false testimony or perjury and said judicial affidavit was
conducted at the Law Office of Atty. Eming Bandonill, located at Magsaysay
Rd. Baguio City, which taking was done in English which I clearly speak and
understand and that the other information or requirements of Sec. 3, A.M.
12-8-8-SC as explained to me by the administering officer, hereby deposes
and states as follows:

PURPOSE

This affidavit of the accused, GERALDNATTY E. BANDEMING is

being offered to prove the existence of doubt on the charged of attempted
homicide against the accused and deny all allegations against him.

Question 1:Please state your name and other personal circumstances for
the records.

Answer 1: I am GERALDNATTY E. BANDEMING, 27 years of age, married,

and resides at Brgy. Loakan, Baguio City.

Question 2:Are you the same GERALDNATTY E. BANDEMING, who is

charge of this case?

Answer 2: Yes, sir.

Question 3:Where were you last February 14, 2018 at about 11 o’clock in
the evening?

Answer 3: I was at my home in Brgy. Loakan, Baguio City.

Question 4:What happen in your home, if any?

Answer 4: I heard the shout of my nephew calling for help.

Question 5:What is the name of your nephew?

Answer 5: NAT JUANITEZ.

Question 6:What happen next when you heard your nephew shouting, if
any?

Answer 6: I went out to check on my nephew.

Question 7:What happen when you check on your nephew?

Answer 7: I saw him running towards our home pursued by several ladies.

Question 8:What did you do after?

Answer 8: I immediately went to the aid of my nephew and intervened

between the ladies and my nephew.

Question 9:What happen after you intervened?

Answer 9: The ladies got mad and asked me “who the heck I was”

Question 10: what else did they say to you?

Answer 10: They said that I should mind my own business and hand my
Nephew to them.

Question 11: What was your reply?

Answer 11: I asked them what was their problem.

Question 12: What did they say?

Answer 12: They said that it was my Nephew’s fault.

Question 13: What fault were they pertaining to?

Answer 13: They told me that each of them were my Nephew’s lover. And
my Nephew swore loyalty and love, only to discover that my Nephew had
several women.

Question 14:What happened next?

Answer 14: One of the ladies drew a gun and shot my nephew while shouting
“Manloloko ka sabi mo ako lang ang mamahalin mo!”

Question 15: What happened to your Nephew?

Answer 15: After I heard the gunshot, I saw my Nephew lying on the ground
bathed with his own blood and crying for help.

Question 16: What did you do?

Answer 16: I tried to help my nephew but my shoulder was shot. It was
extremely painful.

Question 17: What happened next?

Answer 17: I woke up in Baguio General Hospital. And I saw several

policemen surrounding me asking me why I committed homicide, why did I
kill my own Nephew.

Question 18: With regard to the lady who shot your Nephew, do you
remember her face?

Answer 18: Yes sir.

for Baguio City, Philippines, this 29th day of November, 2018, affiant
personally came and appeared with his SSS ID No. 45-823665-8 issued by
the Social Security Systems at Baguio City, bearing his photograph and

foregoing instrument before me and avowed under penalty of law to the
