It’s not to say that giving advice as a family friend although one is a lawyer is a violation of one’s own

oath as a lawyer. Abortion is in some countries and heck to some people is not immoral but in our
country it is but in my mind it is not immoral per se. Going back to what the constitution provides:

Section 12. The State recognizes the sanctity of family life and shall protect and
strengthen the family as a basic autonomous social institution. It shall equally
protect the life of the mother and the life of the unborn from conception.
The natural and primary right and duty of parents in the rearing of the youth
for civic efficiency and the development of moral character shall receive the
support of the Government.

Let us not forget to determine when an advice is considered immoral. If one gives an advice which
would be for the benefit and protection of his friend then what is immoral about that?

Rule 15.08 tells us that:

Rule 15.08. - A lawyer who is engaged in another profession or occupation


concurrently with the practice of law shall make clear to his client whether he
is acting as a lawyer or in another capacity.

This rule recognizes that although we are lawyers by profession we can still exercise our freedom of
expression, our own opinion. Thus it does not deprive of us of what we believe and say as long as when
we do give such opinion we make it clear to our friend that we are not giving the advice as a lawyer but
as a friend.

Giving an opinion as a friend is never immoral but if you act as a lawyer giving such advice then that is a
different story.
