JUDICIAL AFFIDAVIT

I, John Marky Pilyo, of legal age, Filipino and a resident of #69 Tropical
Valley Gardens, San Roque, Antipolo City, Rizal, under oath, hereby answer
the questions asked of me, fully conscious that I may face criminal liability for
false testimony or perjury, to wit:

PRELIMINARY STATEMENT

This Judicial Affidavit is being executed under oath in compliance with


A.M. 12-8-8-SC and is being adopted the direct testimony of the witness in the
case of People of the Philippines vs Mack Hale D. Beast, docketed as Crim.
Cases No. 666 for Special Complex Crime of Kidnapping with Rape and
Homicide.

The person examining me is Atty. Caridad Sanchez. The examination is


being held in Makati City.
OFFER OF TESTIMONY:

The testimony of witness, John Marky Pilyo, is being respectfully offered


in the above-entitled cases to:

1. Testify that he personally saw the accused, Mack Hale D. Beast at


#100 Forest Ridge Village, San Isidro, Antipolo City;

2. That he and his daughter, Ms. Belle N. Beauty, were forcibly taken
by Mack Hale D. Beast, from the parking lot of #100 Forest Ridge Village, San
Isidro, Antipolo City, and transported to the mansion of the accused;

3. That upon arrival at the mansion of Mack Hale D. Beast, John


Marky Pilyo and his daughter, Belle N. Beauty, were unlawfully detained on
opposite cells directly across each other for three (3) consecutive days;

4. That Belle N. Beauty was repeatedly raped by Mack Hale D. Beast


across the cell where John Marky Pilyo was unlawfully detained;

5. That John Marky Pilyo reported the incident to Sr. Inspector Slick
S. Gaston at the nearest police station and immediately after accompanied the
officers of Inspector Gaston to raid the mansion based on the former’s
testimony;

5. He will also identify relevant documents and testify on some other


relevant matters.
DIRECT EXAMINATION CONDUCTED BY ATTY. ABERGOS
1. Q: Good morning Mr. Witness, do you remember the events that
transpired on the evening of 15 August 2018?
A: Yes, Sir. On that night I was with my daughter, Belle. We met my
business partner, Fairy G. Mother, for a business meeting around dinner
time in her residence at (Address/City of Fairy G. Mother)

2. Q: How long did your business meeting last?


A: It took around 2-3 hours and lasted until 10 P.M.

3. Q: What happened next, if any?


A: While my daughter and I were returning to our car in the parking
lot, I remember being struck by a hard object on my head. I was knocked
unconscious quickly after that.

4. Q: Can you tell us what happened after if you still recall?


A: I regained consciousness feeling really dizzy. But I immediately
realized that my daughter and I were bound by rope and inside a moving
vehicle.

5. Q: Aside from Belle, was there any other person inside the vehicle?
A: Yes sir.

6. Q: Who was this person then?


A: It was Mack Hale D. Beast sir.

7. Q: Mr. Witness, do you personally know Mr. Mack Hale D. Beast?


A: Yes, Sir.

6. Q: Why do you know him?


A: I met him before when he courted my daughter Belle.

8. Q: And how do you know it was Beast who was with you inside the
moving vehicle that night?
A: I can see his face clearly when the vehicle would drive past the
streetlights, and I recognize his hoarse animal voice. Also, I heard the
exchange between him and my daughter.

9. Q: What was the exchange about? [possible objection: hearsay,


counter: independently relevant statement]
A: I heard Beast laughing and telling my daughter that she is finally
within his grasp, while Belle keeps shutting him off.

10. Q: What happened next, if any?


A: Belle and I were then dragged out of the vehicle and we were
brought inside the mansion by Mack Hale D. Beast sir.

11. Q: How did you know that the place where you were brought is his
mansion?
A: I remember because Beast used to invite me and Belle to this
mansion for dinner back when he’s still adamantly courting Belle.

12. Q: Where exactly in the mansion were you and Bell brought?
A. We were brought to the attic by Mack Hale D. Beast sir.

13. Q: What happened next after you were brought to the attic, if any?
A: I was pushed inside a cell by Mack Hale D. Beast, sir.

14. Q: Was there anything you have noticed in the place, if any? [possible
objection: vague; baka we can rephrase it to: “How can you tell that it
was a cell?”)
A: The attic was properly lit.

15. Q: What else happened after that, if any?


A: After he locked the railing where I was placed, he dragged Belle
inside the cell across the cell where I was placed sir.

16. Q: What happened next, if any?


A: Mack Hale D. Beast, the animal that he is, went to the cell of my
daughter, Belle, where he ruthlessly harassed, mauled and
relentlessly raped her.

17. Q: What else happened, if any?


A: After Mack Hale D. Beast satisfied his lust, he leaves the cell and
shouts “linisan n’yo yan!” sir, while laughing hysterically.

18. Q: How long were you detained?


A: We were kept inside the cells for almost 3 days.

18. Q: And what happened during your detention, if any?


A: Every night, Beast would come to our cells, and he would rape my
daughter. He commits this beastly act every night, and every time we would
plead with him to stop and have mercy and to let us go, but to no avail. [with
voice-cracking and tears forming (Tatay, put vicks vaporub on your eyes. Hehe)

20. Q: After Beast rapes your daughter, what was the next thing that
happened, if any?

A: Mrs. Tea T. Potts, who I recognize as one of the servant of Mack


Hale D. Beast, provided first aid for the bruises sustained by my
daughter, Belle. Mrs. Potts is also one of the servants who brings
us food sir.
21. Q: Did she always give you food?
A: There are instances where it was not Mrs. Potts who brings us food
sir.

22. Q: Who brings your food then?


A: During lunch time, it was Mr. Cogsworth W. Clock who would
provide us food and during the evening it was Mr. Lumiere C. Light
who would come serve us dinner sir.

23. Q: What happened next, if any?


A: The next evening, after Mr. Light has served us dinner, he
whispered to me words of encouragement sir.

24. Q. What were these words?


A: He told me that Belle and I must prepare ourselves because we will
be escaping as soon as possible sir

25. Q. And when did this great escape succeed, if at all?


A: It was the after a few days sir.

26. Q. What happened then, if any?


A. Ms. Potts gave me the keys to our cell.

MANIFESTATION:
The Cell Keys was previously marked during the Pre-Trial
Conference as Exhibit “______” for the prosecution

21. Q. If the said Keys will be shown to you, would you be able to
indentify it?
A: Yes sir.

22. Q. I am showing you the Keys marked as Exhibit “________” can you
please go over this and tell the Honorable Court of its relation to the one
you are mentioning earlier.
A: These are the same keys sir.

23: Q. What happened after Ms. Potts gave you the keys, if any?
A: She told me to wait for the go-signal of Mr. Clock in order for us to
escape sir.

24: Q. What happened next, if any?


A: I told my daughter, Belle, that we should take a nap for a while in
order for us to regain strength that will enable us to escape sir.

25: Q. Then what happened next, if any?


A: Mr. Clock woke me up at around 10 AM that same day. He told me
that we have to leave immediately. I also asked him if he was able to
wake up Belle, since we are already about to leave sir.

26: Q. What was the response of Mr. Clock?


A: We were both astonished that my daughter, Belle, was not in her
cell sir.

27: Q. What happened then, if any?


A: The four of us – Lumiere C. Light, Tea T. Potts And Cogsworth W.
Clock, escaped without my daughter, BELLE, and it was tremendously
painful for me to leave without her sir.

28: Q. Was there anything you have noticed during your escape?
A: While we were running away from the mansion Mr. Lumiere C.
Light told us that it was Mr. Mack Hale D. Beast who took Belle away,
but they don’t know where sir.

29: Q: What happened after that, if any?


A Mr. Cogsworth Clock volunteered to stay in order to see the return
of Mr. Mack Hale D. Beast and Belle. So, Mrs. Light and Mrs. Potts
accompanied me to the nearest police station to ask for help sir.

30: Q: Were you able to arrive at the Nearest Police Station?


A: Yes sir.

31: Q: What happened in the Police Station you were referring to?
A: When we arrived at the Police Station PO1 Tank U. Lefou together
with Sr. Inspector Gaston, asked us what happened and we told him
everything. He then helped us file the Police Blotter.

MANIFESTATION:
The Police Blotter was previously marked during the Pre-Trial
Conference as Exhibit “______” for the prosecution

32. Q. If the said document will be shown to you, would you be able to
indentify it?
A: Yes sir.

33. Q. I am showing you the document marked as Exhibit “________” can


you please go over this document and tell the Honorable Court of its
relation to the one you are mentioning earlier.
A: These are the same documents sir.
34. Q: What happened next, if any?
A: Sr. Inspector Slick S. Gaston ordered his men to raid mansion
based on our testimony. Also Mr. Lumiere C. Light and I were
accompanied by the police to the mansion and they immediately blocked
the escape routes of premises. They searched the whole mansion and the
lot adjacent thereto where they have found the corpse of my daughter,
with a stab wound in her chest. [ALL-OUT CRYING/BAWLING BY TATAY].
