It is in these circumstances that the petitioner has boen unnecessarily forced to invoke the writ jurisdiction of this Cour for payment of compensation in respect of the said land. The Court is coming across as the similar writ petitions every day where the State or its authorities have encroached upon the land Of the lawiul owners without acquinng the land or without purchasi it, This practice on behalf of the State and its instrumentality can not be appreciated, 1s rather depreciated On the intervention of the Court as the additional Chief Secretary stated that the Principal Secretary had assured that the concerned Gepartment will make payment of compensation. In case even if compensation has been paid vide letter dated 2.7 2018, this payment would not absolve the Government or its instrumentality {ron furnishing an explanation as to why they are behaving in such a manner and are encroaching upon the land of others without following the procedure prescribed by law. The State Government also owns. an explanation as to the manner in which the compensation in such cases Is being determined and paid, in as much as, compensation of the land has to be determined on the market value with solatium for forceful depnvation of the laid.In view of the aforesaid facts and circumstances despite Payment of the above compensation, if any, learned Standing counsel is directed to file affidavit of a responsible officer of the Government Rot below the rank of the Joint Secretary furnishing complete Particulars of the land which have been encroached and occupied by the State Government, its depariment and instrumentality either for road widening or for any other public purposes without purchasing or acquiring the land or without the consent of the land holders and at | the same time would explain the method of determining the | compensation playable in such cases.
