Resolution Requesting the Chairman of Local School Board to charge the resource materials and building needed by SPED-Fast
Learner of Batangas City to the Annual Budget of the Special Education Fund for CY 2015

WHEREAS, Section 99, Letter (a) of the Local Government Code of 1991 states:

Section 99. Functions of Local School Boards – The provincial, city or municipal school board shall determine, in
accordance with the criteria set by the Department of Education, Culture and Sports, the annual supplementary budgetary
needs for the operation and maintenance of public schools within the province, city, or municipality, as the case may be, and
the supplementary local cost of meeting such needs, which shall be reflected in the form of an annual school board budget
corresponding to its share of the proceeds of the special levy on real property constituting the Special Education Fund and
such other sources of revenue as this Code and other laws or ordinances may provide;

WHEREAS, the primary function of the LSB rests on what is called the special education fund (SEF). The SEF accrues from the
additional one per cent (1%) on real property tax (RPT) levied by municipal government. The collected funds are under the control of
the Local School Board (LSB), which has the sole power to determine the appropriations of the said fund.

WHEREAS, basic public education is still largely the responsibility of the central government, delivered through the
Department of Education (DepEd), notwithstanding the devolution of many basic services to local government units (LGUs);

WHEREAS, the SPED-Fast Learner of Batangas City are requesting for resource materials such as textbooks, workbook or
learning materials, set of LCD projector, Wifi-pocket for JAICA Bldg., printer, visual aids, computer set, tapes and CD’s, science
laboratory tools and equipment and science laboratory building;

WHEREAS, the SEF is allotted by the Local Government Code to the Local School Boards for the operation and maintenance
of public schools; construction and repair of school buildings, facilities, and equipment; educational research; purchase of books and
periodicals; and, sports development in amounts determined by the Local School Boards themselves.

NOW, THEREFORE, BE IT RESOLVED, AS IT HEREBY RESOLVED, to request the Chairman of the Local School Board to charge
the resource materials and building needed by SPED-Fast Learner of Batangas City to the Annual Budget of the Special Education
Fund for CY 2015.
