Hon, Allen H. Sumner
Sacramento County Superior Court
Dept. 42
Re:
Dear Judge Sumner:
"This responds fo plants” counsel's eter requesting a further hearing. No hearing is necessary,
and none should be ordered, The state of affairs is as straightforward as its unfortunate. PG&E
‘was required by tate law to give 15 days" notice of its intention to file bankruptcy. Tt did so, and
intends to file on January 29 ~ six days from today.. Upon filing, maters will be in the hands of
the bankruptcy court. Until then, as stated, PGE hopes and expects that it will beable to make
payments as they come due, including contractual obligation such as settlement agreements
However, PG&E faces liquidity problems, and is prioritizing payments necessary Tor operational
integrity and safe delivery of natural gas and electricity. As a result of ell these factors, PG&E
‘cannot commit to pay one potential creditor over any other inthe days prior to filing for
bankrupty.
