JUDICIAL AFFIDAVIT OF CLEMENT DEL ROSARIO

I, CLEMENT DEL ROSARIO, 24 years old, Filipino, and a resident of

Brgy.Bolilao, Mandurriao, Iloilo City, after having been duly sworn in accordance with
law, hereby deposes and state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicialaffidavits to serve as the direct examination testimony of the witness, on the
basis ofwhich the adverse party may conduct their cross-examination on such a
witness, Ihereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also state
that it was ATTY. CHRISTELLE B. LLANTINO with law office address Rm. 211,
2ndFlr., Maryville Bldg., Delgado Street, Iloilo City who conducted the examination of
the undersigned affiant. My Judicial affidavit is being taken at the above mentioned
place in the presence of ATTY. JONALD B. DORADO and my other companions;

That conformably also with section 3 (c) thereof, I hereby state under the painof
perjury that in answering the questions asked of me, as appearing herein below, Iam
fully conscious that I did so under oath, and that I may face criminal liabilities forfalse
testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

1. Q: Mr. Witness, will you please tell the Honorable Court your name, age and
other personal circumstances?

A: I am CLEMENT DEL ROSARIO, 24 years old, Filipino, and a resident of Brgy.

Bolilao, Mandurriao, Iloilo City.

2. Q: What is your relationship with the accused?

A: I am the family driver of JOSEPH RAYMUND ITURRACDE BAUTISTA.

 3. Q: How many years did you serve as a family driver?

A: 3 years.

4. Q: Did you live at the house of Joseph Bautista during your employment with
him?

A: Yes.

5. Q: Where does Joseph Bautista live?

A: Blk. 27, Lot 7, Phase 2, NHA, Mandurriao, Iloilo City

6. Q: Who are the persons living in Joseph Bautista’s house?

A: Joseph Bautista’s family, his grandchild LAWRENZ ALDON TERUEL and

housemaid,GENE ROSE CANAYA.

7. Q: What is the usual time do you render service for Joseph Bautsista and his
family?

A: It depends. They usually call me if they need my services.

8. Q: Do you remember what transpired on March 18, 2018?

A: On March 18, 2018 in the morning, specifically at around 7 o’ clock in the

morning, I transported/brought Mr. JOSEPH RAYMUND ITURRACDE
BAUTISTAin Faith Bible Baptist Church to attend the scheduled mass;

9. Q: Then, what happened next?

A: That at around 10:00 o’clock in the morning of March 18, 2018, JOSEPH
RAYMUND ITURRACDE BAUTISTA called me to fetch him in the Faith Bible
Baptist to attend his scheduled checkup and laboratory examinations to his
Doctor, Dr. SheenaBembo in St. Paul’s Hospital, General Luna, Iloilo, City.

10. Q: Who were with you during that time?

A: That the person I am with during that time was his grandchild, LAWRENZ
ALDON TERUEL;

6 Q: What happened next?

A: I waited in the parking lot from11 o’clock in the morning to 2 o’clock in the
afternoon. Then, at around 2 o’ clock in the afternoon MR. JOSEPH RAYMUND
ITURRACDE BAUTISTA called me to proceed in St. Paul’s Cafeteria to have our
lunch. Thereafter, we waited for the results of the examinations.

Q: Was there an occasion that the accused returned to their house?

A: There was no occasion for JOSEPH RAYMUND ITURRACDE BAUTISTAto

have returned back to their house from 11o’clock in the morningto 4 o’ clock
in the afternoon of March 18, 2018.

CLEMENT DEL ROSARIO. I duly Interpreted the questions I asked in the tagalog
dialect which the witness understands and she provided the answers the best way she
could which were duly translated by me in the ENGLISH Language. I did not in any way
coach or taught or instruct the witness on how to answer or any other person or persons
then present or assisting the witness regarding the latter’s answers.
