AFFIDAVIT OF DENIAL

I, BENJAMIN SIA TAN, of legal age, Filipino citizen, and with postal and
residence address at B.T. Bldg. V. Rama Avenue Cebu City, under oath, hereby
depose and say, that:

1. I was born on October 2, 1947 at Cebu City, My wife is Susan Yap-

Tan; I have three children namely, a)Lesley Anne Y Tan, b)Stephanie Blanche Y.
Tan c) Ryan Benson Y. Tan;

2. I am a businessman by profession engaged in the electrical and

hardware business from 1975 up to date;

3. On December 8, 2010, when I left for Hongkong, I was informed by

Immigration Officer at the departure area that I was allegedly included in the
Watch List Order (WLO) per Order dated October 14, 2010 of the Hon. Judge
Rosalyn D. Mislos Loja with reference # RMA-10629/ Remark Order dated 10-
12-10 subject charge under CC # 10-277951-57 for Illegal Recruitment/ Estafa;

4. I strongly dent that I am the same person referred to in the watch list
order, the truth being, I have no criminal record before any court of Justice,
neither have I been convicted of any crime involving moral turpitude in any
court of justice in the Philippines neither I am involved in recruitment agency
business; Attached hereto is my NBI clearance which is marked as Annex A;

5. I am executing this Affidavit to attest to the truth of the foregoing

statements for whatever legal purpose this may deem best serve particularly the
truth that I am not the same person referred to in the aforesaid cases.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 5th day
