calalang vs williams- petitioner questions the resolution made by respondent as director of national

public works which prohibits animal-drawn vehicles from passing in Rosario street and Rizal avenue the
resolution was approved by the secretary and was based on ca 548 which authorized the director and
secretary of public works to promote necessary rules to regulate and control traffic on roads and
streets. petitioner stated that the resolution was an undue delegation of power, that it was interfering
with his legitimate business and trade and also it was a violation of social justice. the sc stated that the
resolution was not an undue delegation since ca 548 merely makes the director and secretary of public
works to carry out what the national assembly mandated in CA 548. the resolution and ca 548 was
passed for the purpose of promoting public convenience. in order to promote public convenience the
state may interfere with personal liberty, property or business. finally the promotion of social justice is
not for the sympathy of a given group. Social justice is "neither communism, nor despotism, nor
atomism, nor anarchy," but the humanization of laws and the equalization of social and economic forces
by the State so that justice in its rational and objectively secular conception may at least be
approximated. Social justice means the promotion of the welfare of all the people, the adoption by the
Government of measures calculated to insure economic stability of all the competent elements of
society.
