Sub:- Reply notice for your legal notice dated 11-05-2018 issued on
behalf of your client K. Prabhkar – Rg.
Under the instructions and on behalf of my client Sri. Maddirevula
Viswanatha Reddy S/o Obul Reddy residing at Door No: 37/21 house in
S.N. Colony Rayachoty town, Kadapa District, I herely issue this reply
notice to you for your legal notice dated 11-05-2018 issued on behalf of
your client named Kalimili Prabhakar S/o Rosaiah residing at Door No:
1-3-412 Mangali street, Nawabpeta, Nellore city post & District with the
following facts.
1. It is true that my client executed an agreement of sale on 12-
02-2018 in favour of your client agreeing to execute regular registered
sale deed in favour of your client within three months from 12-02-2018
on payment of balance consideration amount of Rs. 48,90,000/- to my
client on or before 12-05-2018. Your client did not pay the balance
consideration of Rs. 48,90,000/- by way of cash instead of cheque of
Karnataka Bank. My client did not scold your client and did not necked
out your client and that my client did not behave highhandedly but gave
utmost respect to your client. The allegations made by your client in your
legal notice are totally false.
2. My client came to sub Register office on 14-05-2018 by 10
AM and waited up to 5 PM for executing registered sale deed in favour of
your client after receiving Rs. 48,90,000/- from you client and also took
market value certificate on 14-05-2018 from sub Register of L.R Palle for
::2::
proving his presence on 14-05-2016 for performing his part of contract.
Your client did not come to sub Register office at L.R Palle with the cash
of Rs. 48,90,000/- for getting regular sale deed form my client. Your client
totally failed to perform his part of contract on 14-05-2018. So your client
is not entitled to get regular sale deed form my client after 14-05-2018.
Hence the sale agreement has become invalid and unenforceable since
my client cancelled that agreement of sale by virtue of this reply notice
since your client totally failed to perform his part of contract either on
12-05-2018 or on 14-05-2018 even though my client was ready and
willing to perform his part of contract and that your client is not entitled
to get back the advocate amount of Rs. 16,30,000/- form my client.
3. Therefore please take this reply notice and that your client is
not entitled to get registered regular sale deed from my client now and
that the agreement of sale dated 12-02-2018 has been cancelled by my
client by virtue of this reply notice and further please take notice that the
advance amount of Rs. 16,30,000/ is forfeited to the account of my client
forth with.
