Guide for Defense: Direct Examination of Kagawad

Def: Your Honor, the Defense is offering the testimony of its _ witness, Mr. Butch the
Kagawad to prove and corroborate the testimony of the accused that the allegations in the
Information and the Complaint are false, fabricated and malicious, and that the crime could not
have been committed by the accused, and to testify on other matters as may be relevant, your
Honor. With the permission of the Honorable Court, may we proceed, Your Honor.

Q1: Mr. Witness, you mentioned in your Affidavit that you are a kagawad of Brgy. Caniogan
Melendrez, Pasig City, is that correct?

A1: Yes, Sir.

Q2: You also mentioned that you both know Mr. Tom the Cat and Jerry the Mouse, is that
true?

A2: Yes Sir.

Q3: How do you know them?

A3: I personally knew them since each of them filed a complaint against each other on two
different instances.

Q4: What is the first complaint all about?

A5: Nuisance. For loud noise coming from videoke in the middle of the night causing
sleepless nights.

Q5: Who filed the complaint against who?

A5: Tom Cat filed a complaint against Jerry the Mouse.

Q6: Have they settled it?

A6: Yes, before us, that was on August 2017.

Q7: Mr. Witness, you mentioned in your affidavit that first complaint between them, was
settled amicably, how do you know?

A7: I was there when they settled it. I am part of Lupong Tagapamayapa.

Q8: You also mentioned in your affidavit that there is another complaint between them, is
this true?

A8: Yes Sir.

Q9: Did Tom the Cat file that complaint against Jerry the Mouse?

A9: No, Sir. It is the other way around. It was Jerry the Mouse who filed the second
complaint for nuisance again. That time, Tom the Cat is fond of burning garbage in their
backyard.

Q10: What happened?

A10: Just like the first complaint, they also settled it.

Q11: When was the last time they filed a complaint against each other?
A12: December 2017, based on the record, Sir.

Q13: When was the last time you’ve seen them together?
