Recently, there has been
a lot of discussion about the
need for substitute school
teachers. So critical has the
need become that many
school districts are now
hiring “permanent subs” so
schools don’t have to go
without substitute teachers.

Letter to the Editor
To the Editor:
This past spring the
Fort Recovery School
Board came to the point
where a decision should
be made whether or not
to accept the Ohio School
Facilities Commission
(OSFC) offer pertaining
to the prior discussions
dealing with our high
school facility. As a
new board member, I
was not involved with
the discussion prior to
January of this year. I soon
came to find out, through
conversations between
our superintendent and
treasurer and OSFC
officials, many changes
in this process took
place before the Master
Facilities Plan was finally
issued. Until that time, I
was “on the fence” as to
which option would be
best for Fort Recovery
Local Schools.
Once this Master
Plan was issued, I sat
down and listed the pros
and cons of each of the
three options we were
discussing: 1) Build a
new high school wing on
the existing PK-8 building
using OSFC money to
help fund the project, 2)
keep most of the existing
high school and remodel
the rest using OSFC
money to help fund the
project, or 3) keep all of
the existing high school
and remodel it using only
local money to fund the
project. I immediately
discarded option 2 above,
since Fort Recovery’s
local share was over $6
million, considerably
higher than the other two
options. So for me, it
came down to option 1 or
option 3.
Although our current
high school building
is structurally sound at
this point in time, there
are a number of high
dollar issues that will
need addressed; heating
system, electrical system
to support the extra
demands of technology,
and sanitation/plumbing.
These are all repairs that
require the school to be
torn up. This cannot
be accomplished over a
summer break so we will
need to move students out
of construction areas into
mobile classrooms called
swing space. This swing
space is another high
dollar cost. Our walls,
floors and ceilings will
need to be disturbed to
get to these infrastructure
type repairs so it only
makes sense to do them
all at one time rather than
spread them out over a
number of years. I do
not feel our community
would like to go to the
polls every year or two
to vote on another levy
for the next repair to be
completed. The roof on a
big part of the school needs
replaced. To address the
issues needed to expand
the life expectancy of
our current high school
for another 30 years, the
architects have estimated
a cost of approximately
$4.8 million calculating
to $160,000 per year of
life. In the end, we still
have a remodeled, aged
building to maintain.
Building a high
school addition on to the
existing PK-8 building
offers us the opportunity
to construct a new facility
with the aid of state
funding for not a great
deal more locally funded

school area has its own
parking. Extra drive
lanes are designed to
coordinate traffic to flow
in an orderly fashion. The
building design offers a
multi-use area in the high
school wing that is used
for educational purposes
for most of the day and
serves as a dining area for
the high school students
during lunch time where
food prepared in the
existing kitchen would
be brought down to the
students. Will there be
bugs to work out? I’m
sure there will. The
design of the new wing fits
in well with the original
school layout. If you

one of those parents who
were concerned about
mixing our younger and
older students for fear of
exposing those younger
students to many things
their young minds should
not be exposed to. Fifteen
years ago, a lot of homes
did not have computers in
them much less internet
connection. Few people
had satellite/cable TV.
Now those things are
common in most homes.
Our young children are
exposed to many things
they probably should not
be. I’ve come to the
conclusion that in today’s
society having younger
and older children on
the same site in a school
setting is the least of our
worries.
The architects have
estimated Fort Recovery’s
share of the building
to be approximately
$5.3 million with a life
expectancy of 50 plus
years calculating to
$106,000 per year of life
expectancy. With this
option, we have a new
facility that incorporates
up-to-date energy
efficiencies. There are
always maintenance
issues with any building,
whether new or old, but
a new building requires
less. Many people in our
area have been faced in
their own homes with the
decision of remodeling
versus new construction.
Proportionately speaking,
if I have to put $180,000
into remodeling my
home to make it the
home I thought would be
sufficient for the next 30
years or spend $200,000
of my money to build
a new home sufficient
for 50 years I’d choose
the new home. Looking
at all sides of the issue
and putting things into
this perspective, I made
my decision to vote
yes for adding the new
high school wing to our
current PK-8 building.
Long term, I feel this is
the best option for our
community.

It’s No Treat to Be Tricked
by Scary Investment Moves
If you have young children, or even if you just have some in your
neighborhood, you know they will soon acquire large amounts of free
candy, obtained by impersonating witches, vampires and other scary
creatures. As an adult, of course, you’re unlikely to encounter too
many monsters after Halloween ends. Yet as you go through life,
you will find some things that are truly alarming — such as scary
investment moves.
Here are a few of these frightful actions:
•Investing too conservatively — You could try to avoid invest-
ment risk by putting all your money into very conservative invest-
ments. However, as you’re probably aware, those investments
typically pay very little in the way of interest, so your money could
actually lose purchasing power, even with a mild rate of inflation.
•Investing too aggressively — Just as investing too conserva-
tively can be counterproductive, so can investing too aggressively.
Obviously, you would like your money to grow, but the investments
with the highest growth potential are usually also those that carry the
greatest risk to your principal.
•Putting too much money in too few investments — If you
put too many of your investment dollars into just one or two types of
assets, and a downturn hits those assets, your portfolio will probably
take a big hit.
•Waiting too long to invest — As an investor, your biggest asset
may be time. The more years in which you have to invest, the greater
the likelihood that you can make progress toward your important fi-
nancial goals.
•Taking a “timeout” from investing — During periods of sig-
nificant market volatility, such as we’ve seen the past few years,
you might be tempted to take a “timeout” from investing and stick all
your money into very conservative vehicles until everything “blows
over.” But the financial markets will never be totally calm, nor will
they be predictable. Market rallies can start unexpectedly; if you’re
not invested when that happens, you may miss out on growth op-
portunities.
•Ignoring tax-advantaged investment opportunities — When
you invest in a tax-deferred investment account, such as your 401(k)
and a traditional IRA, your money has the opportunity to grow faster
than it would if it were placed in an investment on which you paid
taxes every year. If you aren’t contributing to your 401(k) and you
haven’t opened an IRA, you’re missing out on a great chance to build
resources for retirement.
To make sure you don’t fall victim to these scary investment
moves, you need only follow a few simple principles. First, take the
long view — you will see ups and downs in the short term, but his-
torically the market has performed well over the long term. (Keep in
mind, though, that past performance is not guarantee of what will
happen in the future.) Second, diversify your holdings among a vari-
ety of investments. Diversification, by itself, cannot guarantee a profit
or protect against loss, but it can help reduce the effects of volatil-
ity. Try to build a diversified portfolio based on your risk tolerance,
time horizon and long-term goals. And finally, consider boosting your
401(k) contributions whenever your salary increases and fully fund-
ing your IRA each year.

can haunt you for a lifetime — so take the right steps to help avoid

4 garlic cloves (cut into 4 pieces)
4 tbsp seasoned salt

Physical therapy & Workers Comp
In 2004, when Laura
Horvat was awarded
workers’ compensation
for an injury that occurred
through her job at Cambridge
Home Health Care, Inc., it
led to a legal battle that
brought her case before us –
the Supreme Court of Ohio.
Laura’s workers’
compensation claim was
allowed for a right wrist
sprain with arthritis. She
later filed a motion for
compensation for the loss of
use of her hand. In support
of that claim, she submitted
a functional-capacities
evaluation prepared by
physical therapist Barbara
Hornbeek.
The report noted that
Laura’s right hand was
incapable of performing
maneuvers that required
dexterity or repetition.
Hornbeek felt that these
restrictions were permanent,
although she did report that
Laura’s performance was
not entirely substantiated by
objective findings and that at
points, Laura’s performance
may have been self-limited.
The physical therapy
report did not comment
on the degree of loss or
whether Laura had a total
loss of use of her hand.
When Cambridge Home
Health Care had the physical
therapy report reviewed
by Dr. Scott E. Singer, a
licensed physician, he
concluded that Laura’s level
of function – as recorded by
Hornbeek – did not meet the
standard for loss of use.
A staff hearing officer for
the Industrial Commission
of Ohio – which handles
such matters – nevertheless
awarded Laura 175 weeks of
compensation for total loss
of use, relying exclusively
on the physical therapy
report. Cambridge Home
Health Care requested a
reconsideration of that
decision, but the request
was denied. After that, the
company commenced court
action.
The issue in the case was
not the extent or severity of
Laura’s injury, but rather the
hearing officer’s exclusive
reliance on a physical
therapy report to award 175
weeks of compensation.
Cambridge Home Health
Care argued that a loss-of-
use award must be supported
by a physician’s report and
cannot be based solely on a
physical therapy report.
The Industrial
Commission eventually
came to agree that the
hearing officer erred, and
the Commission joined
Cambridge Home Health
Care in asking us to vacate
Laura’s compensation
award. Laura responded
that the hearing officer
did not rely simply on the
physical therapist’s report
and that even if he did, that
reliance was not fatal to her
cause.
By a seven-to-zero vote,
we agreed with the position
taken by Cambridge Home
Health Care.
Contrary to Laura’s
representation, the hearing
officer did rely exclusively
on the physical therapy
report. The closing line
of the report – which is
all standard boilerplate
language – states, “All proof
on file was reviewed and
considered.” This is not, as
Laura claimed, proof that
the hearing officer implicitly
relied on other evidence in
the file.
The reliance on a single
physical therapy report
is an abuse of discretion
for several reasons. First,
regardless of whether a loss-
of-use award is considered
an impairment award or
a disability award – it has
elements of both – a physical
therapist is prohibited from
giving an opinion on either.
The Ohio General
Assembly has prohibited
physical therapists
from issuing disability
conclusions. In fact, the
pertinent law specifically
forbids a physical therapist
to make a “medical
diagnosis of a patient’s
disability.” Furthermore,
our court – through a
number of previous cases –
has restricted determinations
on impairments to doctors.
Second, while the law in
question is silent as to the
proof required, a review of
that law in its entirety favors
Cambridge Home Health
Care’s position. Under the
law, every claimant who
applies for permanent partial
disability compensation
must have an agency medical
examination – which means
an examination by a doctor.
It defies logic to suggest,
for example, that a 2 percent
permanent partial disability
award must be supported
by a physician’s report,
but a loss-of-use award
generating 175 weeks of
benefits does not. And a
physical therapist, of course,
is not a doctor.
Courts in other states
have also disqualified
physical therapists from
offering disability or
impairment conclusions.
The Tennessee Supreme
Court ruled that a physical
therapist’s permanent partial
impairment assessment
could not be used as evidence
in a workers’ compensation
case. The court said
health professionals were
competent “to testify as an
expert only as to matters
within the limited scope
of his or her expertise and
licensure.”
Tennessee’s law
permitted physical
therapists to evaluate and
treat individuals “using
specific means and narrowly
defined methods.” The law
specifically prohibited the
practice of medicine, and
with only a very limited
exception, authorized
physical therapy only upon
referral by a physician.
This referral requirement
prompted the court to
conclude that physical
