2016 SCHEDULE OF FEES

The following schedule of fees is intended to set a reference for legal fees and
may not be construed as the minimum and/or reasonable fees to be charged in any given
case or situation (IBP By-Laws, Sec. 15) and does not prevent an agreement on
reasonable fees that may be freely arrived at by the lawyer and the client, expressly or
impliedly, based on the criteria fixed by Rule 138, Sec. 24, of the Rules of Court
concerning: (1) the importance of the subject matter of the controversy; (2) extent of the
services rendered; and (3) professional standing of the Attorney and by Canon 20, Rule
20.1 of the Code of Professional Responsibility, thus: (a) the time spent and the extent of
the services rendered or required; (b) the novelty and difficulty of the questions involved;
(c) the importance of the subject matter; (d) the skill demanded; (e) the probability of
losing other employment as a result of acceptance of the proffered case; (f) the customary
charges for similar charges and the schedule of fees of the IBP chapter to which he
belongs; (g) the amount involved in the controversy and the benefits resulting to the
client from the services; (h) the contingency or certainty of compensation; (i) the
character of the employment, whether occasional or established; and (j) the professional
standing of the lawyer. The lawyer shall likewise be conscious of his/her obligation
under Canon 14 and the accompanying rules, not to refuse his services to the needy, not
to decline, except for serious and sufficient cause, an appointment as counsel de oficio or
amicus curiae, and that the practice of law is not a business but a profession imbued with
public service where remuneration is a mere incident (Cueto v. Jimenez, Jr., A.C. No.
5798, Jan. 20, 2005).

COLLECTION MATTERS

Sec. 4.01 Extra-judicial demand of accounts:

Special retainer’s fee of at least P2,000.00 covering the


initial expenses for stationary, transportation, mailing,
etc. In addition, the lawyer is entitled to the following
professional fees:

a) Ten percent (10%) of the amount actually collected


if the account is six (6) months old or less;
b) Twelve point five percent (12.5%) of the amount
actually collected if the account more than six (6)
months old but not more than one (1) year old;
c) Fifteen percent (15%) of the amount actually
collected if the account is more than one (1) year
old;

Sec. 4.02 Judicial demand of accounts:

a. Special retainer’s fee ranging from five to ten


percent (5% to 10%) of the amount involved, but
not less than ten thousand pesos (P10,000.00), for
the initial research, drafting and filing of initiatory
pleading, etc. If the case is amicably settled or
favorable judgment is obtained, the attorney shall be
entitled, inclusive of the special retainer’s fee, the
following additional fee:

1. Ten percent (10%) of the total amount collected,


if payment is made during mediation and/or
judicial dispute resolution (JDR) up to the pre-
trial stage;
2. Fifteen percent (15%) of the total amount
collected if the settlement is made after pre-trial
and during trial;
3. Twenty percent (20%) of the total amount
collected if payment is made after trial and
judgment;

b. In addition and within a twenty (20) kilometer


radius from the lawyer’s office, the lawyer shall be
entitled to an appearance fee as follows:

1. If the case is before the MTC,

2. If the case is before the RTC

c. Beyond the 20-kilometer radius, the lawyer shall be


entitled to an appearance fee equivalent to the
above-appearance fee plus a distance premium of
twenty pesos (P20.00) per kilometer traveled (one
way) beyond the twenty kilometer radius or as may
be agreed upon by the lawyer and client, taking into
consideration the circumstances of both lawyer and
client.

LITIGATION FEES

A. FEES BASED ON FIXED WORK ASSIGNMENT:

Sec. 5.01 In criminal cases:

a. Before the office of the provincial or city prosecutor in preliminary


investigation:

1. Involving light felonies

P10,000.00
Plus appearance fee as provided for under
Sections 4.02(b), 4.02(c) or 5.07, whichever is
applicable under the circumstances

2. Involving less grave felonies

P20,000.00
Plus appearance fee as provided for under

3. Involving grave felonies

P40,000.00
Plus appearance fee as provided for under
Sections 4.02(b), 4.02(c) or 5.07, whichever is

b. Before the municipal, metropolitan, or regional trial


courts:
(In case the lawyer did not handle the case at the preliminary
investigation stage before the office of the provincial/city prosecutor, the
following are the suggested rates, and if he/she did, the suggested rates
are subject to adjustments after taking into consideration the previous
fees paid)

NOTE: The private prosecutor may receive, depending on the agreement, in


addition to the foregoing fees, a maximum of twenty five percent
(25%) of the civil indemnity awarded in the case and actually
collected from the adverse party. The fee structure under Section 4.02
may also serve as guide.

Sec. 5.02 In special civil actions or special proceedings which do


not involve property and money claims, and depending
on the complexity of the issues involved, minimum of

the circumstances

Sec. 5.03 In civil cases involving property or money claims, the


suggested minimum fee is the same as those provided
in Section 4.02

Sec. 5.04 In labor cases:

a. If the lawyer represents the management, the following schedule of fees
shall govern:

1. Before the NLRC, Regional Arbitration Branch,


minimum of

P 25,000.00

Plus appearance fee as provided for under


Sections 4.02(b), 4.02(c) or 5.B whichever is
applicable under the circumstances

2. Before the NLRC Division, minimum of

P 40,000.00

Plus appearance fee as provided for under


Sections 4.02(b), 4.02(c) or 5.B, whichever is
applicable under the circumstances

b. If the lawyer represents labor, he shall be entitled to the legal fees


provided under the Labor Code and other applicable laws.

Sec. 5.05 In all other administrative cases before quasi-judicial


bodies or tribunals in the cities of Tacloban and Ormoc
or the Province of Leyte, minimum of

P 40,000.00

Plus appearance fee as provided for under Sections


4.02(b), 4.02(c) or 5.B, whichever is applicable under
the circumstances

Sec. 5.06 Before appellate courts:

a. Before the Court of Appeals (in original or appealed


cases) or the Sandiganbayan (in appealed cases),
minimum

P50,000.00

b. Before the Supreme Court, in original or appealed


cases, minimum

P50,000.00

NOTE:
 Appearance fees are governed by Sections 5.7 to
5.12, as the case may be.
 All incidental or out-of-pocket expenses relative
to cases before the appellate courts shall be
borne by the client.

B. FEES ON APPEARANCE BASIS ONLY:

quasi-judicial agencies, or tribunals

Note for Sections 5.07, 5.08 and 5.09:


Hearings beyond the 20-kilometer radius from the
lawyer’s office shall be subject to distance premium as
provided for under Section 4.02.c, except for court
located in Metro Manila, Cebu City or Mindanao where
the rates prescribed under Sections 5.10, 5.11 and 5.12
shall apply.

Sec. 5.10 Manila Cases: Before the Court of Appeals,


Ombudsman, Sandiganbayan, Securities and Exchange
Commission, Court of Tax Appeals, Board of
Transportation, Bureau of Patents, Commission on
Immigration and Deportation, Commission on Elections
or any other national judicial, administrative or quasi-
judicial agency or tribunal in Metro Manila.

Sec. 5.11 Cebu Cases: Before the Court of Appeals, Ombudsman,


Securities and Exchange and Commission or any
judicial, administrative or quasi-judicial agency,
tribunal office in Cebu City or Cebu Province

Sec. 5.12 Mindanao Cases: Before the Court of Appeals,


Ombudsman, or any other judicial, administrative or
quasi-judicial agency, tribunal or office in Mindanao

Note:
ALL expenses out of town such as plane fare, board and
lodging shall be borne by the client.

Sec. 6.01 In naturalization and alien legalization proceedings.
a. Judicial Proceedings

Sec. 6.02 Testate or Intestate Proceedings:


a. Without opposition: twenty five percent (25%) of
the gross market value of the estate not exceeding
P100,000.00, plus one percent (1%) of the value of
the estate in excess of the P100,000.00 but not less
than P25,000.00.
b. With opposition: twenty five percent (25%) of the
gross market value of the estate, irrespective of such
value, but not less than P25,000.00.

NOTE: ALL expenses shall be borne by the client.

MONTHLY RETAINER’S FEES

Sec. 7.01 Monthly Retainer’s Fees

a. Sole proprietorship

P 5,000.00
b. Corporation/Partnership/Association

P10,000.00

Retainership shall consist of free legal advice on legal matters affecting


the client’s personal interest and business affairs, exclusive of fees for
notarial services and for handling cases before courts, administrative and
quasi-judicial bodies.

VOLUNTARY ARBITRATION/MEDIATION PROCEEDINGS

Sec. 8.01 For representing a party in voluntary arbitration cases or mediation


proceedings involving:

a. One issue submitted for resolution P20,000.00


b. Two issues submitted for resolution P40,000.00
c. Per additional issue for resolution P10,000.00
d. The lawyer shall also be entitled to a success fee
based on the arbitral award or settlement amount,
minimum of

GENERAL PROVISIONS

Sec. 9.01 The lawyer shall also be entitled to other fringe benefits under our labor laws
and pursuant to practice or collective bargaining agreement.

Sec. 9.02 In all cases, incidental expenses relative to cases before courts, administrative
and quasi-judicial bodies, i.e., filing and/or docket fee, photocopying, securing
documents, court fees, transcript of stenographic notes, mailing,
communication, transportation, hotel accommodations, food, etc. shall be for
the account of the client.

Sec. 9.03 The foregoing schedule of standardized minimum fees shall not apply when
there is a special law fixing the attorney’s fees chargeable in certain cases.

Sec. 9.04 The attorney’s fee charged to client shall be inclusive of taxes.
