Shore protection summary
The Shore Protection Act (SPA) became law in 1979 to ensure the sand sharing system was protected because
this is our first line of defenses against hurricanes and because our beaches are one of the drivers for our
tourism industry.
The sand sharing system is the network of dunes, beaches, shoals and sandbars. This network is what protects
the barrier islands from storms & erosion
This bill does several things—the main point the bill makes is that it replaces what establishes the jurisdictional
line for the SPA with a system that is reflective of the coast. Whereas the current standard is the presence of a
20’ ora structure older than 1979, the new version removes the 20’ tree provision and replaces with a standard
that utilizes the shoreline feature that is present—specifically, the toe of the landward dune, a rock revetment,
or the ordinary high water mark.
Italso features a “minor activity” provision lke is established in the Marsh Protection Act. This includes a less
burdensome regulatory process for small projects like landscaping.
The bill also allows for permits to be transferable should a property owner sell their property.
It includes a new provision exempting beaches that are within groin areas.
It includes cleanup language related to issuing authority and beach driving,
