Dear Governor Cuomo:
1 am in receipt of a jointly executed letter dated April 1, 2019 irom Senate
Majority Leader Andrea Stewart-Cousins and Assembly Speaker Carl E. Heastie advising
‘me that the appropriation bills submitted by the Govemor pursuant to Section 3 of Article
VII of the New York State Constitution have been finally acted on by both Houses of the
Legistature in accordance with Article VII of the New York State Constitution, and that
legislation submitted by the Governor pursuant to Section 3 of Article VII of the New
York State Constitution: determined necessary by the Legislature for the effective
implementation of such appropriation bills has also been acted on.
As you are aware, my role with respect to the budget is limited by law.
Legislative Law Section 5 does not give the State Comptroller the authority to certify a
budget as balanced. Instead, my role is limited to determining that the appropriation bills
are sufficient) for the ongoing operation and support of State government and local
assistance for the 2019-20 State fiscal year. I have determined that they are. ‘Therefore, I
conchude that'legislative passage of the budget as defined in Section 5 of the Legislative
Law has occutred, and legislative paychecks will not be withheld,
