Petitioner, ________________________, moves this court for an order directing that

discovery not be conducted in this matter, and specifically that her deposition not be taken.

The stalking protective order (“SPO”) statutes at ORS 30.866 and 163.730 to 163.750 do
19
not authorize the taking of discovery.

SPO cases are “special proceedings” with their own set of statutory procedures.
21
Therefore, per ORCP 1, they are generally not subject to the Oregon Rules of Civil Procedure.

Even if the Oregon Rules of Civil Procedure do apply, ORCP 36C provides that a court
23
“may make any order which justice requires to protect a party or person from annoyance,

 1 embarrassment, oppression, or undue burden or expense,” for good cause shown. Relief

2 available under ORCP 36C includes an order that discovery not be had.
