This Guidebook for Sangguniang Kabataan aims to


equip you with the inherent powers, duties and functions of
your positions.

As elected SK officials, you will represent the voice of


the youth in representing their rights and responsibilities in
nation building. You have to remember that as young as you
are your actuations will make a difference in determining the
success of your community.

I hope that you will set exemplary practice not only to


your generation but also to other politicians to make a shift in
the political arena.

The Guidebook for Sangguniang Kabataan was


created to help newly-elected Sangguniang Kabataan
officials to perform their duties and functions efficiently.

The youth represents the majority of the population


of the country. With the recent crop of youth leaders we need
to set straight their roles in crafting laws and harness their
conviction on issues that will effect changes in the country.

I am confident that this guidebook will come in


handy to the new set of SK officials. May you perform to the
best of your ability to set as good examples to your fellow
youngsters.

What is the Katipunan ng Kabataan?

The Katipunan ng Kabataan (KK) is an assembly of youth


in the barangay composed of all Filipino citizens at least 15 to less
than 18 years of age who are actually residing in the barangay for
at least 6 months and registered in the list of the Sangguniang
Kabataan or in the official barangay list in the custody of the
barangay secretary.

The Sangguniang Kabataan (SK) is the youth council or


body tasked to govern the KK which shall be composed of the
following:

1. SK Chairman
2. 7 SK Members

The SK secretary and the SK treasurer shall be


appointed by the SK chairman from among the SK members.

ADMINISTRATIVE REQUIREMENTS OF NEWLY ELECTED


SANGGUNIANG KABATAAN (SK) OFFICIALS UPON
ASSUMPTION TO OFFICE

Within thirty (30) days upon assumption to office, the


Sangguniang Kabataan officials shall accomplish and submit the
following:

1. Oath or Affirmation of Office in the prescribed form, which


shall be filed with the office of the SK Chairman and the
Civil Service Commission [Sec. 92, LGC and Sec. 40, Admin.
Code];

2. Sworn Statements of Assets, Liabilities and Net Worth


(SALN), list of relatives within the 4th civil degree of
consanguinity or affinity in government service; and

3. Personnel Data Sheet (PDS) [Sec. 91 (a), LGC].

The SALN and PDS shall be filed with the Office of the Deputy
Ombudsman of their respective region and to the Office of the SK
Chairman. [Rule VII, Sec. 1 (c) (3), IRR of RA 6713]

I. The Sangguniang Kabataan

The Sangguniang Kabataan as the representative of the


youth shall perform the following:

a.) Promulgate resolutions necessary to carry out the


objectives of the youth in the barangay;

b.) Initiate programs designed to enhance the social, political,


economic, cultural, intellectual, moral, spiritual and
physical development of the members;

c.) Hold fund raising activities, the proceeds of which shall


be tax exempt and shall accrue to the general fund of the
SK: provided however, that in the appropriations thereof
the specific purpose for which such activity has been held
shall be first satisfied;

d.) Create such bodies or committees as it may deem necessary


to effectively carry out its programs and activities;

e.) Submit annual and end-of-term reports to Sangguniang


Barangay on their projects and activities for the survival
and development of the youth in the barangay;

f.) Consult and coordinate with all youth organizations


in the barangay for policy formulation and program
implementation;

g.) Coordinate with the appropriate national agency for


the implementation of youth development projects and
programs at the national level; and

h.) Exercise such other powers and perform such other duties
and functions as the SB may determine or delegate or as
may be prescribe by law or ordinance.

II. Sangguniang Kabataan Chairman

The SK Chairman shall perform the following roles, duties


and responsibilities:

a.) An ex-officio member of the sangguniang barangay and


shall exercise the same powers, discharge the same duties
and functions, and enjoy the same privileges as the regular
sangguniang barangay members [Sec. 430, LGC];

b.) Chairman of the committee on youth and sports


development [Sec. 430, LGC] ;

c.) Call and preside over all meetings of the Katipunan ng


Kabataan and the Sangguniang Kabataan;

e.) Implement policies, programs and projects within his


jurisdiction in coordination with the sangguniang
barangay;

f.) Exercise general supervision over the affairs and activities


of the Sangguniang Kabataan and official conduct of its
members, and such other officers of the Sangguniang
Kabataan within his jurisdiction;

g.) With the concurrence of the Sangguniang Kabataan,


appoint from among the members of the Sangguniang
Kabataan, the secretary .and treasurer, and such other
officers as may be deemed necessary;

h.) Exercise such other powers and perform such other duties
and functions as may be prescribed by law or ordinance;

i.) Member of the Barangay-based Institutions, such as, but


not limited to:

1. Barangay Development Council (BDC);


2. Barangay Peace and Order Committee (BPOC)
pursuant to EO 366, DILG MC 2002-02 and POC
2002-05;
3. Barangay Council for the Protection of Children
(BCPC) pursuant to PD 603, RA 7610 and DILG MC
2002-121;
4. Barangay Disaster Coordinating Committee (BDCC)
pursuant to PD 1566;
5. Barangay Anti-Drug Abuse Council (BADAC)
pursuant to DILG MC 99-236;
6. Barangay Ecological Solid Waste Management
Committee (BESWMC) pursuant to RA 9003, DILG
MC 2001-38 and DILG MC 2004-151.

III. Sangguniang Kabataan Secretary

The functions and duties of the Sangguniang Kabataan


secretary are:

a.) Keep all records of the katipunan and Sangguniang


Kabataan;

b.) Prepare and keep the minutes of all meetings of the


katipunan ng kabataan and Sangguniang Kabataan;

c.) Prepare all forms necessary for the conduct of


registration, elections, initiatives, referenda, or plebiscites,
in coordination with the barangay secretary and the
COMELEC; and

d.) Perform such other duties and discharge such other

functions as the chairman of the Sangguniang Kabataan


may prescribe or direct.

IV. Sangguniang Kabataan Treasurer

The functions and duties of the sangguning kabataan treasurer


are:

a.) Take custody of all Sangguniang Kabataan property and


funds not otherwise deposited with the city or municipal
treasurer;

b.) Collect and receive contributions, monies, materials, and all


other resources intended for the Sangguniang Kabataan
and katipunan ng kabataan;

c.) Disburse funds in accordance with an approved budget


for the Sangguniang Kabataan;

d.) Certify to the availability of funds whenever necessary;

e.) Submit to the Sangguniang Kabataan and to the


sangguniang barangay certified and detailed statements
of actual income and expenditures at the end of every
month; and

f.) Perform such other duties and discharge such other


functions as the chairman of the Sangguniang Kabataan

V. The Sangguniang Kabataan (SK) Task Forces

There shall be in every barangay task forces to be organized


as follows:

a.) Green Brigade Task Force


Head - 1st SK Member
Members - 10% of the katipunan ng kabataan

b.) Livelihood and Entrepreneurship Task Force


Head - 2nd SK Member
Members - 10% of the katipunan ng kabataan

c.) Disaster Coordination and Health Task Force


Head - 3rd SK Member
Members - 10% of the katipunan ng kabataan

d.) Education Services. Moral Recovery Activities and Anti-


Drug Campaign Task Forces
Head - 4th SK Member
Members - 20% of the katipunan ng kabataan

e.) Sports Program and Community Immersion Activities

Members - 20% of the katipunan ng kabataan

f.) Infrastructure Task Force


Head - 6th SK Member

VI. Meetings of the SK

In order to fulfill the above functions, the SKs are expected


to:

a.) Meet regularly once a month on the day, time, and


place to be arranged among themselves;

b.) Conduct special meetings that may be called by the SK


chairperson or any three (3) SK members by giving a
written notice to all members of the date, time, place,
and agenda of the meeting at least one (1) day in
advance;

Notices of regular and special meetings should also be


given to the barangay captain and to the Sangguniang Barangay.

VII. Quorum Required

A majority of all elected SK members shall constitute a


quorum to transact official business.

If there is no quorum, the presiding officer may declare a


recess until such time as a quorum is reached.

A majority of the SK members present may also adjourn


from day to day and may force the immediate attendance of

any member absent without good cause. They can do this by


designating a member of the SK, with the assistance of local police
force member/s, to arrest the absent member and present him/
her at the session.

If there is still no quorum, no business shall be transacted.

BENEFITS AND PRIVILEGES OF SK OFFICIALS

a.) During their term, all SK officials are exempted from


payment of tuition and matriculation fees while enrolled
in public tertiary school including state colleges and
universities (SUCs);

b.) The SK chairman is entitled to the same compensation,


allowances, emoluments and such other privileges
enjoyed by the sangguniang barangay officials; and

c.) The SK chairman, as ex-officio member of the


sangguniang barangay, is entitled to the same leave
privileges as those enjoyed by appointive local officials.

AND CONDUCT

Guidelines on how public officials conduct themselves

It is important for all SK officials to remember that they are


covered by Republic Act 6713 or the “Code of Conduct and Ethical
Standards for Public Officials and Employees”, a guidelines on how
public officials, including SK officials, are expected to conduct
themselves.

Specifically, it provides that public officials are accountable


at all times to the people and should discharge their duties with
utmost responsibility, integrity, competence, and loyalty; act with
patriotism and justice; lead modest lives; and uphold public interest
over personal interest.

1. Duties of public officials

a.) Act promptly on letters and requests. SK officials must


respond to letters and requests sent by the public within
fifteen (15) working days from receipt thereof;
b.) Submit annual performance reports. SK Chairpersons and
SK Federation Presidents should submit a performance
report of the local SK within forty-five (45) working days
from the end of the year. This report should be open and
available to the public within regular office hours;
c.) Process documents and papers expeditiously. Official
papers and documents should be processed and
completed within a reasonable time and should contain
not more than three (3) signatories as much as possible;
d.) Act immediately on the public’s personal transactions.
Public officials should attend to anyone who wants to avail
of the services of their offices; and
e.) Make documents accessible to the public. Official papers
and documents should be readily available to the public
within reasonable working hours.

2. Norms of Conduct of Public Officials

The SK, as public officials, should observe the following


as standards of personal conduct in the discharge and
execution of official duties:

a.) Commitment to public interest. SK officials should uphold


the public’s interest over and above personal interest;
b.) Professionalism. SK officials should enter public service
with utmost devotion and dedication to duty. They should
perform and discharge their duties with the highest degree
of excellence, professionalism, intelligence and skill;
c.) Justness and sincerity. SK officials should at all times
respect the rights of others, and should refrain from doing
acts contrary to law, good morals, good customs, public
policy, public order, public safety and public interest. They
should not dispense or extend undue favors on account of
their office to their relatives;
d.) Political neutrality. SK officials should provide service to
everyone without unfair discrimination;
e.) Responsiveness to the public. SK officials should extend
prompt and courteous service to the public. As much
as possible, they should ensure openness and clarity of
information;
f.) Nationalism and patriotism. Public officials should at all
times be loyal to the Republic and to the Filipino people;
g.) Commitment to democracy. SK officials should maintain
the principle of public accountability and manifest the
supremacy of civilian authority over the military. They
should uphold the Constitution and put loyalty to country
above loyalty to persons or party; and
h.) Simple living. SK officials should lead modest lives
appropriate to their positions and income.
3. Prohibited acts and transactions for public officials

SK officials should not engage in the following unlawful


acts and transactions:
a) Financial and material interest. SK officials should not,
directly or indirectly, have any financial or material interest
in any transaction requiring the approval of their office;
b) Outside employment and other activities related thereto.
During their term, SK officials should not accept jobs in
any private enterprise regulated by their office or engage
in the private practice of their profession, unless expressly
allowed by the law;
c) Disclosure and/or misuse of confidential information. SK
officials should not use or share confidential or classified
information officially known to them by reason of their
office and not made available to the public; and
d) Solicitation or acceptance of gifts. SK officials should not
solicit or accept, directly or indirectly, any gift, gratuity, favor,
entertainment, loan or anything of monetary value from
any person in the course of their official duties. This also
includes gifts from a person other than family or relatives
during celebrations or festivities if the gift is of significant
value or if the gift is given in anticipation of, or in exchange
for, a favor.
The law does, however, allow SK officials to accept
the following kinds of gifts or grants from foreign
government:

1.) Gifts of nominal value;


2.) Gifts in the nature of a scholarship, fellowship grant, or
medical treatment; and
3.) Travel grants or expenses for travel taking place entirely
outside the Philippines if such is consistent with the
public interest and is permitted by the head of the
office to which he/she belongs.

4. Grounds for Disciplinary Actions


Like any elective local official, SK officials face certain
sanctions if they do not fulfill their duties or use their powers
properly. An SK official may be disciplined, suspended, or
removed from office on any of the following grounds:

a.) Disloyalty to the Republic of the Philippines;


b.) Culpable violation of the Constitution;
c.) Dishonesty, oppression, misconduct in office, gross
negligence, or dereliction of duty;
d.) Commission of any offense involving moral turpitude or
an offense punishable by at least prison mayor;
e.) Abuse of authority;
f.) Unauthorized absence for fifteen (15) consecutive working
days, except in the case of members of the Sangguniang
panlalawigan, sangguniang panlungsod, sangguniang
bayan, and sangguniang barangay.
g.) Application for, or acquisition of, foreign citizenship or
residence or the status of an immigrant of another country;
and
h.) Such other grounds as may be provided in the Code and
other laws.

BASICS OF
PARLIAMENTARY
PROCEDURE

I. Basics of Parliamentary Procedure

1. What is Parliamentary Procedure?

Parliamentary Procedure is a set of rules and precedent


governing formal proceedings of a deliberative body or
assembly, as in the case of the provincial, city, municipal or
barangay council.

2. What is the objective of the Parliamentary Procedure?

It aims to ensure an order and smooth conduct of


deliberations, which depends to a large measure on the skills
of the presiding officer (also referred to as “The Chair” who
controls all the discussion).

3. What are the “sessions of the sanggunian or council”?

a. “Regular Sessions” are sessions which are convened at


scheduled times and deal with both the general and
usual business of the sanggunian, and

b. “Special Sessions” are sessions which are called as the


need arises to tackle specific item(s) or issue(s).

4. How to address the presiding officer?

During the sessions of the sanggunian, members


address the presiding officer as Mr. or Madam Chairman/
Chairperson; the chairperson refers to himself or herself in the
third person.

5. How to address the members?

Individual members of the body in session are referred


to in the third person.

Ex. The gentlemen/lady from the…


Will the Gentlemen/Lady yield to a few questions?

6. How can someone be recognized?

A member who wishes to speak must raise his/her hand


or rise and request the Chair for recognition.

Ex. “Mr. Chairperson may I be recognized, please”?

7. What is a motion?

A motion is a means by which an action is attained.


Informal discussion helps develop opinions, but to get action
a motion must be introduced, then seconded by another
member (except for nominations), and re-stated by the Chair.
All motions should be expressed in the affirmative.

The Chair has the authority to close the general discussion


and call for a specific motion. (e.g. “The Chair will entertain a
motion to…). Only one motion can be entertained at a time.
After a motion is seconded, the Chair may explain or give
information concerning the effect of the motion. The question
is then up for concentrated debate by the membership.

8. How to present a motion?

Normally, presenting a motion calls for:

a.) Member rises and addresses the Chair;


b.) Member is recognized by the Chair. If the Chairman does
not know the member he says: Will the member please
register his name”? and then recognizes him/her;
c.) Member states his/her proposal: “Mr. Chairman, I move
that…”;

d.) The Chair calls for a second and if no member seconds


the motion, the Chair repeats his request: “Is there a
second for the motion?” If the motion is not seconded or a
second motion is not forthcoming, the Chair announces:
“The motion is lost for want of a second”;
e.) If seconded, the motion is re-stated by the Chair: “It was
moved and seconded that…”;
f.) The Chair conducts the discussion or debate;
g.) The Chair puts the questions to a vote; and
h.) The Chair announces the result.

In recognizing the members, the chair also considers the


order in which members raise their hands.

9. How to preside a session or meeting?

a.) The presiding officer follows a general order of business


which normally starts with the call to order and ends
with the official adjournment; and

b.) The order of business is a means to provide a logical


system for group considerations and the procedure by
which the Chair tackles one item after another. The order
of business can be revised anytime by a 2/3 vote of the
members.

10. How to call the session to order

a.) To open the session, the Chairperson rises, raps the gavel
and declares: “The session may please come to order.”
He may then proceed with the other opening rites or
numbers or directly inquire from the Secretary if a quorum
is present.
b.) If there is a quorum, the Chair proceeds with the agenda or

order of business.
c.) If there is no quorum, he says: “As there is no quorum, a
motion to adjourn is in order.” A motion has to be made by
a member, then duly seconded, and then the chair declares
the session adjourned.
d.) In special cases the Chair may conduct session without
quorum. However, actions and decisions promulgated
during such session (or more appropriately caucus) shall
be subject to approval at the next duly constituted session/
meeting.
e.) The Chair usually decide as to forgo the calling of the roll
except in instances where there is a question as whether
there is a quorum, or to identify all individuals present and
those not present.
f.) If the session starts with a quorum, but losses it later in
the session, only those item taken up or for which votes
were taken while the quorum exists shall be considered
officially acted upon.
g.) For all others, discussion may continue but no vote can be
taken.

11. Conducting Debate or Discussion on a motion

A debate is in order if a motion is classified as debatable.

There are few rules, however, to observe during the


process and they are as follows:

a.) No member should speak without first being recognized


by the Chair.
b.) The chair should first recognize the original mover of the
motion, if said mover wishes to speak.
c.) The chair should, as far as practicable, alternate the speakers

for and the speakers who are against the motion.


d.) No member shall speak the second time until all members
who need to speak have had the chance.

12. How to terminate a debate?

a.) To terminate the debate, the presiding officer may signal


this intention by asking the members: “Is the membership
ready to act on the questions?
b.) If there should be opposition, he may call for a voice vote
or show hands. The Chair should see to it that the question
has been adequately deliberated upon before the Chair’s
final action.
c.) On the other hand, a member may initiate to terminate the
debate by saying: I move the previous question. This motion
cannot be debated and must be put to vote immediately
which requires a 2/3 vote of the members.

II. Minutes of a meeting or Session

Minutes refers to the official document recording of what


happens during session or meeting of a deliberative body like the
Sangguniang Kabataan.

1. The Sangguniang Kabataan Secretary is responsible for the


preparation of the minutes.In his absence, the Sangguniang
Kabataan may choose from among themselves a temporary
secretary.

2. Minutes of the meeting shall contain the following:

a.) Name of organization calling or holding the


meeting.

b.) The place or venue of the meeting/assembly.


c.) Date and time of meeting.
d.) Attendees
e.) Agenda of the meeting
f.) Minutes of the previous meeting, which may reflect
data/ figures, letters, reports and legal papers that
might be used as reference to keep the meeting
run smoothly and fruitfully.
3. In preparing the minutes of the meeting, it shall be brief
and shall cover the essential points.

III. How to draft and adopt SK Resolution

A Resolution is an act of the Sanggunian Kabataan on


matters involving ministerial functions or duties, expressing its
collective desire or an objective whose realization is dependent
on another body or entity.

1. Essential parts of a Resolution:

a.) Heading - is that which indicates the origin of the


resolution
b.) Number - reflects the series in the order of the local
resolutions.
c.) Title - expresses in a single sentence the
substance of the entire resolution.
d.) ‘Whereas” Clauses - that which enumerates the purpose
of the resolution
e.) Main Resolutory Portion- that which shows the name
of the principal authors, the certification of
the presiding officer and attestation of the
SK Secretary; and the final approval of the
SK Chairman.

WHEREAS, the Welfareville Compound in the Barangay of San Vicente
is a public property belonging to the National Government;
WHEREAS, said property is no longer utilized for its original purposes
nor for ay other purpose;
WHEREAS, the promotion of sports and athletics and of community
development and beautification are all in line with national
government policies and objectives;
WHEREAS, the Welfareville Compound, by its location, size and
physical make-up, is ideal for an athletic and recreational park;
now therefore, be it
RESOLVED, That the Sangguniang Kabataan of San Vicente petition,
as it hereby petitions, the President of the Philippines to set aside
the property known as the Welfareville Compound as a national
athletic and recreational park, and to cause its development
for such purposes.
