Whereas, the FIRST Party desires to lease Dump Trucks, Backhoes, Bulldozers,
Payloader and other Operating Equipment from the SECOND PARTY.
Whereas, the
MEMORANDUM OF AGREEMENT
FJ TRADING AND INDUSTRIAL SUPPLY, a business firm duly registered with the
Department of Trade and Industry (DTI), with office address located at Poblacion,
San Jose, Dinagat Island, represented in this act by its Authorized Operation
Officer, JEFRIE C. TELBE, hereinafter referred to as the “FIRST PARTY”;
AND
WHEREAS, THE SECOND PARTY provides, manages and responsible for the
operation on the use of Dump Trucks with a minimum capacity of 14 cubic meter
dump boxes, units of Backhoe with a minimum capacity of one (1) cubic meter
(bucket) and units of other operating equipment and willing to lease the same to
the FIRST PARTY.
For the use of units of Dump Trucks and units of Backhoes for the said
purpose, the FIRST PARTY obligates to pay the SECOND PARTY the following rental
rates:
For a minimum of ____ units Dump Truck (per hour) with ___ Units
Backhoe (per hour), Bulldozer (per hour) and Payloader (per hour), the FIRST
PARTY obligates to pay the SECOND PARTY a Haulage Contract Price of ________
_____________ per metric Ton from the operation site to project site (Barging).
That CHARITO D. ACOSTA is willing to buy said lot including the improvement
therein (building is presently occupied by Charito Acosta) from Ismail Mamokan in
the amount of One Million Pesos (P 1,000,000.00) in an installment basis but to
be paid in full amount within the period of one year starting at this month of
September 2015 and to end in August 2016.
That Charito D. Acosta will give Two Hundred Thousand Pesos (P 200,000.00) to
Mr. Mamokan at this instant as initial payment and the remaining balance of Eight
Hundred Thousand Pesos ( P 800,000.00) will be paid as follows:
December 2015 - P 100,000.00
March 2016 P 200,000.00
June 2016 P 200,000.00
August 2016 P 300,000.00
Total Amount P 800,000.00
That before giving the full payment in August 2016, such eviction of the house
being occupied by Ms. Neneng Cimagala and Ms. Juliet Alojado was already done
which will be under the responsibility of Mr. Mamokan.
That the lot survey and staking out of cylindrical monuments bounded by the said
lot is under the responsibility of Mr. Mamokan.
That the monthly payment of the house and lot to Ismael S. Mamokan being
represented by Allan. Alipio will be ceased starting September 2015.
That any problem arising from the lot issues will be addressed to Mr. Mamokan.
That all of Mr. Mamokan’s son’s and daughters were informed about this
agreement and agreed by waive rights as required by the law.
That this agreement shall remain binding and effective until further revoked.
Done this 1st day of September 2015 at General Santos city, Philippines.

ACKNOWLEDGEMENT
BEFORE ME, Notary Public for and in the City of General Santos, personally
appeared CHARITO DUMAUP ACOSTA, with residence certificate No.
______________ issued on _________ 2015 at General Santos City and
ISMAEL S. MAMOKAN with Residence Certificate No. ___________ issued on
___________ 2015 at__________________, known to me to be the same person
executed the foregoing MEMORANDUM OF AGREEMENT and they acknowledged
to me the same as their true act and deed for and behalf of the PARTIES they
represent.
