JUDICIAL AFFIDAVIT
I, EDUARDO RAZON Y RIVERA, of legal age, Filipino and a resident of # 21 Purok Munawin
Bitas, Cabanatuan City, Nueva Ecija after having been duly sworn to in accordance with law, herein
below dispose and say;

THAT, Atty. GLENN B. PALUBON, with office address at LCV Bldg., Paseo del Congreso,
Catmon, City of Malls, Bulacan, conducted and supervised my direct examination at his office
aforestated;

THAT, I am answering the questions asked of me, fully conscious that I am doing this under oath
and that I may incur criminal liability for false testimony or perjury. Some of the exhibits attached are
photocopies, which I warrant to be faithful reproduction of the original, which will be presented during
hearing for the reception of my testimony.

THAT, the following are the questions asked of me by Atty. Glenn B. Palubon, which I gave him
consecutively numbered, to wit:

1. Q: Are you the same EDUARDO RAZON Y RIVERA, who is the petitioner in this case?

A: Yes, sir.

2. Q: You said that you are the one of the registered co-owners over a parcel of land. What parcel
of land you are referring Mr. Petitioner?

A: A certain parcel of land located at Brgy. Tabang, Bulakan, Bulacan, covered by and
embraced in Transfer Certificate of Title No. T-102983, sir.

3. Q: Mr. Petitioner, you handed to me a Certified True Copy of Transfer Certificate of Title No.
T-102983. What is the relationship of this TCT to the one which you said covers the parcel of land
registered in the names of Sps. Marcelo V Burdeos & Rebecca Castro, and Jesus O. Dasmarinas.

A: That is the same, sir.

4. Q: You also handed to this representation a Certified true Copy of a Tax Declaration No. 2014-
05008-00179, what is the relationship of this tax declaration to the you said covers the parcel of land in
Brgy. Tabang, Bulakan, Bulacan?

A: That is the same one sir.

(The Certified True Copy of Tax Declaration No. 2014-05008-00179 is marked as Exhibit “D”)

5. Q: Mr. Petitioner, how many duplicates of the said certificate of title are there, as far as you
know?

A: There are two (2) duplicate copies, Sir.

6. Q: Mr. Petitioner, where are those two (2) duplicate copies?

A: The owner’s duplicate copy of the said TCT is in my custody and my possession, and the
other one Co-Owner’s Duplicate copy was then also in my custody but was found to be missing from my
personal files in and despite my earnest efforts exerted to locate or recover the said CO-OWNER’S
DUPLICATE COPY, the same has not been found nor recovered as evidenced by my Affidavit of Loss,
executed in April 27, 2017.

7. Q: You mentioned that you executed an affidavit of loss do you have proof that there is such
an affidavit?
 A: Yes, sir, I have an electronically generated photocopy Sir, the original of the affidavit is
with the Register of Deeds. Here it is sir.

8. Q: You said that the original of this document is with the Register of Deeds, what is your
proof that the original exist and is on file with the RD?

A: The entry with number __________________ on page _____ of the electronically

generated certified true copy of the certificate of title and the stamp received on the affidavit of loss, sir.

9. Q: Can you show thus representation the entries that you are referring to?

A: Yes, sir. (Witness point to the Entry No. ___________________ appearing own page __ of
TCT No. T-102983. Here sir is the entry regarding the affidavit of loss. (The entry pointed out by
witness is marked as Exhibit ‘E”)

10. Q: Who is paying the real estate taxes of the property at this time?

A: I am the one sir.

11. Q: What is your proof, Mr. Petitioner that you are paying the real estate taxes of the said
property?

A: I have an Official Receipt with the number 0088399 issued by the Office of the Treasurer,
Municipality of Bulakan, dated ____________. Here it its.

Bulacan dated __________ is marked as Exhibit “F”)

12. Q: Now, Mr. Petitioner, what would you request the court to do in connection with your
petition?

A: That a new co-owner’s duplicate copy of TCT No. 102983 be issued sir, so that the
transactions involving the said parcel of land could be registered with the Register of Deeds, Sir.
