Judge: James Taylor I, Christopher Cleary, hereby acknowledge and certify that I have been advised of and understand the following: Notification of Charges Tam pleading guilty to the following crimes that carry the punishments indicated: 1, ATTEMPTED THREAT OF TERRORISM Utah Code § 76-5-107.3(1)(b)(i) Third Degree Felony 0-5 years in prison Up to $5,000 fine + 90% surcharge $43 security fee Ihave reviewed a copy of the Second Amended Information filed against me. I have either read it or had it read to me. I understand the nature and elements of the crimes to which I am pleading guilty. The elements of the crimes to which I am pleading guilty (or no contest) are: 12 bodily injury, death, or substantial Attempted to threaten to commit any offense invol! property damage and acted with intent to intimidate a civilian population. understand that if I plead guilty I will be admitting that I committed the crimes listed above T acknowledge that the following facts describe my conduct and that these facts provide a basis to accept my plea of guilty and that such facts constitute elements of the crimes for which I am pleading guilty: On or about January 29, 2019, in Provo, Utah, I posted on Facebook a message stating | was going to shoot up a public place and kill as many women as I see. Waiver of Constitutional Rights Tam entering these pleas voluntarily. I understand that I have the following rights under both the Constitution of Utah and the Constitution of the United States. I also understand that if I plead guilty I will be giving up all of the following rights: Counsel: I know that I have the right to be represented by attorney. If I cannot afford one, the Court will appoint an attorney at no cost to me. Tunderstand that I might be required to pay a portion of fees eamed by an appointed attorney if the judge determines that I am able to do so. I have not waived my right to an attomey. My attorney is Dustin Parmley. My attorney and I have fully discussed this statement, my rights, and the consequences of my pleas. Jury Trial: I know that I have the right to a speedy and public trial before an impartial and unbiased jury. By entering a plea of guilty I will be giving up my right to a jury trial, Confrontation and cross-examination of witnesses: If I choose to go to trial, I would have the right to see and listen to all witnesses who testify against me. I would also have the right to have my attomey cross-examine each of those witnesses. Right to compel witnesses: If I choose to go to trial, I would have the right to call ‘witnesses in my behalf and to have subpoenas issued by the judge to make those witnesses attend my trial and give testimony and I have the right to have the State pay witness fees for my witnesses. If the judge determines that I am unable to pay other necessary expenses for such witnesses, the judge may order the State to pay such costs. Right to testify: If I choose to go to trial, I would have the right to testify in my own behalf. Right to exercise my privilege against self-incrimination (my right not to testify): If 1 choose to go to trial, I would have the right to choose not to testify. No one could make me testify if I did not want to, including the judge, the prosecutor, or even my own attorney. If I were to choose not to testify, the jury would be instructed by the judge that they could not hold my choice not to testify against me, Presumption of innocence: The law provides that I am presumed innocent of all charges filed against me. If I do not desire to plead guilty, I simply have to plead “not guilty” and my case will be set for trial at the next date available to the judge, the prosecutor, and my counsel. If I choose to go to trial, I would have the right to have the jury instructed by the judge that they are
