the body worn camera footage, I found the contact to be professional and in my opinion, the Officers showed a lot of patience. NO violations of policy and or law

complaint, 14-P01144. He feels Ofc. Lambley racially targeted him and in general was rude. She also refused to identify herself. He also
said as she and Ofc. Gordon were leaving, Ofc. Gordon warned him not to follow the, which he felt was threatening. I explained there would
be body cam and he insisted on filing a complaint and implied this was a racial thing.

Tennant's Investigation:

On 2-10-14 at 1600 hrs I called 1 - Right to Privacy (Corrected phone # 1 - Right to Privacy and spoke to him about his complaint. He was very
adamant that he wanted to file a formal complaint and that the officers were racially biais against him. I asked if he was hispanic (He said
he was) and I clarified that it was his Hispanic heritage that he thought invoked the bias response by the officers, and he indicated that it
was. I asked 1 - Right ... to explan the contact from his perspective. 1 - Righ... said that he was at a party and just chose that moment to go outside
to get some fresh air. The officers contacted him as if he lived there and asked him questions that he didn't know the answers to. He tried
to the best of his ability to answer the questions, but the officers kept badgering him for information that he didn't have. At one point the
officers acussed him of being high (on MJ) and told him not to follow them. 1 - Right...believes both are because he is hispanic. 1 - Right ...also
focused on the fact that when he re-entered the Apartment the officers tried to illegally enter the residence. I told 1 - Rig... that I would review
the video from the contact and proceed with a formal investigation and complaint.

I reviewed PPD Noise Complaint # 14-P01144. ON 4-25-14 I attempted to watch the body worn camera video's from the two officers.
However, Evidence.com software problems prohibited me from viewing them.

4-26-14 0800 hrs: I was able to watch Officer Lambley's and Officer Gordon's Body Worn Video Footage in Evidence.com. Gordon's video
is masked by the wind noise and most of the coversation between 1 - Right... and Lambley can not be overheard on Gordon's video. You can
hear Gordon tell 1 - Righ... "not to follow" them when they leave. This was after 1 - Rig... had followed them to the cornor of the building after they
tried to leave the contact at the door. Gordon's request was polite and in a normal voice and seemed reasonable based on the
circumstances.

I watched Lambley's video which showed the contact from start to finish. She approaches the apartment door and the party noise is very
aparent from the outside. She knocks five times with no response, then announces "Police, can someone just answer the door?" 1 - Rig...
immediately opens the door, steps out, and begins talking to the officers. Lambley assumes that he is exiting the door in response to her
knocking and annoucing, and starts speaking to him as if he is a responsible for the party. She informs him of the strong smell of Marijuana
eminating from the apartment. 1 - Righ...'s demeanor is quiet but he interacts with the officers leading the officers to believe that he is
responsible for the party during the first half of the conversation. When the officers are getting no where in the conversation reference the
party (Most of 1 - Rig... 's responses are I don't know…..), Lambley figures out that he is not a responsible and asks him to go back into the
party and find someone that lives there. 1 - Righ... appears to agree to do that and re-enters the apartment. When 1 - Righ... comes back out, he
accuses Lambley of opening the door and trying to enter the apartment unlawfully (She stepped back from the door on video and clearly
doesn't attempt to open it). 1 - Righ... is more confrontational verbally at this time and the officers tell him that they will just contact the landlords
later and write the occupants for the noise. 1 - Right... follows the officers to the cornor of the building requesting identifications. Gordon verbally
identifies them, and Lambley shows1 - Right ... that she doesn't have any business cards with her. They finally depart.

Tennant's opinion and recommendation:

Unfounded. There is no indication that any racial bias is present in the interaction. I found the officers to be very polite, professional and
demonstrated a great deal of patience. 1 - Right ... intentially mislead the officers and contiuned a conversation with the officers that was totally
unnecessary.

I concur with the conclusion's of Commander Tennant and the disposition as unfounded. I prepared a disposition letter that was sent to Mr.
1 - Right ...
