Whereas, FlRs have been registered under Section 15 3 -A, 15 3 -B, 17 1 -G, 5 05( 1 ),

505(2) of Inclian Penal Cocle ancl Section t25 of the Representation of the People Act,
1951 in the aforementioned cases; ancl

Whereas, your said statements have been widely published in the electronic and
print media; and
 Whereas, Para (2) o1'Parl I 'General Conduct' of "Model Code of- Conduct for

the guiclance of lrolitical Parties and Candiclates" provides that Parties and Candidates
shall refrain from criticism of all aspects of private life, not connected with the public
activities of the leaders or workers of other parties. Criticism of other parties or their
workers based on unverified allegations or distortion shall be avoided; and

Whereas, Irara (3) of the said Part 1 inter-alia, provides that there shall be no

appeal to caste or communal feelings for sscuring votes, and Pata (4) of the Part I
provicles that all parties ancl candidates shall avoid scrupulclusly all activities which are

corrupt practices and ofTences under the election Iaw; and

Whereas, sub-section (3) of'section 123 ot'the Representation of the People Act,

1951, which deals with'Corrupt Practices' provides:

"Tlte appeal blt a candidate or his agent or by any other person with. the consent
oJ'ct cancliclate or his election a.gent tct vote or re/iain/rom votingfbr any person on the

dl ground. oJ his religion, race, casle, community or language or the use of, or appeal to
yel.igious slmtbols or the use of, or appeal to, national symbols, such as the national.flag

cartclic{al:e or/ttr prejudicially aJJbcling the election ofany candidate.'..."; and

Whereas, the Hon'ble Suprerne Court of India, vide judgemenl and Order dated

2.1.2017,in Civil Appeal No 37 of 1992 (Abhirarn Singh vs C. D. Commerchen and

others), with Civil Appeal No.8339 of 1995, has held that Religion and Caste cannot be

used by anyone while making any statement during electioneering or other"wise; and

Whereas, sub-section (3A) of Section 123 of the said Act provides:-

"The promoti.on o./, or attempt lo promote, feeli.ngs of enntity or haffetl belween

ctdfbrent classes ctf the citize.ns o/'tnctia on grouncls of'religion, race, caste, commrunity,

of lctnguctge, by a candidate or his agent or atxy other person with the consent of a
can.didate or his election agent for the ./urther'(tnce o/"the prospects oJ'the election of
that candiclate or /br preju.c{icially affbcting the electictn qfarty candidate. " ; and
 Whereas, Section 125 of the Representation of the People Act, 1951, which deals

with 'Prornoting enrnity between classes in connection with election', provides:-

"Any person who in connection with an election under this Act promotes or

attempts to promote on ground of religion, race, caste, community or language, feelings

of enmity or hatred, between dffirent classes of the citizens of India shall be punishable,

with imprisonment for a term which may extend to three years, or with fine, or with
both.; and

Whereas, the Cornmission has, vide its Order no. 437lUP-HPl20l9, dated

15.04.2019 reprimanded you fbr making derogatory statements against a contesting

candidate fiom 7-Rampur PC and bar:red you from holding any public meetings,
public processiorrs, public rallies, road shows and interviews, public utterances in
media (electronic, print, social media) etc. in connection with ongoing elections for
72 hours; and

Whereas, the Commission is prirua Jbcie of the opinion that you have violated

the albresaid provisions o1'the MCC, the relcvant sections of the Representation of the

People Act, 1951 and also willully disobcyed the afbresaid Order of Hon'ble Supreme

Court by rnakit"rg the highly obiectionerble ancl provooative aforesaicl statements;

Now, therefbre, the Commission, after considering the available material and
extant instrr-rctions on the rnatter, has decided to provide you an opportunity to explain
your stand regardir-rg the said statements. Your explzuration shall be submitted within 24
hours ol receipt of this Notice, failing which the Commission shall take a decision
without lurther relerence to you.
