RESOLUTION

The respondent PRECIOUS LOREN SANCHEZ is charged with the crime of Cyber
Libel as provided under Section Sec. 4 (c) (4) RA 10175 otherwise known as the Cybercrime
Prevention Act of 2012, by the performance of acts of Libel under Art. 353 of the Revised Penal
Code through a computer system.

In support of his complaint, the herein complainant attached the following documents:
1. Complaint-Affidavit of Lito Bungog
2. Affidavit of witness Marlene Punsalan
3. Affidavit of witness SPO2 Dick Sison
4. Printed copies of screenshots of relevant libellous statements of social media platform
“Facebook”

Statement of Facts
Based on the investigation conducted by SPO2 Dick Sison, the facts of the case are stated
hereunder:

That on the dates of February 16, 17, 18, 20, 21, 22, and 23, 2019, in the City of
Marikina, National Capital Region, Philippines and within the jurisdiction of this
Honorable Court, accused PRECIOUS LOREN SANCHEZ, with malicious
intent, did then and there, wilfully, unlawfully, and feloniously publish statements
imputing upon the person of LITO BUNGOG and VACAYEAH TRAVELS the
conduct of crime, vices or defects, and acts tending to cause dishonour and
discredit to such names, and performing the act through a computer system.

CONTRARY TO LAW

In the affidavit of the complainant Lito Bungog, he stated that the respondent attempted
on February 8, 2019 to procure his services in the business of Vacayeah Travels for a hotel and
tour at Puerto Princesa for the days of February 13-16, 2019. Despite his protests, the accused
insisted on the task despite the complainants warnings that it was an impossible or futile
endeavour. Upon learning of his failure, the respondent then presumably created the libellous
statements available to the public. The complainant discovered this after a suspicious decline in
business and confirmed it through the notification of witness MARLENE PUNSALAN.
The respondent was duly served a subpoena to submit her counter-affidavit and any
relevant documents for the preliminary investigation. However, she failed to do so within the
given time period. As such this resolution shall be based only on the evidence presented by the
complainant.

The following facts and circumstances based on the personal knowledge of the
investigating officer SPO2 Dick Sison shows that there is probable cause to believe that the
respondent Precious Loren Sanchez has committed the crime:

1. The respondent was known to have approached the complainant and his business on
February 8, 2019.
2. The respondent reacted negatively from the complainant’s apparent failure to comply
with her wishes.
3. On the weeks following the dates that the respondent wished to be at Puerto Princesa, the
complainant noticed a decline in business.
4. The witness Marlene Punsalan notified the complainant of shocking malicious statements
publicly available over the social media platform “Facebook” directly referring to him by
name and his business by name.
5. Screenshots of the libellous facebook posts as well as the personal knowledge of the
investigating officer show the exact dates of the posted statements as well as the identity
of the facebook account making the posting of the messages.
6. The account name of the facebook posts point to the respondent Precious Loren Sanchez’
facebook account.

WHEREFORE, IN VIEW OF THE FOREGOING, it is most respectfully recommended


that an information be filed for the crime of Cyber Libel as provided under Section Sec. 4 (c) (4)
RA 10175 otherwise known as the Cybercrime Prevention Act of 2012 against the respondent
PRECIOUS LOREN SANCHEZ. Bail of Php 10,000.00 is recommended.
