DEED OF ABSOLUTE SALE

KNOW BY ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE is made, executed and entered


into by:

SPS. FLORENTINO S. RASCO JR. AND FLORIVIC C. RASCO,


both of legal ages, Filipino, and with residence at Block 1, Lot 26,
Garnet St. Villa Esmeralda, Sta. Rosa, Laguna, hereinafter
referred to as the “SELLER”

-and-

SPS. JERRY M. MALTO AND ROSEMARIE N. MALTO, both of


legal ages, Filipino, and with residence at 197 Lagadon St.,
Namuac, Sanchez Mira, Cagayan, hereinafter referred to as the
“BUYER”

W I T N E S S E T H;

WHEREAS, the SELLER is the registered owner of a parcel of land with


all improvements therein located at Lot 7 Block 1, Barangay Pulong Sta. Cruz,
Municipality of Sta. Rosa, Province of Laguna and covered by Transfer
Certificate of Title No. 060-2019006179 of the Registry of Deeds for Province of
Laguna, Calamba Branch, with a total area of Forty-Five (45) square meters,
more or less and more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE NO. 060-2019006179

A parcel of land (Lot 7, Blk 1 of the Consolidation-Subdivision Plan


PCS-04-027274, being a portion of Lot 2223-C-1, PSD-04-199780, Lot 3-
A, PSD-04-129713 and Lot 3-B-3, PSD-04-199382) situated in the
Barangay of Pulong Sta. Cruz, Municipality of Sta. Rosa, Province of
Laguna. Bounded on the SE., along line 1-2 by Lot 8, Blk 1 of the
Consolidation- Subdivision Plan.; on the SW., along Line 2-3 by Lot 3-B-2,
PSD- 04- 199382; on the NW., along Line 3-4 by Lot 6, Blk 1 and on the
NE., along Line 4-1 by road Lot 13-B both of the Consolidation-
Subdivision Plan. Beginning at a point marked “1” on plan, being S. 24
Deg. 27’ E., 761.04 M. from Mon. 39, Sta. Rosa Estate, T H E N C E
S. 76 Deg. 20’ W. , 8.87 M. to point 2;
N. 13 Deg. 40’ W. , 5.00 M. to point 3;
N. 76 Deg. 20’ E . , 9.10 M. to point 4;
S. 11 Deg. 06’ E . , 5.01 M. to the point of
beginning, containing an area of FORTY-FIVE (45) square meters, more
or less, located inside Berkeley Heights Subdivision, Brgy. Pulong Sta.
Cruz, Sta. Rosa, Laguna.

WHEREAS, the BUYER has offered to buy and the SELLER has agreed
to sell the above mentioned property for the amount of SEVEN HUNDRED
FIFTY THOUSAND PESOS (Php 750,000.00) Philippine Currency;
NOW THEREFORE, for and in consideration of the sum of SEVEN
HUNDRED FIFTY THOUSAND PESOS (Php 750,000.00) Philippine Currency,
hand paid by the buyer to the seller, the SELLER do hereby SELL, TRANSFER
and CONVEY by way of Absolute Sale unto the said BUYER, the certain parcel
of land together with all the improvements, free from all liens and encumbrances
of whatever nature including real estate taxes as of the date of this sale.

Warranties. —The Sellers represent and warrant:

A. The Property is not leased or under an option to sell or lease and is free from
any and all liens, encumbrances, easements, charges and claims;
B. The Buyer shall acquire valid title to and peaceful possession of the Property
and the Sellers shall defend the rights of the Buyer against any claims of third
parties;
C. They have no knowledge of any law, ruling, regulation or fact which will
prevent the Buyer from acquiring good, clean, and valid title to the Property;
D. There are no pending or threatened actions, suits or proceedings affecting the
Property;
E. The owner’s duplicate certificate of that they shall deliver to the Buyer is
genuine and subsisting;
F. All real estate taxes and assessments, national and local taxes on the
Property have been fully paid.

Venue.

In case of litigation, venue shall exclusively be in Manila with exclusion of other


jurisdiction.

IN WITNESS WHEREOF, the parties have hereunto set their hands this 15th day
of May 2019 in Sta.Rosa, Laguna.

acknowledgement is written, signed by them and their witneses and sealed with my
notarial seal, and they acknowledged that the same is their own free act and voluntary
deed and of the person represented.
