INTRODUCTION

Meaning of Legal Aid:


Legal aid is the provision of assistance to people otherwise unable to afford legal
representation and access to the Court system. Legal Aid is regarded as central in providing access
to justice by ensuring equality before the law, the right to Counsel and the right to a fair trial.

Legal Aid which means giving free legal services to the poor and needy people who are unable to
afford the services of an advocate for a conduct of a case or a legal proceeding in any court, tribunal
or before any Judicial Authority. The preamble of the Indian Constitution basically aims to secure
to the people of India – Justice, socia-economic and political.

Meaning And Object:


The meaning and object of the Legal Aid Camp has been clearly explained here that legal aid means
providing an arrangement in the society so that the machinery of administration of justice becomes
easily accessible and is not out of reach of those who have to reach of right given to them by law.
Poor and illiterate people should be able to approach the courts and their ignorance and poverty
should not be an impediment in the way of their obtaining justice from the courts.

Constitutional Provision:
Article 14:-
Article 14 of the Constitution of India provides that the state shall not deny to any person
equality before law or equal protection of law within the Territory of India. The Indian Constitution
(42nd Amendment) Act, 1976 inserted Article 39 (A) in the Chapter of Directive Principle of State
Policy, which enjoy upon the state to secure the operation of the Legal System to promote justice on
the basis of equal opportunity for securing justice so that justice is not denied to any citizen by
reason of Economic and other disabilities.

Article 38 (1):-
It allows the state shall promote the welfare of the people by securing and practising the
social order including justice.

Article 21:-
Clearly says that every person has an equal right to life and liberty except according to the
procedure established by law.

Provision of Legal Services Authority Act:


1 > A State Bar Council may constitute one or more funds in the prescribed manner for the purpose
of giving legal aid or advice according to the rule made in this behalf. [Section 6(2) (3)]

2 > The function of the Bar Council of India shall be to organise legal aid for poor in the prescribed
manner. [Section 7(1) (b)]

3 > The Bar Council may make rule to provide for organisation if legal aid and advice to the poor,
contribution and function of committee and sub-committee for the purpose and description of
proceeding in connection with which legal aid advice may be given. [ Section 15 (2) (36)]

Duty of a student in Legal Aid Camp:-


1 > Prepare carefully with respect to the subject of law though roughly so as to be capable of
providing legal aid of the people.

2 > Preparation of legal awareness manual prepare and translation of a legal aid manual from
English to local language according to the area and their local language.

3 > Manual should be prepared in very simple and easy language and cover specific area of subject.

4 > Acquiring good communication skill in local language so as to understand the problem and
provide likely legal solution very easily to uneducated and poor needy people.

5 > Proper fixation of place : The place to be selected should be remote area covered by poor and
needy people.

6 > After fixation of the place meet with the appropriate authority to take necessary permission to
conduct free Legal Aid Camp.
7 > After bearing necessary permission the student should meet with the local police authority to
inform them about the date of Legal Aid Camp.

Free Legal Aid Camp organised by Dispur Law College students of 3 years LL.B, 5th Semester on
27th November, 2018.
We, the students of Dispur Law College, 3 years LL.B, 5th Semester, 2018 have organised
free Legal Aid Camp on 27th November, 2018 under the guidance of Honourable faculty members
along with our Principal Madam, as per the provision of the course curriculum for practical
fulfillment of legal study as well as the directives of Bar Council of India at Palahguri Village,
Nelly Panchyat, Mayong (Tribal) Block, P.O. Killing Valley, P.S. Jagiroad, Circle Office -
Morigaon, District - Morigaon, Pin - 782413, Assam.

About the Village:-


The village is approximately 65.9 km via NH24 from Dispur Law Collage, Guwahati. The
village had been selected because it had a mixed population. The socio-economic condition of the
people is very poor and the people are mostly tribal an dilliterate and dependent on cultivation. The
village does not have sufficient communication, or electricity, water supply connection and other
infrastructure facilities including pacca road.

According to Census 2011 information the location code or village code of Palahguri village
is 283982. Palahguri village is located in Marigaon Tehsil of Morigaon district in Assam, India. It is
situated 33km away from sub-district headquarter Marigaon and 33km away from district
headquarter Morigaon. As per 2009 stats, Nellie is the gram panchayat of Palahguri village.

The total geographical area of village is 243.7 hectares. Palahguri has a total population of
1,644 peoples. There are about 342 houses in Palahguri village. Jagiroad is nearest town to
Palahguri which is approximately 10km away.
