Sir/Madam:

Greetings of Peace and Prosperity!

This has reference to the MISCONDUCT done by one of your instructors in the person of MRS.
ANTONETTE MAGBANUA which is unethical of being a teacher that transpired OOA 1910H 02 October
2015 in Biological Science 2 class. Kindly be informed that the above-mentioned teacher did not allow
her students to attend to her class because they were late for a few minutes. Instead, she just let her
students stayed outside of their room in the entire duration of 2 hours as the official time of their
subject. Sad to note that if and only the teacher did not forget that she’s in the country where the
system of government is democracy and not dictatorship, she should and must have to listen first to the
reasons of her students. On my investigation, I found out that some were late because they took their
snacks at the school canteen. I guessed, it’s but normal for the students to take something for their
stomachs considering that 7 pm is already dinner time. Others were late for some reasons, but this
teacher DIDN’T AND WON’T listened to her student’s reasons because she is SO MUCH USED TO HER
TRADITIONAL WAY OF DISCIPLINING STUDENTS. How INCONSIDERATE and INSENSITIVE teacher
towards her students? Isn’t it? I want you to know that this is not the first time that this teacher did this.
But, nobody is brave enough to tell this to proper authority.

Further, I’d like to give stress to this problem in connection to my wife Andrea May Danda Ares who was
one of those students who were not allowed to get inside their class in spite that she was only late for
10 minutes. Iwon’t defend my wife if she’s a habitual late comer but, she’s not. In fact, that was her first
time to attend to her class in that particular subject late. Thinking that the students of Mrs. Magbanua
are our future teachers someday, she should teach by example. She should be a role model to them.
Imagine, according to my wife, if their teacher is the one late, it’s a BIG OK. But if the students are the
ones late, it’s a BIG NO NO NO to attend to her class.

I couldn’t see where in the world this practice of the above – mentioned instructor is acceptable. I can’t
feel if where and how to understand and tolerate such action because I’m also a college instructor
during my off time. In fact, presently I’m a part-time instructor of Universidad de Zamboanga Ipil. Not
only that, I’ve been a faculty member of WMSU-Pagadian and Molave for long years when I was still
assigned their that’s why I’m very much knowledgeable in so for as the WMSU Policy on attendance of
students is concerned.

IGNORANCE OF THE LAW EXCUSES NO ONE. Under the Constitution of the Republic of the Philippines
Article XIV Sec. 1. The state shall protect and promote the right of all citizens to quality education at all
levels, and shall take appropriate steps to make such education accessible to all. Section 3 (2)They
shall inculcate patriotism, foster love of humanity, respect for human rights, appreciation of the role of
national heroes in the historical development of the country, teach the rights and duties of citizenship,
strengthen ethical and spiritual values, develop moral character and personal discipline, encourage
critical and creative thinking, and promote vocational efficiency. Section 5 Academic freedom shall be
enjoyed in all institutions of higher learning.In Batas Pambansa Bilang 232 “Education Act of 1982”
Chapter 1 Sec. 5 (2) The state shall promote and safeguard the welfare and interest of the students by
defining their rights and of their privileges, and encouraging the establishment of sound relationships
between them and the other members of the community. Chapter 2(Rights of Students) Sec. 9(1) The
right to receive, primarily through competent instruction, relevant quality education in line with nation
conducive to their full development as person with human dignity. (7)The right to free expression of
opinions and suggestions, and to effective channels of communication with academic channels and
administrative bodies of the school or institution.Chapter 3 (Duties and Obligations of Teachers) of Sec.
16(4) Assume the responsibility to maintain and sustain his professional growth and advancement of
professionalism in his behavior AT ALL TIMES. (5) Refrain from making deductions in students’
scholastic rating for acts that are clearly NOT manifestation in scholarship. (6) Participate as an AGENT
of constructive social, economic, MORAL, intellectual, cultural and political change in the community
within the context of national policies.
ICON the above – cited provisions of our law, the undersigned prays and request to the honorable
Disciplinary Board for an immediate and appropriate action against such erring instructor. Or, if your
good office will recommend me to bring this matter to the main campus and to the Commission on
Higher Education.
