SPECIAL VERDICT

TWELFTH COUNT (MURDER OF KIDNAPPED PERSON- MICHAELA PETIT)

I. ALLEGED STATUTORY MITIGATING FACTORS.

The defendant claims the existence of the following statutory mitigating factors:

1. Steven Hayes’ mental capacity was significantly impaired but not so impaired as to
constitute a defense to prosecution. C.G.S. § 53a-46a(h)(3).

2. Steven Hayes’ ability to conform his conduct to the requirements of law was
significantly impaired, but not so as to constitute a defense to the prosecution. C.G.S. §
53a-46a(h)(3).

3. Steven Hayes could not reasonably have foreseen that his conduct in the course of
commission of the offense of which the defendant was convicted would cause or would
create a grave risk of causing death to another person. C.G.S. §53a-46a(h)(5).

Has the defendant proven by a preponderance of the evidence the existence of a statutory
mitigating factor?

II. ALLEGED AGGRAVATING FACTORS

A. First Alleged Aggravating Factor

Has the State proven beyond a reasonable doubt that the defendant committed the offense
during the commission of, or during the immediate flight from the commission of a felony and
he had previously been convicted on eight occasions of the same felony, to wit: Burglary in the
Third Degree (Section 53a-103(a) C.G.S.)?

sentence of life imprisonment without the possibility of release.

If your answer to either or both of the above questions is “YES,” you must proceed to the
next portion of the Special Verdict form.

III. NONSTATUTORY MITIGATING FACTORS.

(Nonstatutory mitigating factors are such as do not constitute a defense or excuse for the
capital felony of which the defendant has been convicted, but which, in fairness and mercy, may
be considered as tending either to extenuate or reduce the degree of his culpability or blame for
the offense or to otherwise constitute a basis for a sentence less than death.)
Do one or more jurors find, by a preponderance of the evidence, that a particular factor
exists concerning the defendant’s character, background or history, or the nature and
circumstances of the crime that is mitigating in nature, considering all the facts and
circumstances of the case?

IV. WEIGHING PROCESS.

Are you unanimously persuaded beyond a reasonable doubt that the aggravating factor or
factors you find in Part I outweigh the nonstatutory mitigating factor or factors found by one or
more jurors by any degree or amount and are you, therefore, persuaded beyond a reasonable
doubt that death is the appropriate punishment on this count?

___ YES. The jury unanimously finds that it is persuaded beyond a reasonable doubt that the
aggravating factor or factors it finds in Part I outweigh the nonstatutory mitigating factor or
factors found by one or more jurors and it is, therefore, persuaded beyond a reasonable doubt that
