1.1 Anicle 62, Rule Xlll of the tmplementing Rules and Regulations of rhe Local f olr
Government Code of 191 (Republic Act No. 7150) mandates local govemmenr
units to promote the esmblishment and operation of people's org,anizadons, non-
governmental organizations, and the privare sector, to make them active psnners
in the pursuit of local autonomy, and to directly involve them in the plans,
programs, proiects or activities ofthe local government unit, such as, but not l.imited
to, membership in local special bodies (lSBs) and involvement in the ddvery of
basic services and facilities.

1.2 Anicle 64 of the same Implementing Rules and Regulations provides for the
procedures and guidelines for the selection of representatives of CSOr in local
special bodies and the criteria for accrediration that shall 6uide the coniemed
Sanggunian on the accreditation of CSOs for the purpose of represenution to the
local special bodies.

1.3 Good governance is vital in the pursuit of excellence in local public administration
and development. This Depanment recognizes that in forming a sustainable
foundation of good governance, it is nor enough to concentrate on developing the
internal capacity of local governmene. h is equally imponant to develop and
strengthen paftnerships with CSOs in order to empower citizens to aniculate their
needs as they panicipate in the decision-making process, program planning,
implementation and monitoring ar the local level which can ihcnibse the
responsiveness and efficiency of local governments in delivering servites. ,,'

t.4 The Accreditation of CSOs is a continuous process wherein a CSO may apply and
obtain accreditarion at any dme. The only legal effect of nor applyirg for
accreditation within the period prescribed by law and reiterated in rhis
Memorandum Circular, is that such organization is not entitled for a reprcser,ration
in a local special body.

1.5 This Memorandum Circular is issued to provide rhe guidelines on the F.ocess for
accreditation and selecrion of CSO8 and their representatives to the local special
bodies, and to strengthen their panicipation in local governance and development
processes, reiterating and strengtiening the provisions of RA 7160 and its
Implementing Rules aud Regulations.

2,0 COVERAGE

2.1 This Memorandum Circular shall cover all provinces, cities and
municipalities, and
all civil society organizations intending to apply for accreditation to seek
representation in the local special bodies.

2.2 A civil society organization and its chapters, affiliates, offices


or local organizations,
and an organization that does not coyer an entire local government
unit are also
covered by this Memorandum Circular. Such organization
may be qualified for
accreditation in the localities where such endries operate: provided
that, (a) rhey
comply with all the requiremen* and crireria sei forth'in
this Memorandum
Circular and (b) their programs or proiects have significant
conrribution to the
concerned local government unjt.

2.3 This Memorandum Grcular shall only involve the accrediution process
for CSOs
for the purpose of representation in the local special bodies.

3.0 DEFINmOIIS

3.1 Civil *rietyOrganizaarbr, (CSO) - refers to a non_shte and non_profit


association
that works to improve society and the human condition. Basic
types ofCSOs include
non-governmental organization, civic organization, cmperative, social
movement,
professional group, and business group. In this Memorandum
Grcular, the terms
'CSO" and "organization- are used interchangeably.

3.2 Non-Govemmental Organization - refers to a non-stock, non-profit


organizatlon
that works with differcnt sectors and communities, promoting their general
weltare
and development, provide a wide range of services for people,s orianization
and
tends to operate
with full time staff. Social development organirations, fountlations,
and independent research in$itutions fall in this category.

3.3 Pmple's Otganiz-ation - refers to an association of residents in a barangay, or


barangays, established to promote public interest and with
an identifiabre leaclership
structure and membership. people,s organizations are
often formed among thl
disadvantaged sectors of society such as the farmer-peasant,
anisanal trsher folk,
workers in the ficrmal sector and migrant workers, workers in the intbrmal
secror,
indigenous people and cultural communities, women, differently-abled persons,
senior citizens, victims of calamities and disasters, youth and stu<.lents,
children, and
urban poor.

3.4 Indigenous Paple's Organization - refers to a priyate, non_profit, voluntary


organization of members of indigenous cultural communities (lCG) or indigenous
people (lPs), which are acccptcd as representatives ofsuch ICCs or lps.

3.5 Coo.terative - refers to an autonomous and duly registered association o[ persons


with a common bond of interests who have volunrarily
ioined together to achieve
their social, economic, and cultural needs and aspirations hy iaking equitable

contributions to the capital required, patronizing their producrs
and services and
accepting 0 fair share ofrisks and benefits ofthe
undenaking in accordance with the
universally accepted cooperative principles.

3.6 Civrc Organization- refers to any local service club, fraternal


society or association,
volunteer group, or local civic league or association not
organized for profit but
operated exclusiyely for educational or chariable purposes,
in-cluding the promotion
of community welfare, and rhe net earnings of which
are devoted exclusively ro
charitable, educationd, recreational or sociJ welfare purposes.

3.7 Social.Movement - refers to a large informal grouping ofindividuals or organrzation


that aims ro aflect social change througt sustainea, oig"nized
and collective action.
Some social movements are not permanent institutions
but instead tend to coalesce,
pursue their aims, and then dissolve. Religious movements
are included in this
category.

3.8 Professional Group - refers to a duly incorporated non_stock corporation of


registered professionals established for the benefit and
welfare of the profbssionals
of one discipline, for the advancement of the profession itself
and for the other
professional ends.

3.9 Business Group - refers to a non-stock corporation composed of businesses in the


same industry established to pursue the inrere$ of
the industry. Chambers of
commerce and indu$ry associadons fall in this category.

3.10 Recognized Orgaaizatnn - refers to an organization allowed by the Sanggunian to


participate in a local special body for purposes of meeiiog the minimum
requirements for membership. An organization may only
be recognized if it meets
all the criteria excep( for regis[ation.

3.1I Registered or Accredited Organhation


- refers to an organization that obtains
r€gi$ration ftom the Securities and Exchange Commission, Coaperative
Development Autlrority, Depanment of Labor and Employment,
Depanment of
Agriculture, Depanment ofAgrariau Reform, National Housing Authority,
Hcusing
and Lrnd Use Regulatory Board or any other national go\r"*In"nt
agency that is
empowered by law or policy to accredit or register such orgaoizations.

3.12 Accreditation - refers to the proces ofgranting authorization, within


60 days from
the organimtion ofthe newly elected Sanggunian, to an organization
for purposes of
representation to a local special body. An organization may
still be sccredited after
the prescribed 60-day period for other purposes, such as participation in local
SovenuDent Prograrns.

3.13 Inventoty- refers to the pro€ess ofgathering CSO information from, among ilthers,
CSO networks, the DILG Provincial CSO Network Map, and other National
Government Agencies empowered to accredit or register. The output
ofthis process
is a Directory.

3.14 DirLtk ty - refers to a document which contains profile of CSOs in a local
SOvernment.

3.15 htcal Spxial Bodies- rcfer to the Iocal Development Council,


Iaal Health Board,
l.ocal School Board and local peace and Order Council.

4.0 GBNERAL GTJIDEIJNES

The following guidelines are hereby prescribed for


the guidance ofall concerner.l:

4.1 Inventory end Directory ofCivil Sciery Orgsnizeionr

4.1.1 All prwinces, cities and municipalities shall conduct an inventory to generate
or update rheir ex.istinB Directory of CSOs. The final updated
Directory shall
serve as the source document for the isuance of Notices
of Call for
Accreditation.

4.1.2 The Governor or Mayor shall engage the suppon ofthe head
oft}te DILG Field
Office, other appropriate National Govemment Agencies, and CSO Network,
ifany, in rhe conduct of such inventory and in the preparation of the

Direcrory.

4.1.3 Wirhin the l" week of fuly, both the schedule of the conduct ofrhe inventory
shall be announced and the existing Directory of CSOs shall be gxted
in thl
provincial, city, and municipal hall bulletin boards and, if
applicable, through
th€ LGU website, social and./or print media. Concemed CSOs may
coordina-te
with the LCU through the planning and Development Offrcer or the duly
designated LGU appointive offrcial for inclusion in the direcrcry
and/or
updating of their organizational profile.

4.1.4 Wirhin the l" to 2d week of July, every provincial Governor, Gty Mayor, and
Municipal Mayor shall cause the inventory of all existing CSOs
operadng
within fie local government unit, to be conducted by the Rlanning ani
Development Officer or by a duly designated LGU appointive ofEcial.

4.1.5 Thc Planning and Development Oflicer or duly designated LGU appointive
ofEcial shall ensure that all qisting CSOs operating within tlie lccal
Sovernment unit are covered by the conduct ofthe inventory.

4.1 .6 On the basis of the said inventory, a final updated Directory of Civil Society
Organizations is to be prepared, and shall contain the following information for
each CSO:

4.t.6.1 Name of the organization;


4.1.6.2 Contact information (office address, telephone number, fax number,
email address, and website, ifany);
4.1.6.3 Organization's oblectives or purposes;

4.1.6.5 Community or communities served or currently being served:
4.1.6.6 Prolect development and implementation track record;
4.1.6.7 Name and telephone or fax numbers of offrcials, as well as, list
of
membersi
4.1.6.8 National, regional, provincial, city, and municipal, affiliations, ifany:
and
4.1.6.9 Registration information (whether the organization is registerc{, and
by which governmenr office, or with a pending registratiJn).

4.1.7 Within the 3d to 4,h week of July, the initial draft of the Directory shall
be
posted in at least three (3) conspicuous places within the province, ciry or
municipality and, if applicable, through the LGU website, social and/or print
media, to give rime rc CSOs in the draft Drectory to verify the information
therein, and for CSOs which are not in the draft Directory to requesr
to be
included by informing the planning and Development Officer oi
the duly
designated LGU appointive official.

4.t.8 By the last working day ofthe 4th week ofJuly, the final updated
Directory of
CSOs shall be posted in at least thre€ (3) conspicuous places within
the
province, city or municipaliry. The same shall also be posted in
the LGU
website, social and/or print rnedia, ifapplicable.

4.2 Call for Accreditation

4.2.1 Withia l. week of August, the Sanggunian shall issue a Notice of Call for
the
Accreditation to all the CSOs listed in the final updated Directory of tiSOs,
whether previously accredited or seeking accrditation for the firsr time.
through the conducr of a CSO Conference thar shall be conducted by the local
govemment unit.

4.2.t.1 'Ihe Sanggunian shall also see to it that, within the 1., week ofAugust,
copies ofthe Notice ofCall for Accreditation are prominently po6ted
in at least rhree (3) conspicuous places within rhe municipslity, city
or province. The same shall also be posted in the LGU website, social
and./or print media, if applicable.

4.2.2 The CSO Conference shall be conducted to enhance rhe awaren€ss and
understanding of CSOs on the importance ofcivil society panicipation,
and to
increase their capacity to effectively engage in local governance,

4.2.2.t The CSO Conference shall be handled by the DILG provincial


Director, City Director, City local Government Operations CXIicer
and Municipal l.ocal Government Operations Officer or their
designated DILC personnel, and the concerned planning and
Development OIEcer.

4.2.2.2 The CSO C.onference shall cover four major topics: a) relevance
of
participatory govemance; b) guidelines on LGU accrediution
ofCSOs
and reconstitution of tSBs; c) avenues of CSO panicipation
as
provided for in RA 7150; and d) ficrmation ofa local CSO Net*ork.

4.2.2.3 The DILG Central Office, through the Bureau of l.ocal


Governmcnr
(BLGS) and the Suppon for Local Covernance program

(SLGP-PMO) shall provide the Training Modules "used
that shall be
in the conduct ofthe CSO Conference.

4.2.2.4 The Sanggunian shall see to ir that Application forms are

available in the Oflice ofthe liecrerary ro rhe Sanggunian and

the CSO Conference.

4.2.3 An invitation shall also be sent to all organizations participatrng in rlifferent


government programs, and those representing various local
boards or councils
pursuant to applicable laws and rules and regulations,
encouraging these
organizatiors to participate in the accreditation and selection processes.

4.2.4 Withil the 2, week of August, but not later than the last working day of the
3d week, every organization seeking for a new accreditadon,
or renewal, shall
submit one (l) copy ofeach ofthe fiollowing requirements to the Sanggunian:

4.2.4.1 Letter ofApplication (Annex .A");


4.2.4.2 Duly accomplished Applicarion Form for Accreditation (Annex .,B");
4.2.4.3 Duly approved Board Resolution signiffing inteation for
accreditation for the purpose of representation in the local special
body;
4.2.4.4 Cenificate of Registration or Cenificate of Accreditation (or in the
case of IPOs, cenification issued by NCIP);
4.2.4.5 Iist ofcurrent Olficers and Members;
4.2.4.6 Original Sworn Statement, isued by the chief executive oflir:er or
equivalent officer ofthe CSO, staring that the CSO is an independent,
non-panisan organization and that it will rebin its autonomy while
pursuing the advancement of the peoples, interest through irs
membership in a local special body, after satisfying ail the
requirements and set criteria, as stated in this Memorandum Circular,
and after securing a Cenificate of Accrediution from the concerned
Sanggunian;
4.2.4.7 For exi*ing CSOs, Minutes of tlre Annual Meetings of the
immediately preceding year as certified by the organizations, board
secretary;
1.2.4.8 For existing CSOs, Annual Accomplishment Repon for the
immediately preceding year;
4.2.4.9 For existing CSOs, Financial Statement, at the minimum, signed by
the executive officers of the organizatioD, also of the lmmediately
preceding year, and indicating therein other information such
as the
source(s) offundsi and

4.2.4.10 For CSOs applying to be members of the Local School or Health
Boards, photocopy of prohles of at Ieast three (3) individuals in
the
organization that will verifo their involvement in education or heahh
services, as prescribed in Sections 9g and 102 ofRA 7160_

43 Accredietion Pmper

4.3.1 The Sanggunian shall evaluate all applications for accreditation, upon tecerpr
thereof, staning on the 3d week but nor later rhan the last working day Lf
August, on the basis ofthe following criteria:

4.3.1.1 RegistradoD wth the Secuities and Exchange Commission,


Cooperative Development Authoriry, Depanment of t.abor and
Employment, Depanment of Agriculture, Depanmeot of Agrarian
Reform, National Housing Autlority, Housing and Land Use
Regulatory Board or any national government agency that is
empowered by law or policy to accredit or register such organizadon;

4.3.1.2 Organization purposes and objectives which include corrnunity


organization and development, institution-building, local enterprise
development, livelihood dwelopment, capaciry-building, anci s.milar
development objectives and considerarions;

4.3.1.3 Community-based and sectoral-based with project development and


implementation track record ofat least one (l) year;

4.3.t.4 Reliabiliq- as evidenced by the preparation of annual repons and


conduct of annual meetings duly certified by the board secretary of
organization; and

4.3.1.s I'or CSOs appllng to be members of the Local School or Health


Boards, must be compced ofindividuals that have competencies that
are related to the functions relevant to tlre local special body thar the
organization intends to be a member of.

4.3.2 No Cenilicate of Accrediration shall be issued to any organization that f;iled to


submit any of the enumerated requirements and failed to satisl,, any of the set
criteria.

,1.3.3 The Sanggunian shall issue before, but not later than, the las working day of
August, the following:

4.3.3.r C,enificate of Accreditation to every qualified CSO (Annex ,,C");

4.3.3.2 Notice to every organizarion, which applied and satisfied the set
criteria but failed to submit all the requirements, encouraging them
to complete the lacking requirements not later *Ian the last working
day of the I " week of September; and

4.3.3.3 Notice of Non-Qualification to CSOs that were not able ro
satisfu rhe
requirements and set criteria, inllcrming them ofthe reason/s
for said
non-qualification.

4.4 Selection ofRegrercntatives to the local Special Bodies

Unless otherwise provided by existing laws and policies, selection

representadves to the local Special Bodies shall be guided by the
follolving: .

4.4.1 Within the l" week of September, after the accreditation process, the DILG
Provincial Drector, City Director, City l_ocal Governmeff Operations Omcer
and Municipal Local Government Operations Omcer, as the case may
be, shall
issue a notice to all accredited CSOs for a meedDg on the selection
of
representatives ro the local special bodies. Said notice shall be posted
in at least
three (3) conspicuous places within rhe province, city or municipality. The
same shall also be po$ed in rhe LGU v.eb,site, social and/or print
media, if
applicable.

4.4.2 Within the 2 week of September, above-said meetint with the execuriye
omcers, or with the duly authorized representarives ofall;ccredited GiOs
shall
be held where such groups shall choose from among themselves the
representative-organizations to the local special bodies.

4.4.3 During the above-said meeting, rhe DILG provincial Director, City Director,
City l,ocal Coyernment Operations Officer or Municipal locsl Government
Operations Officer shall conduct an orientation, to be presided by the
Provincial Governor, Gty Mayor or Municipal Mayor, on the functions of the
local special bodies and responsibilities ofthe CSO that will be selected.

4.4.4 The erecutive officers, or the duly authorized representatives, of the selected
CSOs shall designate their principal and alterDate representatives to the local
special bodies where they are ro sit as members.

4.4.5 In no case shall an orgaaizadon or a representadve th€reofbe a member ofmore


than one (1) local special body within a proyince, city, or Bunicipaliry.

4.4.6 The term ofollice ofa selected representative shall be coterminous with that of
the local chief executive concerned. Should a vacancy arise, the selected C,SO
shall designate a replacement for the unexpired term.

4.4.7 The DILG Provincial Director, Ciry Director, Ciry Local Government
Operations Officer or Municipal local Government Operations Officer shall
caus€ the documentation of the proceedings, and submit an olficial repon to
the Provincial Covemor, City Mayor or Municipality Mayor, as the case maybe,
copy fumished the Prcsiding Officers of the Sanggunian, within rwo (2)
working days after the meeting. Said repon shall also be posted in at least threc
(3) conspicuous places within the province, city or mulicipality, and may also
be posted in the LCU webnite, social and./or prinr media.

4..1.8 ln-the selection of CSO replesentatives to the Local Development
Council, the
following shall be taken into consideration:

4.4.8.1 Membenhip in the tocal Development Council must have


representetives from the women sector, or as may be practicable,
at
least forty percent (.109o) of the fully-organized council shall be
composed ofwomen as prescribed by RA 9710 or the Magna C,ana
ot
Women of 2009;
4.4.8.2 Similarly, other existing laws enacted and passed subsequenr ro the
passage of RA 7160 that funher define the composition
of the local
Development C-ouncils and other special bodies, such as, but not
limited to, RA 837I or rhe lndigenous peoples Righa Act o f lg)7, and
RA 8435 or the Agriculture and Fisheries Modernization Act.

4.4.9 The following criteria shall apply to these local special bodies

4.4.9.2 local Schml Board - representative,organizations shall be limited to
patents-teachers associations, and teachers' organizations and
organization of non-academic personnel of public schools ta the
locality, and other organizations involved in education services: and
4.{.9.3 Local Peace and Order C.ouncil - the three (3) organizations shail be
chosen in adherence to Anicle 63(e) of the Implementing Rules and
Regulations of RA 7160 and Section I of Executive Order No. J09 s.
1987, and shall come from Civil Society Organizations that falls under
rhe definition that is provided in this Memorandum Circular.

4.5 Replacemnt of Reprelenrdiye - Gvil society Orguizdiotr

4.5.1 The Sanggunian shall replace rhe representative-CSO that has incurrcd threc
cumulative abnences to the meetings ofthe local special body where it sits as a
member. 'l'he replacement organization shall be chosen from among the CSOs
in the local government unit that were accredited for the purpose stated in this
Memorandurn Circular, provided funher, that the Sanggunian shall adhere to
the selection criteria as provided in Sections 4.4.g and 4.4.9 of this
Memorandum Circular in selecting the replacement organization.

4,6 Recoustitution and Convming oflocal Special Bodies

4.6.1 Within the 3d week of Srptember, or immediately following the selection


process, the ProviDcial Govemor, City Mayor or Municipality
Mayor shall call
for a ioint organizational meeting with the tocal Development Council,
local
Health Board, Local School Board, and L,ocal peace and Order
Councrl.

4.6.2 The purposes of said joint organizational meeting shsll include the
drscussion
ofthe functions ofthe local special bodies, initial exploration ofpannerships
in
local governance and development, and in the case ofthe LDC,ihe
creation of
an executive committee, sectoral and functional committees,
technical working
group, and consideration of *re selection of a CSO representative
as vrce-

4.8 &remption

4.8.1 Although the Implementing Rules and Regulations of RA 7160 inclu<ie the
People's Law Enforcement Boards as one among the local special
bodies, the
provisions of the Code as to the manner ofselecting representatives to
the local
special bodies do nor find application to the pL[Bs. As such, this Memorandum
Circular does not apply to the pLEBs.

4.8.2 Likewise, this Memorandum Circular does not apply to the pre_qualificarion,
Bids and Awards Committees (pBAC), now called Bids and Awards Commrttees
(BAC) estabtished, considering that unlike the old pBAC, the composition
of
the BAC is now limited to local governmem personnel occupyin plantilla
positions in local government units. However, while the BAC is still required
ro invire two (2) obaervers from NGOs or private organizations, the selection of
these NGOs or private organizations are not covered by this Memorandum
Circular.

4.9 Rolee and Reaponribilities

Iror pur;nses of this Memorandum Circular, the following shall have their respective
roles and responsibilities, to wit:

4.9.1 Provincial Governors, City and Municipal Mayors:

4.9.1.t Execute the intent of this Memorandum Circular, conducr a CSO


Conference and cause the $an of the accreditation process of CSOS,
and selecdon of representatives to the local special bodieq and
4.9.1.2 Coordinate with their concemed DILG local Government Offrcer lbr
technical assistance and staffsuppon, ifany, in relatioD to the conduo
ofthe CSO C,onference, and the accreditation and selection processcs.

4.9.2 DILC Central Oftice

4.9.2.1 Develop and proyide rhe TraiDing Modules that shall be used in the
conduct ofthe CSO Conference;
4.9.2.2 Provide technical assistance to DII.G Regional and Field Officcs, if
necessary, or upon their request; and

6.0 REPEAIJNG CLATJSE

All DILG Memorandum Circulars, or pans rhereof, which are inconsistent with this
Memorandum circular are hereby repealed or modified accordingly. Any reference to rhe
guidelines and procedure on the accreditation of CSOs by the Sanggunian and in the
selection of their representatives to the IsB6 shall be made in reference to this
Memorandum Circular.

l0.l To help ensure thar the penineDt provisions of RA 7160 and this Memorandum
Circular are strictly end faithfully observed, Monitoring and Reponing Crrmmittecs
shall be organized as follows:

10.1 . I The National Monitoring and Reponing Cornmittee (NMRC) shall bc headcti
by the Undersecretary for Local Government, and the Bureau of Local
Governmenr Supervision (BLGS) Director, representative from the Union of
Local Authorities of the Philippines and CSO networks as members. The
NMRC shall perform overall coordinarion function, generate narioDal repons
and recommend measures to the Secretary oflnterior and l_ocal Government
to further enhance the participation ot CSOs in the workings of the local
special bodies and in local goyernance, in general. The BLGS shall provide
technical and secretariat support to the committee.

10.1.2 The Regional Monitoring and Reporting Comminee (RMRC) shall be headed
by the DILG Regional Director or the DILG Minister of rhe Regional
Government (BARMM), and the regional represenbtives of the League of
Provinces, League of Cities, t€ague of Municipalities and regional CSO
network as members. The RMRC shall see to it that the intent of this
Memorandum Circular is complied with among provinces, highly urbanized
and independent component cities in the regron, generate regional repons and
recommend measures, through the NMRC, to the Secrerary of Interior and
Local Government to funher suengthen rhe panicipation ofcivil and private
sociery organizations in the workings of the Iocal sp€ial bodies and in local
governance, in general, within the region.

r0.t.3 The Provincial, Gty or Municipal Moniroring and Reponing Commirtee


(P/C,&{MRC) shall de headed by rhe DILG Provincial Direcror, City I)irector

10.2 Reponing of accreditation-related activities conducted in all LGUs shall be repned


to the BLGS. A prescribed reponing form with instructions is available in a Google
Drive platform and can be accessed through the following link:

monitoring report forms are to be done online.
