LABS AND TWO STAFF ROOMS

1. Sealed bids will be received under National competitive Bidding procedure by the Ministry of
education on behalf of Royal College, Colombo to carry out the undermentioned construction work.
Relevant bidding documents will be issued up to 1.30 p.m. on 16.05.2019. Bid documents will be
issued at the Ministry of education. To qualify for granting the contract, bidder should not have been
blacklisted and should be registered in CIDA, within the western province.

3. Bid Securities, as stated, should be submitted with the bids and they should be valid up to 10.07.2019
for the work stated above.
4. Sealed bids in two copies, could either be sent by registered post or personally delivered to Ministry
of education, to be received at or before 2.00 p.m. on 22.05.2019. Bids received will be opened
immediately after closing of acceptance of bids and bidders or their authorized representatives can be
present at the opening.

Non submission of the documents will lead to rejection of the bid. If any information provided found to be
misleading or false, the bid will be rejected.

4.4 The qualifications criteria are as follows;

a) Bidders must be registered with Institute for Construction Training and Development
(ICTAD) for building construction C3 classification or above.
b) The average annual volume of construction work performed in last five years shall be at
least Sri Lankan Rs.100 million
c) At least 10 years of work experience required.

9.0 In addition of A3 Size hard copies of all drawings, Soft copies of all drawings in “pdf”
format will be issued with bidding document to take printout to a full scale if necessary.

13.3 Vat Component should not be added in the rates.
If bidder is registered for VAT, the bidder should include the value of the VAT separately at the
end of the BOQ. Any bidder who does not have a valid VAT registration NO will be rejected.

13.4 Adjustments for change in cost

The Contract is subjected to price adjustment.

15.1 Period of Bid validity:

The Bid shall be valid up to 100 days from the date set for closing of bid.

16.1 Amount of Bid security

The amount to Bid Security is Sri Lanka Rupees One Million only (Rs.1, 000,000.00)

16.2 Validity of Bid Security

The Bid Security shall be valid up to 140 days from the closing date of Bid.
Securities and Guarantees issued by the following institutions are acceptable:
1. A Bank operating in Sri Lanka, approved by the Central Bank of Sri Lanka.
2. A Bank based in another country, but the security or guarantee “confirmed” by a Bank operating
in Sri Lanka.
3. A reputed Insurance Company operating in Sri Lanka accepted by the Treasury for acceptance of
Guarantees.

31.1 After evaluation of Bids in accordance with the procedures described under Clauses 28, 29, 30 and
31, the Employer will inform to all the bidders in writing the selection of the successful bidder and
the in tension of contract award to such bidder. The unsuccessful bidders if they so wish, within one
week of such notice may make representation to the Procurement Appeal Board at the address given
below. Such representation shall be self-contained to enable the Appeal Board to arrive at a
conclusion and a cash deposit to amount given below shall be made. The Appeal Board may request
the bidder who had made representation to submit further evidence during the investigations. The
cash deposit will be forfeited unless the Employer has changed the original contract award decision
in favor of the bidder who has made such representation.

34.0 Amount of performance Security

The Standard Form of performance Security acceptable to the Employer shall be a Bank Guarantee or
a performance Bond from a reputed Insurance company operating in Sri Lanka and accepted by the
Treasury for acceptance of Guarantees or from any other organization approved by the Treasury for
this purpose.

The amount of performance Security is 5 % of the Initial Contract Prices.

The Performance Security shall be valid until 28 days beyond the expected date for completion.

iii. Project Manager - B.Sc. qualified Civil engineers with 6 year

13.1 The minimum insurance covers shall be:
a. The minimum cover for insurance of works and of plant and material is 100% of
the initial contract price
The maximum deductible for insurance of the works and of the plant and the
material is 10% of the initial contract price
b. The minimum cover for the loss or damage to equipment will depend on the type
of equipment to cover the replacement cost.
Maximum deductible for the insurance of equipment shall be 5% of the minimum
cover for equipment.

 c. Minimum cover for personal injury or death
a. For the employer shall be 10% of the initial contract price
b. For the contractor shall be 110% of the initial contract price

17.1 Time for Completion of the works

The time for completion for the whole of works shall be 24 calendar months.

21.1 Right to access to the Site 15 Days after the acceptance

39.2 Engineers Duties and Authority

The engineer may order variations up to a total cumulative value of not

exceeding 1% of the initial contract price

49.1 Liquidated damages for the Works

LKR 50,000/= per day

50.1 Maximum amount of liquidated damages

10% of the initial cost

52.1 Performance Security shall be 10 percent of the initial contact price.

60.1 The percentage to apply to the value of the work not completed representing the employer’s
additional cost for completing the works shall be 20% of the initial contract price.

We have been informed that “The Bidder.” has entered in to the contract no CMB/AN 20190018 dated
22.05.2019 with you for the construction and remedying the defects of building containing 25 classrooms, 3
modern labs and 2 staff rooms – Colombo where the work consists of construction, completion and remedy
of defects of the proposed building containing 25 classrooms, 3 labs and staff room– Colombo.

Furthermore, we understand that, according to the conditions of the contract, a performance guarantee is
required At the request of the contractor, we, “Bank of Ceylon.” hereby irrevocably undertake to pay you any
sum or sums not exceeding in total an amount of LKR 41,372,275.00 (forty one million three hundred and
seventy two thousand two hundred and seventy five only ), upon receipt by us of your first demand in writing
accompanied by a written statement stating that the contractor is in breach of its obligation(s) under the
contract, without your needing to prove or show grounds for your demand or the sum specified therein.

This guarantee shall expire no later than the 22nd day of October 2020 and any demand for payment under it
must be received by us at this office on or before this date.

We have been informed that “The Bidder.” has entered in to the contract no CMB/AN 20190018 dated
22.05.2019 with you for the construction and remedying the defects of building containing 25 classrooms, 3
modern labs and 2 staff rooms – Colombo where the work consists of construction, completion and remedy
of defects of the proposed building containing 25 classrooms, 3 modern labs and 2 staff rooms – Colombo.

Furthermore, we understand that, according to the conditions of contract, and advance payment in the sum of
LKR 124,116,826.00 (one hundred and twenty four million one hundred and sixteen thousand eight hundred
twenty six only) is to be made against an advance payment guarantee.

At the request of the contractor, we, “Bank of Ceylon.” hereby irrevocably undertake to pay you any sum or
sums not exceeding in total an amount of 7 LKR 124,116,826.00 (one hundred and twenty four million one
hundred and sixteen thousand eight hundred twenty six only) upon receipt by us of your first demand in
writing accompanied by a written statement stating that the contractor is in breach of its obligation in
repayment of advance payment under the contract.

The maximum amount of this guarantee shall be progressively reduced by the amount of the advance
payment repaid by the contractor.

The guarantee shall expire on 22nd day of October 2020.

Consequently, any demand for payment under this guarantee must be received by us at this office on or
before that date.

6. Agreement

AGREEMENT

This AGREEMENT, made 22nd day of October 2019, between the Ministry of Education, 18, Ward Place,
Colombo 7, Sri Lanka. (hereinafter called “the employer”) of the one part, and The Bidder (hereinafter
called “the contractor”) of the other part.

WHEREAS the employer desires that the Contractor execute Construction of a building containing 25
classrooms, 3 modern labs and 2 staff rooms(CMB/AN 20190018) (hereinafter called “the works”) and the
employer has accepted the bid by the contractor for the execution and completion of such works and
remedying of any defects therein

NOW THIS AGREEMENT WITNESSETH as follows:

1. In this Agreement, words and expressions shall have the same meaning as are respectively assigned
to them in the conditions of contract hereinafter referred to, and they shall be deemed to form and be
read and construed as part of this Agreement.

2. In consideration of the payments to be made by the employer to the contractor as hereinafter

mentioned, the contractor hereby covenants with the employer to execute and complete the works
and remedy any defects therein in conformity in all respects with the provisions of the Contract.

3. The Employer hereby covenants to pay the contractor in consideration of the execution and
completion of the works and the remedying of the defects wherein the Contract price or such other
sum as may become payable under the provisions of the contract at times in the manner prescribed
by the contract.

IN WITNESS whereof the parties there to have caused this Agreement to be executed to be executed the day
and year aforementioned in accordance with laws of Sri Lanka.
