AN ORDINANCE REQUIRING ALL RESIDENTIAL AND COMMERCIAL ESTABLISHMENTS WITHIN THE

BARANGAY KINAN OAN TO CLEAN THE SIDEWALKS FRONTING THEIR HOMES AND/OR ESTABLISHMENTS
OTHERWISE KNOWN AS “TAPAT KO, LINIS KO ORDINANCE” OF BARANAGY KINAN OAN.

WHEREAS, the efforts of the Baranagay alone is not sufficient enough in providing and
maintaining clean streets and sidewalks in the Baranagay without the help of the residents and dwellers;

WHEREAS, the dwellers and residents cooperation is needed to discourage and stop the dumping of
garbage outside their residences and establishments premises.

WHEREAS, in compliance with the Local Government Code Section 447 a; 4ii) Require that buildings and
the premises thereof and any land within the Baranagay be kept and maintained in a sanitary condition;
impose penalties for any violation thereof, or upon failure to comply with said requirement, have the
work done and require the owner, administrator or tenant concerned to pay the expenses of the same;
or require the filling up of any land or premises to a grade necessary for proper sanitation;

NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED BY THE SANGGUNIANG BARANGAY OF


KINAN OAN TRINIDAD BOHOL THAT:

Section 1. It shall be the responsibility of the owner and/or dweller, lessee, occupant of a residential or
commercial establishment to maintain the cleanliness of the sidewalk and streets fronting their
residence or establishment.

Section 2. It shall be the duty of the above-mentioned persons to dispose of their garbage and litters in a
sanitary manner and kept inside the residence premises or establishment premises until the garbae
collector collects them.

Section 3. All persons violating this Ordinance shall be penalized as follows:

First Offense – Warning

Second and Subsequent Offense – Fine of Php 500.00

Section 4. The Baranagay Council of Kinan oan shall strictly implement this Ordinance and provide for
other Implementing Rules and Regulation it deems necessary for the full implementation of this
Ordinance.

Section 5. This Ordinance shall take effect sixty (60) days after posting at conspicuous places and
disseminating of information in various barangays, subdivisions and communities within the
municipality.

Let copies of this Resolution be furnished all concerned offices for their information, guidance and
implementation

AN ORDINACE PROVIDING THE RULES AND REGULATION ON THE USE OF THE BARANGAAY COVERED
COURT AND PROVIDING PENALTIES THEREOF.

WHEREAS, under Section 391 of the Republic Act 7160, otherwise known as the Local Government Code
of 1991, where the Sangguniang Barangay is powers and duties to enact revenue ordinances and
regulate the use of facilities constructed with government funds and charge reasonable fees for the use
thereof;

WHEREAS, Barangay Sabang South has successfully upgraded its ordinary basketball court into a covered
court which has high electricity consumption;

WHEREAS, the Barangay budget for power services is insufficient if it will be appropriated for the
covered court;

WHEREAS, the covered court serve as a training ground especially for the youths in enhancing their
talents in the field of sports and artistic gifts and a venue where residents and non-residents meet
together for social, cultural, educational and religious activities;

WHEREAS, the covered court needs maintenance for its continuous public operation and use;
NOW, THEREFORE be it ordained by the Barangay Council of Barangay Sabang south that;

Section1.TITLE. This ordinace shall be known as “Barangay Sabang South Covered Court

Regulation Ordinance”.

Section 2.PURPOSE. It is the purpose of this Ordinace to generate fund necessary for the maintenance of
Barangay Sabang South Covered court for continuous use in enhancing sports activities, development of
youth and promoting social welfare.

Section 3.PURPOSE. For purposes of this ordinance, the following words, terms, phrases shall have the
meanings given herein:

1. “Permit means the written authorization issued by the Person-in-charge to a person to engage in
particularly activity on the covered court. Said the authorization is subject to the terms and conditions
specified in the permit as well as all applicable laws, city ordinance and iisuances.

2. “Officer-in-charge” refers to the officer of the day, designated by the Punong Barangay.

3. “Littering” refers to the throwing, scattering of garbage / trash within and around the permises of the
Barangay Sabang South coverd court.

4. “Vandalism” this refers to the destruction or spoiling of structures including the markings of the
benche , stage and playing area.

5. “Time Frame” refers to the day time 8:00 a.m to 5:00 p.m and night time 5:30 p.m to 2:00 a.m for
social gatherings and 8:00 a.m to 10:00 p.m for ball games.

Section 4.VAILABILITY. The use of Barangay Sabang South covered and its facilities shall be charged with
reasonable fees and shall be regularly open any day of the week. An early opening or late closing maybe
reasonably allowed if the activity so requires, upon approval by the Officer-in-Charge.

Section 5.SECURING PERMITS. Permits may be granted to a person by the Officer-in-charge upon proper
applications and approval thereof, in order to engage in a particular activity in the Sabang south Covered
Court. The permittee shall file its written application to the Officer-in-charge who shall verify the
application thereafter the Barangay Treasurer shall require payment of applicable fees. Once paid,
Officer-in-charge shall record the said event in the reservation book. Baranagay Sabang South reserves
the right to make necessary changes places necessary otherwise included in the permit.

Section 6.EXEMPTIONS. Permits are not necessary regular games. Requirement of permits only applies
to package deals, leagues and special events. Regular games reservation can be acquire by direct
payment to the authorized persons.

Section 7.REFUSAL OF APPLIACTION, RECVOCATION OF PERMITS OR TRANSFER OF ACTIVITY. Barangay


Sabang South thru the Officer-in-charge may refuse an application for

Permit, revoke the same or transfer or reset approved activity under a Permit previously granted when
there is fraud, misrepresentation or mistake in the application or permits; When the proposed activity is
injurious to public morals; To pave way to urgent repairs and maintenance of Barangay Sabang South
covered court and its facilities.

Section 8.RENTAL RATES. The following shall be the rates imposed for the use of Barangay Sabang South
covered court:

Daytime

League/Special Events P150.00 per hour, with electricity use (Non-residents)

League/Special Events P100.00 per hour, with electricity use (Residents)

Regular Games P10.00 per game, no electricity use (Non-residents)

Regular Games P5.00 per game, no electricity use (Residents)

Night Time

Regular Games P150.00 per hour, with electricity use (Non-residents)

Regular Games P100.00 per hour, with electricity use (Residents)

Special Events Package

Daytime P750.00 (Non-residents) P500.00


(Residents)

Night time P1,500.00 (Non-residents) P1,000.00

Section 9.SCHEDULING.Reservations on schedule of games and activities shall be on first come, first
served basis. Schedule shall be coordinated with the Officer-in-charge during office hours. Application
for Permits must be made at least three (3) days before the schedule of the activity. 20% of the total
payment shall be required upon reservation.

SECTION10.LIMITATION. The use of Barangay Sabang South Covered Court shall be limited exclusively
for the purpose it was requested. If at any time before or during the event, the permittee uses the
requested area for any purpose other than what has been requested or cancels the said event after
reservation, the Barangay through its Office in charge shall forfeit the deposit or advance payment made
by the permittee.

SECTION11.RESTRICTIONS AND PROHIBITED ACT. The following shall be the restrictions and
prohibitions:

a) Littering and Vandalism

b) Use of fireworks, firecrackers and other similar alike explosives.

c) Only those wearing proper sports apparel like shoes, jersey and t-shirt shall allowed to use the
court.

d) A player must not be under the influence of liquor.

e) No streamer, leaflets and other promotional paraphernalia are allowed to be display or


distribute without the prior approval by the Officer-in-charge.

f) No smoking and spitting inside the premises.

g) No urinating inside and outside the premises.

SECTION12.PENALTIES. The penalties shall be imposed on violators of this Ordinance;

a) First Offense Warning for disciplinary action.

b) Second Offense One month suspension in using the covered court


and fine of 100.000

c) Third Offence and Subsequent Offenses 1 year banned with a fine of 300.00

SECTION13.PERSON LIABLE. In case of untoward incidents during the said use resulting to damage of any
of the facilities and other properties of the Barangay Sabang South Covered Court, the permitee shall be
charge and accordingly pay for such damage. The Barangay Sabang South Covered Court shall be free
from any third party claim, in case of any untoward incidents resulting to injury to the person or damage
to the property of performers, participants and spectators, which claim or liability if any shall be the sole
responsibility of the permitee.

SECTION14.REPEALING CLAUSE. All Barangay ordinances to or inconsistent with this Ordinance are
hereby repealed or modified accordingly.

SECTION15.SEPARABILITY CLAUSE. If any part or provision of this Ordinance is declared unconstitutional


or invalid, the same shall not affect the validity and affectivity of the other parts or provision hereof.

SECTION16.EFFECTIVITY CLAUSE. The Ordinance shall take effect upon approval.
