The Defense Counsel (PAO lawyer - Atty. Carolyn Tanudtanud) in behalf


of the accused asked for settlement between the accused and the
complainant because the carnapped vehicle was already recovered.
However, the Prosecution argued that settlement can be achieved only
after the accused has disclosed before the court the identity of the other
persons who participated in the commission of the offense. The accused
refused to divulge the identity of the others were involved. Hence, no
settlement was made.

During the cross examination of the prosecution’s witness (P02 Clifford


Bayangdan), the defense counsel Atty. Ruben B. Garcia asked the witness
how did the police know that the accused was allegedly invovled in drug
trade. The witness responded that the police received an information.
The defense counsel inquired if there were other informants against the
accused for the crime charged. The witness responded that there were
no other information aside from that of the informant. The defense
counsel argued that the witness being a police undercover and engaged
in buybust operations for more than 2 years should have made
validations by asking or searching for more informations for the charges
against the accused and that they cannot rely on mere allegations made
by the informant. The witness claimed that even if there were no other
informants, they depended on the information because the source was
credible and reliable.

Witness claimed that the accused was her friend. She claimed that she
was at the disco with the accused. When a gunshot was heard from the
disco area, she ran away together with her friends. The victim was
already lying on the floor when she looked back. The accused and the
witness and their other friends who were at the disco ran to the nearest
store for safety. The accused, the witness and their friends were together
all night. Hence, it is highly improbable that the accused hot the victim.

Legal Argument:

The accused, through his defense counsel claimed that the accused was
a minor. The judge asked if the alleged crime was committed when the
accused was still 17 years old. The crime was committed on January 6,
2018. Initially the accused claimed that he was born in Febraury 2000.
However, upon clarification by the defense to is client, the accused was
born on June 25, 2000. It is apparent that the accused cannot ascertain
his correct date of birth because he only relied to what his mother has
told. The judge moved for the postment of the hearing of the case and
ordered the defense to secure birth certificate to prove minority.
