ABOUT LABOUR DEPARTMENT


The Labour Commissioner Organization, established in 1936, administers and enforces 33 labour laws (24
are Central legislations and 09 State legislations) to ensure, mainly, provisions relating to social justice and
economic inter-dependency, improvement in working conditions, social security, and protection against
harassment and exploitation of working children, women and men employed in organized sector. Labour
department ensures quick disposal of industrial disputes through its conciliation machinery with a view to
establish harmonious industrial relations amongst the employers and employees, so that along with growth
in industrial production, the interests of workmen are also protected. The department periodically fixes the
minimum wages and ensures their due and timely payment to the workmen. The labour laws are consistent
with fundamental rights of citizen, the directive principles of Indian Constitution, and at international level,
with standards laid down by International Labour Organization through various conventions and
recommendations.

Along with executive functions through its administrative set up, following wings are also
established in the Organisation to enforce various labour laws and timely intervention in industrial
disputes:

• Enforcement and Conciliation


• Directorate of Factories and
• Directorate of Boilers.

VISION OF THE DEPARTMENT:

• To ensure harmonious industrial relations, safe work environment and implementation


of labour laws to guarantee dues and rights under labour legislations.
• On line registration, licensing and submission of returns under labour laws to promote
investment.
• Labour laws reforms and simplification.

KEY OBJECTIVES / GOALS OF THE DEPARTMENT:

• To establish harmonious relations.


• To ensure minimum wage, guaranteed monetary benefits, due under law, to the workmen.
• To provide safe, healthy, and productive work environment and welfare to the workers.
• To ensure social security and service conditions of the workmen.
• To ensure abolition of child labour and bonded labour, and rehabilitation of those.
• To encourage and promote zero accident, safe and productive work places.

MEMBER REGISTRATION
The portal can be used for registration, renewal, submission of annual return, viewing of inspection
report for following Labour Acts

• The Factories Act, 1948


• Motor Transport Works Act – 1961
• Uttar Pradesh Dookan Aur Vanijya Adhishthan Adhiniyam, 1962
• Beedi and Cigar Workers (Conditions of Employment) Act,1966
• Contract Labour Act (Regulation And Abolition),1970
• Inter-State Migrant Workmen Act (Regulation of Employment & Conditions of
Service),1979
• Indian Boilers Act, 1923

To use any of the activities (registration, renewal, submission of annual return, viewing of
inspection report), the user must be a member of the portal. For this, following steps must
be performed

A - Click on Register Now button

B – Now the user will fill up the details with username and password and click on Submit
button.
The username and password will be sent to the user on email id (specified while entering
the user details), and on mobile no (specified while entering the user details)

NOTE : The member registration of the user is subject to the approval of the department. A
new password will be sent to your email id/mobile by the department after approval of
your membership.

In the Building Plan Approval Section i.e. Step-1, fill up all the details asked i.e. Factory
Name, Factory Type, Address and Upload all the required attachments that are asked.

Now , Go to the Step-2 : Registration Under Factories Act. Fill up all the details carefully
which includes Occupier’s details, Workers’ details , Power details etc.

ATTACHMENTS
We have gone through the procedure of filling up the application form for registration under all
the acts. The user will also need to upload all the important documents or attachments under the
acts along with the application form. The user will select the acts the same way from Select Acts.
There are different attachments required for different acts

Click on Attachment and the attachment portal will open where the user will have to fill up the
application no generated earlier.

A – After filling up the application no , click on Go

After clicking on Go , the details will be shown. The user can upload the attachments through
Choose File as shown in the next screenshot on the next page

A – After uploading all the required attachments, click on Submit button

NOTE – Maximum upload size for all attachments should not be more than 3 MB.

PAYMENT
For payment of the registration or licensing fee the user will have to click on Payment. A payment
portal will open where user will enter his/her application no. The payment can be done by two
modes, either by challan or online.

A – After entering the application no , click on Go

A – After selecting the Online payment mode, click on Proceed to Payment

NOTE – In the Online payment, after clicking on Proceed to Payment the user will be directed to
http://rajkosh.up.nic.in/. The user will have to perform the e-Payment and a e-challan slip number is
generated which the user will need for the future activities i.e. the user will have to enter that
number in the challan no column of the payment details in the next step.

A – After selecting the Challan payment mode, click on Generate Challan which will open
challan form on the next tab

LICENSING
Licensing is applicable only for two acts i.e.

• Contract Labour Act (Regulation and Abolition), 1970


• Inter-State Migrant Workmen Act(Regulation of Employment & Conditions of
Service),1979

For licensing , click on Licensing. A license application will be shown where the user will have
to fill up the particulars of establishment , name of establishment, name of principal employer
and other important details carefully.

A – For calculating the licensing fee , click on Calculate Fee


B – After filling up all the important details , click on Submit

VIEW SAVED APPLICATIONS


A – The user can view all his/her saved applications by clicking on View Saved Application

Your application will remain pending, until it is approved by the department. On approval of
Application, Application status will be shown as approved and Registration no/License no will
will be allotted.

A – By clicking here the user can edit all the details of the selected application.

RENEWAL
Once the Application is approved by the department, a new registration no is allotted.
The user will go to the View Saved Application and check whether his/her application is approved
or rejected by the department. If the status is approved then a new registration no is allotted to
the concerned application by the department. The user needs to remember or copy the new
registration no for further activities like renewal, annual return or print certificate/license.

A – Click on Renewal to go to the Renewal portal


B – After this the user needs to fill up the new registration/license no and click on GO

Now Registration/License Details will be shown. The user will fill up the Renewal Application Date
and other important details.

A – To change the application details, click on Change Registration Detail


B – To calculate the renewal fee, click on Calculate Fee
C – If the payment mode is Online, click Proceed to Payment
NOTE – In the Online payment, after clicking on Proceed to Payment the user will be directed to
http://rajkosh.up.nic.in/. The user will have to perform the e-Payment and a e-challan slip number is
generated which the user will need for the future activities i.e. the user will have to enter that

DEPARTMENT PANEL
When the user has filed for the registration/licensing/renewal/annual return then the application
is sent for the approval from the department. The officer from the department logins into the
department panel and goes through all the applications and decides whether to approve or reject
the application.

Inter-State Migrant Workmen Act (Regulation of Employment & Conditions of Service), 1979
then the three options will be shown i.e.
• Pending Registration Application
• Pending License Application
• Pending License Approval

This happens only in the case of Contract Labour Act (Regulation And Abolition), 1970 and Inter-
State Migrant Workmen Act (Regulation of Employment & Conditions of Service), 1979.

A – To look for pending registration applications, click on Pending Registration Applications

C - To look for pending license renewals, click on Pending License Renewal

There is also a case if the officer selects Factories Act, 1948 then the three options will be shown
i.e.
• Pending Building Plan
• Pending Registration Application
• Pending Registration Renewal

This happens only in the case of Factories Act, 1948.

A – To look for pending building plans, click on Pending Building Plan


B – To look for pending registration application, click on Pending Registration Application
C - To look for pending registration renewals, click on Pending Registration Renewal

NOTE – Just like the Pending Registration Application is approved, similarly all the other pending
applications can be approved/reject/cancelled for all the Acts

INSPECTION

A – Click on Inspection and the inspection portal will be shown

The officer will select the required Act and fill up the new registration no generated after the
approval

The officer will fill up all the details found during the inspection of the firm or establishment of the
user. The officer will fill up the type of inspection, date, his/her name and designation and other
important details. The report on the inspection will be maintained by filling up all the checklist
mentioned.

A – If there were any breaches found during the inspection then the details of such could be
mentioned by clicking here
B – After filling up all the details, click on Submit

ANNUAL RETURN

The officer can also view the Annual Returns submitted by the users from Annual Returns Panel

A – The officer from the department can select the respective Acts from here

The applications could be searched on the basis of Registration no and Date.

MEMBER APPROVAL

The officer can view all the applications through Member Approval panel. The applications can
also be searched on the basis of date.

A – The officer can search all the applications or only approved, rejected or cancelled applications

REPORTS

To view all the Registration/License reports and lists under all the Acts, click on Reports and the
report panel would open

In the reports panel, the list of registration/license under all the Acts would be shown.

A – The officer will have to click here to view the report of the particular act

The officer will have to select the district and also can search the reports on the basis of different
criteria that is incorporated to that particular act

A – For Contract Labour Act – 1970, the officer will have to choose whether he/she wants to
search on the basis of Principal Employer or Contractor

NOTE – The process shown is meant for Contract Labour Act – 1970. Similarly the reports for all

The Superadmin Panel includes


• Shop Type Master
• Business Master
• Unit Master
• Officer Master
• User Management
If the Department needs to add, edit or delete a category of shop, business or unit then it can be
done through the Superadmin panel. The department can also edit, add or delete any officer of a
particular department along with all the details.

A – Enter the respective username here


B – Enter the password
C – Enter the Text shown
D – Click Login button
