JUDICIAL AFFFIDAVIT OF LEONARD MAGTANGGOL

I, Leonard Magtanggol, 27 years old, single and residing at Lot 17, Block 1, Eagle

Nest Villa Subdivision, Bakakeng, Baguio City, a room boy after having been duly

sworn in accordance with law hereby depose and state that:

Atty. Precious Angela B. Eugenio (ung prosecutor rin ba mismo ang dpat

magcoconduct ng examination or pwedeng private counsel?) is the counsel who

supervised and conducted my examination as a witness at her office Room 465,

Antipolo Building 89, Session Road, Baguio City, Philippines; (kailangan bang may

ibang tao na nag witness dto sa Q and A? or kahit wala na?)


I am answering the questions herein fully conscious that I do so under oath

and that I may be criminally liable for false testimony or perjury for false

statements given by me or made by me.

OFFER OF TESTIMONY

The testimony of the witness is being offered to prove that on July 25,

2018, he was a room boy at Dreamland Inn, that he saw accused Marie Celo and

Hilario Banzuela Jr., inside room No.2 when the former opened the door, and he

also saw both Hilario Banzuela Jr., and Marie Celo when they went down from

room 2 of the Dreamland Inn on July 25, 2018 at about 2:00 in the afternoon; and

that he also saw the dead body of Lando Bloom wrapped in a white blanket at

room No. 2 on July 25, 2018.

Q: Mr. Witness, please state your name, your age and other personal

circumstances.

A: I am Leonard Magtanggol, 27 years old, single and residing at Lot 17, Block

1, Eagle Nest Villa Subdivision, Bakakeng, Baguio City, a room boy at Dreamland

Inn.

Q: Mr. Magtanggol you said that you are an employee of what company?

A: The Dreamland Inn ma’am.

Q: Will you tell us the period of time when you were employed at the

Dreamland Inn?

A: From July 2017 up to the present ma’am.


Q: On July 25, 2018, did you report for work on that date?

A: Yes ma’am.

Q: At about 1:30 in the afternoon, what unusual incident happened on July 25,

2018?

A: On July 25, 2018, a man came saying that he was from the PERA MO PALIT

KO (PMPK) carrying a bright yellow bag with a PMPK logo, ma’am

Q: Did the man tell you why was he bringing money?

A: He told me that someone called to change yens to pesos, ma’am.

Q: Did the employee of the PERA MO PALIT KO (PMPK) tell you where to find

the caller who likes her yens to changed to pesos?

A: He told me that the she was inside room No.2 of the Dreamland Inn, ma’am.

Q: Now, after he told you, what did you do?

A: I told him to wait for me and I went up to the room, ma’am.

Q: Where did the employee wait?

A: Outside room no. 2 of the Dreamland Inn ma’am.

Q: When you said outside room no. 2, what particular place was he at the

time?

A: Outside the garage ma’am? (kindly enlighten me kasi dko maimagine ito)

Q: The employee of PERA MO PALIT KO (PMPK), was he a man or a woman?


A: A man, ma’am.

Q: Did he tell you his name?

A: No, ma’am.

Q: You said you told the employee of the PERA MO PALIT KO (PMPK) to wait,

did you go to room no. 2?

A: I went to room no. 2 and I knocked at the door. Then a woman went out

and I told her, “ma’am meron pong lalaki na magpapalit daw ng yens.”

Q: After you told the person who opened the door of room no.2 what

happened next?

A: She told me to let the person go upstairs and enter the room, ma’am.

Q: What was your answer to her?

A: I said yes, ma’am.

Q: And so, what did you do?

A: I went down and let the employee from PERA MO PALIT KO (PMPK) go to

room no.2, ma’am.

Q: How about you, what did you do?

A: I accompanied the moneychanger upstairs. We knocked at the door and

then the woman inside the room told me to let him come in, ma’am.

Q: Who went inside room no. 2?


A: The moneychanger ma’am.

Q: How about you? Did you go inside the room?

A: No, ma’am, I went down form room no. 2 and I waited at the garage ma’am.

Q: How far was the garage from room no. 2?

A: Near, ma’am.

Q: What did you do at the garage?

A: I waited at the garage of room no.2 ma’am.

Q: How long did you wait at the garage of room no.2?

A: More or less for twenty (20) minutes, ma’am.

Q: From where you were waiting, could you see the moneychanger and the

person who opened the door?

A: No, ma’am.

Q: Why could you not see them?

A: Because the room was upstairs and I was downstairs, and there was a door

at room no. 2 ma’am.

Q: Now Mr. Magtanggol did the employee of the PERA MO PALIT KO (PMPK)

go down from room no. 2?

A: No ma’am.

Q: Who did you see went down from room no. 2?


A: The woman bringing P500 ma’am and a man carrying with a bright yellow

bag with a PMPK logo.

Q: Where were you when she went down from room no. 2?

A: At the garage of room no.2 ma’am.

Q: How did you know that the woman had P500?

A: She gave to me the P500 and she told me “boy magkano ang bill namin?”

Eto ang P500 sa iyo na yan,” ma’am.

Q: What was your response?

A: I said “wait ma’am, where is the moneychanger.”

Q: What was her answer to your question about the whereabouts of the

money changer?

A: The woman told me to immediately pay the bill because they were in a

hurry and she told me to get a taxi ma’am.

Q: Why did you ask about the moneychanger from the woman who gave you

P500?

A: Because she already went down but the man from the moneychanger had

not yet came down, ma’am. I was wondering why the man had stayed there for

too long when changing money was only for a short time, ma’am.

Q: At what time did the employee of the moneychanger enter the room no. 2?

A: About 1:30 in the afternoon on July 25, 2018, ma’am.


Q: At what time did that woman and the man come down to give you P500

and asked for the bill?

A: About 2:00 in the afternoon, ma’am, on July 25, 2018.

Q: Now, after she insisted that you receive the P500 and call for her a taxi,

what did you do?

A: I did not get the P500 and I asked her again about the man from the

moneychanger, but she told me again to get the P500 and to get for her a taxi

ma’am.

Q: What did you do after that?

A: When Joe passed by, my co-employee, I called him ma’am.

Q: After you called Joe, what happened next?

A: He approached me and I told him to take her bill and get a taxi ma’am.

Q: After that what did you do?

A: I was still in front of them and she told me to get our bill because they were

in a hurry ma’am.

Q: After telling you to move fast because they were in a hurry, what did you

do?

A: I went to the operator and I told the operator about the bill of room no. 2

ma’am.

Q: What do you mean by operator?


A: The operator of the Inn, the one taking the orders of the customers, ma’am.

Q: Now, after you went to the operator, what did you do next?

A: The operator told me that the bill is with Joe ma’am.

Q: What did you do next?

A: I went back to the garage ma’am and I saw the taxi coming in and after that

the woman and the man approached the taxi ma’am.

Q: Who were the woman and the man who approached the taxi coming inside

the Inn?

A: They were the customer at room no.2 ma’am.

Q: Now, what happened next?

A: They boarder the taxi and I told the driver to wait as I will check the room

ma’am.

Q: Did you check the room?

A: I called Joe and we went to room no. 2 ma’am.

Q: What happened at room no. 2 when you went there ma’am.

A: When Joe and I went upstairs I switched on the light as it was dark ma’am

and I saw the beddings soaked with blood ma’am.

Q: Will you describe it further to us?


A: I saw the bedding soaked with blood and there was a person beneath the

bed with stabbed wounds, ma’am.

Q: What was the position of the person with stabbed wounds when you saw

him?

A: He was lying down, ma’am, I saw him with a lot of stabs and with a cable

wire around his neck, ma’am.

Q: What do you mean by cable wire? (hndi ko sure kung isasama pa ito kasi

dun sa complain affidavit natin nkalagay lang multiple stab wounds)

A: The wire connecting the TV, ma’am.

Q: where was this person lying down?

A: On the floor below the bed, ma’am.

Q: How about the bedding, where was it?

A: It was wrapped around the body of the person with stabbed wounds

ma’am.

Q: What did you do upon seeing the dead body inside room no. 2?

A: I went down and I saw the taxi going out. So I chased it and told the driver,

“sandali lang may nangyari sa loob ng kwarto”, ma’am.

Q: What happened after you told the driver to wait?

A: The driver did not listen to me because the woman had told him to hurry

up, ma’am.
Q: Where was the woman at the time you told the taxi driver to wait?

A: She was inside the taxi, behind the driver ma’am at the back seat.

Q: After the taxi had left, what happened?

A: When the taxi was about to go out, I met it at the other gate, ma’am.

Q: So what happened after you met the taxi at the other gate?

A: When it was near the gate I approached it, ma’am.

Q: What happened after that?

A: When the driver stopped in front of me, he opened the window and I told

him “Ma, sandali lang po dahil may nangyari sa loob ng kwarto,” ma’am.

Q: What was his answer?

A: He did not answer, ma’am.

Q: What did the taxi driver do after that?

A: The taxi ran outside, ma’am.

Q: After the taxi ran outside, what did you do?

A: I went inside the Inn ma’am.

Q: After that, did you know what happened to the woman and the man after

the taxi they rode ran outside?

A: Joe told me to go to Police Station (Julita court ito sa book, iniba ko lang ng

kaunti) because the woman and the man was apprehended and to see if she was

my customer at room no. 2 ma’am.

Q: Did you go and see the arrested woman?

A: I saw her, ma’am.

Q: Were you able to know why the policemen went there at the Police station?

A: Because our OIC called the Baguio City Police Station ma’am

Q: Now, in connection with the case, do you remember having executed a

sworn statement before the police?

A: Yes, ma’am.

Q: I am showing to you this sworn statement of Leonard Magtanggol, will you

examine it?

A: Yes, ma’am, that is mine.

Q: Whose signature is this?

A: Mine, ma’am.

Q: I have marked the sworn statement of Leonard Magtanggol as Exhibit

(anong exhibit to) and the signature as (Exhibit- ???)

Q: Do you attest to the truthfulness of your statement and allegations in this

Judicial Affidavit?
A: Yes, ma’am.

Q: Do you have anything else to add?

A: No more, ma’am.
