AGREEMENT TO SELL

This Agreement to sell is made at __________ on DD____ /MM_________/YY______

AND WHEREAS the said Owner/s is/are the sole and absolutes owner of

No.________situated at Tehsil ______________________________________________________
________________________________________________which has been self purchased by me/us
and is the ownership and possession of me/us and the same is free from all sorts of encumbrances i.e.
sale, Gift, mortgage, claims, charges, dispute, lien , attachment, Court case, litigation etc.

NOW THIS DEED FURTHER WITNESSS AS UNDER:-

1) Agreed Sale Price: That the total sale price of the said Land/flat/house/shop is fixed at
Rs._________________/- (Rupees ____________________________________Only).

2) Agreed Byana Price: That the said purchaser/s had paid to the said owner/s a sum of
Rs_______________/- (Rupees ___________________________________ Only) in cash as
earnest money (Byana), for which amount they said owner/s hereby acknowledges the separate
receipt in the presence of the marginal witnesses.

3) Final/Balance Agreed Payment Amount: That the balance payment after deducting the
earnest money (Byana) from the above mentioned total sale price Rs. __________
(Rupees ____________________________________Only) will be paid by the purchaser/s to
the owner/s at the time of execution of transfer papers/sale deed/transfer final papers.

4) Full & Final Agreed Payment Date/Place: That the purchaser shall pay remaining sale
consideration money in favour of Seller(s) or whom they will direct to do so, and sale deed will
be executed and registered on dated ________________ at address____________________.

5) That the purchaser/s can get the said Land/flat/house/shop transferred in his/her/their own
names(s) or in the name(s) of his/her/their nominee(s) or any other person(s) whosoever and the
said Seller/s shall have no objection for the same.

6) That the said purchaser(s) or his/her/their nominee(s) Name ____________shall hereinafter be


responsible and entitled for all type of loss or profit arising out of said deal/bargain and said
purchaser(s) is authorized by the said Seller(s) to receive any amount of earnest money/advance
from other person(s) by virtue of this agreement to sell and the said seller(s) shall not have any
objection for the same at any later stage, but the said purchaser(s) shall be responsible to make
the full and final payment to the said seller(s) as per Provision of Clause No.1 of this
“Agreement to Sell”. All expenses on execution of transfer papers/final papers will be borne by
the purchaser/s.

7) That the said owner/s will handover peaceful physical vacant possession of the said property
alongwith all original documents and papers pertaining and fixture of the said property to the
said purchaser/s at the time of execution of transfer papers/final papers.

8) That if the said purchaser/s back out from this sale agreement then his/her/their Earnest
money/Byana shall stand forfeited in favour of the said owner/s and if the said owner/s
backs out from this sale agreement then they shall have to pay the two times of the
earnest money to the said purchaser received by them from the said purchaser and the
purchaser shall have the option either to get the said damages accepted or get the said
sale effected through the Court of Law under the Specific performance of Relief Act.
