CONSTITUTION AND BY-LAWS OF PWD FEDERATION of DUMALAG,


CAPIZ
PREAMBLE

We, persons with disability of Dumalag, Capiz and all 19 barangays endeavour to develop our
community and under the guidance of our God and Creator manifest our concern for the nature
and the environment in order to establish a PWD an Association of the PWD Federation, Dumalag,
Capiz, do hereby promulgate this Constitution and By-Laws.

We, the members of the PERSONS WITH DISABILITY FEDERATION OF DUMALAG, CAPIZ and all 19
barangays seeking the Divine Guidance in order to establish an Association that shall embody our
ideals, assist in our great task and responsibility to protect the interest of all members, to promote
mutual help and understanding, to include civic consciousness among ourselves and foster love of
our country, do hereby obtain and promulgate this Constitution and By-Laws.

ARTICLE 1 – NAME AND DOMICILE

Section 1. The name of this organization is Persons With Disability of Dumalag, Capiz
Section 2. The permanent address of this Federation is PDAO Office Poblacion, Dumalag,
Capiz

ARTICLE 11 - VISION AND MISSION

Section 1. Vision

ARTICLE 111 – OBJECTIVES

Section 1. The following are the objectives of this association:


a. To create protection mechanism advocacy and awareness of the inclusion
of Persons with Disability rights;
b. To unify all members of the federation for a common good;
c. To conduct various capacity building trainings among members;
d. To establish a strong Unified Persons with Disability group;
e. To implement income generating programs for the members.
Secrion 2. The Federation shall, through a resolution by the Officers and ratified by a simple majority
Of its General Membership attending the meeting called for such purpose do such act as
May be requisite, necessary and proper to carry out its purpose to attain its goals.

ARTICLE 111 - MEMBERSHIP

Section 1. Except for those who are already members of this Federation before the ratification
Of this Constitution and By-Laws, membership shall be open to all Person with
Disability and individuals of 18-59 years old only legal age who are:

a. Person with Disability/Parents of Children with Disability;


b. Willing to abide and live with the Federations objectives;
c. The affected Persons with Disability barangays should have a resolution
List of Officers and Members signed by the Barangay Council and
Chairman.

ARTICLE IV - RIGHTS AND DUTIES OF ACTIVE MEMBERS

Section 1. Rights of the Members. An active member shall have the right to:
a. Vote and be elected upon in any position of the Federation;
b. Be informed of the activities concerning the federation;
c. Avail the existing benefits of the Federation.

Section 2. Duties of the Members. An active members shall endeavour:


a. To conduct, converse and convey the objectives of the Federation;
b. To render support to every member in the best manner and effort;
c. To strive for the advancement of this Federation.

ARTICLE V-TERMINATION OF MEMBERSHIP

Section 1. Termination of Membership by the Federation. The membership in this organization shall
Be terminated upon:
a. Death;
b. Commission of crimes and other analogous circumstances;
c. Transfer of residency outside Dumalag;
d. If elected as Government official;
e. Malicious misconduct against the Association and its Officers;
f. Oral defamation against the Officers and its Association.

ARTICLE VI - FEDERATION OFFICERS MEETINGS

Section 1. The Federation shall be governed by the General Membership, Officers, and the Board
Of Directors.
Section 2. The General membership shall:
a. Be composed of active members;
b. Be the highest policy making body;
c. Elect the Officers and the Board of Directors of the Federation;
d. Formulate, revise and approve general policies and program of actions and
budget of the organization.
Section 3. The Officers:
a. Be composed of the President, Vice-President, Secretary, Asst. Secretary, Treasurer,
Auditor, Asst. Auditor, Business Manager, Asst. Bus. Mgr. P.R.O., Board of Directors,
Chairman and Members,
b. Ex-Officio Member or representative of CSWDO, DILG and Federation;
c. Meets monthly every 2nd Friday of the month.

Unless otherwise assigned by the General Membership, the following are the Duties of the
Officers and Board of Directors:

a. President – shall preside over all meetings of the General Membership; shall enforce
the Constitution and By-Laws and other resolutions and measures passed
and approved by the General Membership and/or Officers; sign all
documents requiring his signature; approve all vouchers, requisitions and
all papers calling for payment and/or expenditures from the fund of the
association, and performs such other duties and functions as may be
assigned by the association.

b. Vice- President – shall take over the duties and function of the President in the event
the latter’s absence, disability, resignation, or death; serve
unexpired term of his predecessor and perform such other duties
and functions delegated by the federation as necessary deemed
by the Federation President.

c. Secretary – shall be the custodian of all records and minutes of all meetings of the
association; shall inform all concerned at least three (3) days before the
designated date of regular and special meetings; and shall perform such
other duties and functions may be assigned by the association;

d. Assistant Secretary – shall take over the duties and function of the Secretary in the
the event of the latter’s absence, disability, resignation, or
death; serve unexpired term of his predecessor and perform
such other duties and functions delegated by the federation
as necessary deemed by the Federation Secretary.

e. Treasurer – shall be the custodian of all financial records, book of accounts, cash
and properties owned or held in trust by the association; collect or cause
to be collected all dues and payables to the association and issue official
receipt thereof; shall render a complete report to the General
Membership during the meeting of the association’s cash position and
Financial standing and shall perform such other duties and functions as
May be assigned by the association.

f. Auditor – will be the check and balance Officer of the Treasurer.


g. Assistant Auditor – shall take over the duties and function of the Auditor in the event
of the latter’s absence, disability, resignation, or death; serve
unexpired term of his predecessor and perform such other duties
and functions delegated by the Federation as necessary deemed
by the Federation Auditor.

h. Public Relation Officer – shall be responsible for the releasing statements to the
media;

i. Business Manager – shall direct, supervise and manage the affairs and activities of the
association as may be directed by the President or General
Membership and shall perform such other duties as may be
Assigned by the association.

j. Assistant Business Manager – shall take over the duties and function of the Bus.
Manager in the event of the latter’s absence, disability,
Resignation, or death; serve unexpired term of his
Predecessor and perform such other duties and functions
Delegated by the Federation as necessary deemed by
The Federation Business Manager.

k. Board of Director – shall be responsible of making laws and amendments of the same

ARTICLE VII - NOMINATIONS, ELECTIONS, TENURE OF OFFICE AND SUCCESSION

Section 1. The Officers and Board of Directors shall hold office for a term of three (3) years until
successors shall have been duly elected and qualified. Until the association shall provide otherwise,
the terms of officers shall commence after installing them to office not later than five (5) days after
their election.

Section 2. Any vacant position can be filled in through a special election set forth by the
Executive Board and approved by the General Membership.

Section 3. Termination after 5 consecutive absences with written warning.

ARTICLE VIII – AMENDMENTS

Section 1. This Constitution and By-Laws may be amended, repeated or changed by an


affirmative vote 2/3 of the General membership at any regular or special meeting.

Section 2. The next of the proposed amendment of this Constitution and By-Laws shall be
submitted to the Secretary in writing at least seven (7) days prior to the date of the Federation
meeting at which the amendment may be considered.
ARTICLE IX – ORDER OF BUSINESS

Section 1. The following shall be the order of business in every meeting of the organization:
a. Prayer
b. Call to order (roll call)
c. Reading of the Minutes of the previous meeting and approval
d. Reporting
e. New Business
f. Other Matters
g. Adjournment

ARTICLE X – EFFECTIVITY

Section 1. The Constitution and By-Laws shall take effect immediately upon ratification by the
General Membership in the plebiscite called for such purpose by the incumbent Officer and the
Board of Directors and shall supplement all other existing laws and regulations adopted by this
association.
