INTRODUCTION

Marriage is the highest social relationship of human being. According to R.N. Sharma a Hindu
marriage is “a religious sacrament in which a man and a woman are bound in permanent
relationship for the physical, social and spiritual purposes of dharma, procreation and sexual
pleasure.” The Vedas hold marriage to be one of the important sacraments sanctifying the body.
That is why marriage is given great importance by the Hindus. It is said, “That man who does not
win a wife is really half, and he is not the full man as long as he does not beget an offspring.”

AIMS AND OBJECTIVES

1. To analyse the concept of marriage and divorce under old Hindu law.
2. To review the impact of legislation in the sphere of marriage and divorce under Hindu
law.

HYPOTHESIS

1. Too much legislation interference into the Hindu law caused the threat of altering its
divine nature.
2. There is a threat to the sacramental nature of Hindu marriage because of –
 Liberalization of the grounds of divorce by the Hindu Marriage (Amendment)
Act, 1964 and
 Too much liberalization of the grounds of divorce by the Marriage Laws
(Amendment) Act, 1976.

RESEARCH METHODOLOGY

For the project research, researcher will rely upon doctrinal method of research.

The researcher will be relying on secondary sources to complete the project.

LIMITATIONS

The researcher has time and territorial limitations in completing the project.
