Defendant.

The State of Utah, by and through the Utah County Attorney’s Office, charges the
defendant with the commission of the following offense:

COUNT 1: TERRORISTIC THREAT, a second degree felony, in violation of Utah Code


Ann 76-5-107, in that on or about August 7, 2019, in Utah County, the defendant, Colton
John Shay Cox did threatened to commit an offense involving bodily injury, death, or
substantial property
damage and:

(i) threatened the use of a weapon of mass destruction, as defined in Utah Code Ann. §
76-10-401 or threatened the use of a hoax weapon of mass destruction, as defined in Utah
Code Ann. § 76-10-401; or
(ii) acted with intent to intimidate or coerce a civilian population or to influence or affect
the conduct of a government or a unit of government.

PROBABLE CAUSE STATEMENT: Thayne Call of the Lehi Police Department, having
probable cause to believe that the defendant committed the above-listed offense,
submitted the following evidence in support of the filing of this Information:

On August 7, 2019, in Utah County, Colton Cox left a voice message at the Traverse
Mountain Outlets shopping mall threatening "bad news" to come to the businesses unless
they cancelled the "Kidchella" back-to-school children's shopping event planned for
Saturday, August 10. This threat was an attempt to "intimidate or coerce a civilian
population." The threat ominously concluded, "You won't even see it coming." As a
result, the shopping center put their emergency protocols in place.

When police traced the phone call and found Cox, he admitted that he left the voice
message as a "prank," because he didn't agree with "their" political views. In a
handwritten apology letter, he stated, "I've very sorry about the panic. I didn't mean to
cause fear."

Cox was booked into the Utah County Jail on $5,000 cash/bond bail.

Based upon evidence received from Thayne Call of the Lehi Police Department, I have
reason to believe the defendant committed the offense as charged herein.
