I, Mickey Henderson, the undersigwd, being first duly sworn on oath, dcposcs and says

Becatgise of the following facts:
On August 10, 2019 at approximately 0136 hours I arrived at Mile Marker I73 on
Highway 20 1n Blaine County, Idaho, in response to a vehicle crash. Upon my arrival I
saw a white 1995 Dodge R25 pickup truck bearing Idaho plates IC49OT m the center of

Iperformed SFST‘s and decision points were met. I handcuffed Matthew, searched him
incident to arrest, checked the handcuffs for tighmess and dOuble-locked them Ithcn
placed Matthew 1n the back of my marked patrol unit and played the ALS audio for him.
Matthewlstated he understood the ALS audio and I begun my 15 minute waiting period
by my watch. I asked Matthew not to burp, belch or vomit. Aficr the 15 minute waiting
period I asked Matthew ifhe had burped, belchcd or vomited, to which he stated he had
not. I also checked inside Matthew’ s mouth for obstructions and found none.
I had matthcw provide 3 breath samplm into a Lifeloc F020 and gained the results - .,146
.,191 and. 189. The FCZO (serial # 1902003 7) was verified on August 10, 2019 at 0403
and 0406 hours, gaining a positive verification of .077 and ..077 The last calibration was
doue on June 13, 2019. My certification expires July 8, 2021.
Matthew; was tranSported to the Blaine County Jail and booked for Aggavatcd DUI
(Idaho Code 18'8006) and Vehi cular Manslaughter (Idaho Code l84006(3)(b)).
On 8/10/19, Detectives Mike Abaid and Steve Hansen interviewed Park at the Blaine
County Public Safety Facility Prior to speaking with Park, Det Abaid read him his
Miranda nghts and Park said he understood his rights
conSumed 2 large Coors drafi beers which was confirmed through a receipt Det. Hansen
obtained éfiom the Wicked Spud It should be noted that each large Coors drafi beer Park
consumed held 25 ounces ofbcer. Park said afier the Wicked Spud he drove back to his
residencé m Fairfield. On the way back to Fairfield, Park said he stoPPed at the Valley
Country Store' m Bellevue to pick up a 6-pack of Coors beer, which was later confirmed
to be a of 16 ounce Coors cans by Det. Hansen through a receipt fi'om the store

Afier arriving back to his residence 1n Fairfield, Park said he consumed 2 of the Coors
beers fi’om the purchased 6-pack, then got cleaned up to go back to Bellevue. Park said he
went back to Bellevue around 6: 00 PM and went to Mahoney’ s Ba: and Grill where he
said he censumed approximately 4 Coors beers Det Hansen was able to obtain a receipt
fiom Mahoney’ s Bar and Grill showing Park to have purchased 5 beers and that he paid
his bill at 8: 30 PM After Mahoncy' s Park said he went across thc street to the Silver
Dollar Saloon, where he stayed until he drove back towards his residence 1n Fairfield.
While at the Silver Dollar Saloon, Park said he consmned approximately 4 Coors beers.
In regards to the accident, Park said he remembers the traffic light on the bridge being
gecn as he approached the construction area near mile post 173 on Highway 20. He said
he proceéded to go through the construction zone and did not see Lurak’s Dodge Neon
unfil justgbefore impact. Park said he did not see any lights emitting fi'om the back of the
Dodge Neon pn'or to the impact.
In regards to his intoxication level, Park admitted he was intoxicated and drunk. He said
even witfiout being able to see any brake lights and with the glare and darkness, “If I was
perfectlyialm, I would have seen same resemblance of a silhouette of a ca: there and I
didn’t, I did not see that."
Ispoke with Detective Hansen, who stated fie spoke with Emma‘s mother Hansen stated
she told him Somchai sustained neck and back mjuriw with possible paralysis. Hansen
stated she told him Emma sustained a broken ann.
Nothing Follows.
