DEED OF SALE WITH ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This DEED made and entered at


_____________________, and between SPS. JOJEE CATAP
YABUT and JACQUELINE C. YABUT, both legal ages, Filipinos,
and a residents of 18 Lapu-Lapu, Teopaco Lourdes, City of San
Fernando, Pampanga, and hereinafter called the VENDORS,

-and-

ABIGAIL M. PACAMARA, legal age, single, Filipino, and


resident of Brgy. Dolores, City of San Fernando, Pampanga, and
hereinafter called the VENDEE;

WITNESSETH

WHEREAS, the VENDORS is the owner of that certain property with all
the improvements existing thereon, situated at Block 13, Lot 3, Brgy.
Magliman Pacific II, City of San Fernando, Pampanga covered by Transfer
Certificate of Title No. 042-2016010068 of the Register of Deeds of
Pampanga, and more particularly described as follows:

"A PARCEL OF LAND (LOT 3 OF THE CONS. SUBD. PLAN


PCS-03-021494 BEING A PORTION OF LOT 20, BLOCK 13, PCS-
03-004634; LOTS 18 AND 22, ALL OF BLOCK 13, PCS-033-
004634 LRC REC. NO.) SITUATED IN THE BARANGAY OF
MAGLIMAN, CITY OF SAN FERNANDO, PROVINCE OF
PAMPANGA. CONTAINING AN AREA OF SIXTY FOUR (64)
SQUARE METERS MORE OR LESS."xxx

That the above house and lot are mortgage to Home Development
Mutual Fund (HDMF) as security for the amount of EIGHT HUNDRED SIXTY
TWO THOUSAND TWO HUNDRED 78/100 (₱862,200.78), under the
promissory note with loan and mortgage agreement signed and executed by
the VENDORS in favor of Home Development Mutual Fund (HDMF) executed
on April 10, 2017 at City of San Fernando, Pampanga.

WHEREAS, the VENDEE may assume Home Development Mutual Fund


(HDMF) balance starting on September 10, 2017 including occurrence of
charges until fully paid.

WHEREAS, The VENDEE has agreed to assume, as they hereby


assume, all the duties and obligations of the VENDORS imposed upon the
latter in the afore-mentioned Mortgage Deed.

WHEREAS, the VENDEE hereby obligation herself to assume and pay


all the balances of VENDORS, has far as this DEED OF SALE WITH
ASSUMPTION OF MORTGAGE is concern.

NOW THEREFORE, for and in consideration of the sum of EIGHT


HUNDRED SIXTY TWO THOUSAND TWO HUNDRED 78/100 (₱862,200.78),
hand paid by the VENDEE to the VENDORS, the SELLERS DO HEREBY SELL,
TRANSFER, and CONVEY by way of Absolute Sale unto the said VENDEE, his
heirs and assigns, the certain parcel of land together with all the
improvements found thereon, free from all liens and encumbrances of
whatever nature including real estate taxes as of the date of this sale.
