AFFIDAVIT

We, ROSARIO G. BORJA, widowed or married again, BENJAMIN

AGUSTIN B. LIM, JR.. married to Jocelyn Andrade, ROSEMARIE B.
LIM, married to Sergio Wong Jr., and GIOVANNI JOSEF B. LIM, all of
legal age, Filipinos and residents of Cebu City, Philippines, hereby
depose and state that:

1. We are the only compulsory heirs who survived the

decedent Benjamin Lim Sr.;

2. A Deed of Extrajudicial Settlement of the Estate of the

Decedent Benjamin Lim Sr., and Adjudication among
Compulsory Heirs was executed by and among us in
February 20, 1993;

3. Such Deed provides that there are real and personal

properties which remain in co-ownership by and among the
compulsory heirs of the decedent;

4. Such properties include a parcel of land particularly

described as follows:

TCT No. T-46587

A parcel of land (Lot 2079-B-2-K-7 of the

subdivision plan (LRC) Psd-93393, being a portion
of Lot 2079-B-2-K, (LRC) Psd-66075, L.R.C. Cad.
Rec. NO. 1562), situated in the District of Cogon,
City of Cagayan de Oro, Island of Mindanao.
Bounded on the N., points 3 to 4 by Lot 2079-B-2-
K-g, of the subdivision plan; on the E.,, points 4 to
5 by Lot 2079-B-2-B, (LTC) Psd-66075; on the S.,
points 5 to 6 by Lot 2079-B-2-K-8, and on the W.,
points 6 to 1 by Lot 2079-B-2-K-5, , points 1 to 2
by Lot 2079-B-2-K-4, points 2 to 3 by Lot 2079-B-2-
K-3, all of the subdivision plan. Beginning at a
point marked “1” on plan, being S. 26 deg.58’ W.,
1040.89 m. from B.B.M. No. 4, Cagayan Cadastre;
thence N. 5 deg. 15’ E., 24.93 m. to point 2;
thence N. 5 deg. 18’ E., 3.46 m. to point 3;
thence S. 85 deg. 33’ E., 31.20 m. to point 4;
thence S. 85 deg. 16’ W., 33.23 m. to point 5;
 thence N. 85 deg. 40’W., 31.20 m. to point 6;
thence N. 5 deg. 17’ E., 4.89 m. to the point of
beginning; Containing an area of ONE THOUSAND
AND THIRTY SEVEN (1,037) SQUARE METERS, more
or less.

5. We intend to absolutely and irrevocably sell, transfer and

convey the above-described parcel of land;

6. To complete the transfer of the parcel of land and the

registration thereof, the Land Registration Authority
requires us to furnish the Original Copy of the Deed of
Extrajudicial Settlement of the Estate of the Decedent
Benjamin Lim Sr., and Adjudication among Compulsory
Heirs;

7. All other original copies of the Deed of Extrajudicial

Settlement were submitted to various government
agencies, such as the Bureau of Internal Revenue;

8. No copy, other than the copy certified by the Bureau of

Internal Revenue as the true and faithful representation of
the original, also known as a Certified True Copy, is in our
possession;

9. We execute this affidavit to attest to the truth that we are

the absolute owners of the parcel of land covered by TCT
No. T-46587 despite the absence of the original copy of the
Deed of Extrajudicial Settlement of the Estate of the
Decedent Benjamin Lim Sr., and Adjudication among
Compulsory Heirs, to attest to the truth of the foregoing
facts and for whatever purpose this affidavit may serve.

IN WITNESS WHEREOF, we hereunto set our hand this ___ of
