EXECUTIVE ORDER NO. 6 of 2019

CHANGES IN THE STRUCTURE OF THE EXECUTIVE

PRESIDENTIAL ACTION

WHEREAS, Article 132 of the Constitution confers on the President of the Republic,
the Authority to direct and co-ordinate the functions of Ministries and Government
Departments;

WHEREAS, the Principles of Executive Authority set out under Article 129 of the
Constitution require that Executive Authority be exercised in a manner that serves the
best interest, well-being and aspirations of the People of Kenya;

WHEREAS, there is compelling need to orientate the scope and mandate of various
Ministries, State Departments and State Agencies to expedite the ongoing
implementation of the transformative vision for a better Kenya espoused as the Big
Four Agenda, which is: decent and affordable housing; affordable healthcare for all;
food and nutrition security for all Kenyans and job creation and economic growth
through manufacturing;

WHEREAS, my administration is committed to enhancing efficiency, transparency


accountability and operational autonomy through a governance structure that
ensures rapid delivery of public services to Kenyans in every part of the Republic; and

WHEREAS, it has become necessary to effect changes in the structure of the


Executive to embed operational enhancements in Ministries, State Departments and
State Agencies.

NOW, THEREFORE, by the Authority vested in me as President by the Constitution


and the Laws of the Republic of Kenya, I, UHURU KENYATTA; President of the
Republic of Kenya and Commander-in-Chief of the Kenya Defence Forces DO
HEREBY ORDER AND DIRECT as follows:

I. THAT the Executive Office of the President, identified Ministries, State


Departments and State Agencies shall be reorganized as set out in this
Executive Order;

II. THAT the portfolio responsibilities and changes made in the structure of the
Executive set out in this Order shall come into effect immediately; and

III. THAT Executive Order No. 1 of June 2018 (as revised), is hereby further
amended accordingly.

A. TRANSFER OF FUNCTIONS TO MINISTRIES

To strengthen the efficacy of delivering the mandate of the Executive Office


of the President, to direct and co-ordinate functions of Ministries and State
Departments, the functions and ancillary institutions set out hereinafter are
transferred from the Executive Office of the President to various
Ministries and State Departments, as follows:

B. MERGER OF STATE DEPARTMENTS

I. WATER SECTOR

I.I To enhance synergy within the Water Sector, which is a key enabler for
the implementation of the “Big Four”, the State Department for
Irrigation is merged with the State Department for Water & Sanitation
to establish the MINISTRY OF WATER & SANITATION AND
IRRIGATION.

II. REGISTRATION OF PERSONS & IMMIGRATION

II.I To foster the integration of the functions of Registration of Persons and


the functions of Immigration, the State Department for Interior and the
State Department for Immigration & Citizen Services are merged to
establish the STATE DEPARTMENT FOR INTERIOR & CITIZEN
SERVICES.

II.II The State Department for Interior & Citizen Services shall be domiciled
within the Ministry of Interior and Co-ordination of National
Government.

C. REALIGNMENT OF MINISTRIES

In light of the changes caused hereinabove, the affected Ministries are hereby
re-established and renamed thus:
I. Ministry of Water & Sanitation and Irrigation; and
II. Ministry of Agriculture, Livestock & Fisheries.
