16 I. INTRODUCTION
17 Plaintiffs Board of Trustees of the Carpenters Pension Trust
18 Fund for Northern California ("Plaintiffs") seek entry of Default
19 Judgment against Defendant GDT Builders, Inc. ("GDT" or
20 "Defendant"). ECF No. 15 ("Mot."). Having considered the papers
21 submitted, the Court concludes that entry of Default Judgment
22 against Defendant is appropriate, and GRANTS Plaintiffs' Motion.

24 II. BACKGROUND
25 Plaintiffs contend that GDT is bound by the terms and
26 conditions of a collective bargaining agreement, known as the
27 Carpenters Master Agreement for Northern California. Compl. at 2;

11 on the merits. Eitel v. McCool, 782 F.2d 1470, 1471-72 (9th Cir.
12 1986).

14 IV. DISCUSSION
15 A. Service of Process
16 Federal Rule of Civil Procedure 4(h) provides that a
17 corporation may be served in the manner prescribed by Rule 4(e)(1),
18 which allows service to be perfected by following state law. Fed.
19 R. Civ. P. 4(h), 4(e)(1). California law provides that a
20 corporation may be served
21 by leaving a copy of the summons and complaint
during usual office hours in . . . [the
22 corporation's] office or . . . usual mailing
address . . . with the person who is apparently
23 in charge thereof, and by thereafter mailing a
copy of the summons and complaint by first-
24 class mail, postage prepaid to the person to be
served at the place where a copy of the summons
25 and complaint were left.
26 Cal. Code Civ. Proc. 415.20(a). This method of service is deemed
27 complete on the tenth day after the mailing. Id.

1 Here, service was left with "Tammy Doe," the person in charge
2 at GDT's business address, 710 Aldo Avenue, Santa Clara,
3 California, on July 28, 2010, at 11:22 a.m. ECF No. 5 ("Proof of
4 Service"). The process server estimates that she was forty years
5 old. Id. The following day, the summons, complaint and other
6 relevant documents were mailed to GDT at its business address. Id.
7 The Court finds that service of process was adequate and complete
8 by August 8, 2010. The Clerk of Court entered default as to
9 Defendant on September 1, 2010. ECF No. 10.

1 V. CONCLUSION
2 The Court GRANTS the Motion for Default Judgment filed by
3 Plaintiffs Board of Trustees of the Carpenters Pension Trust Fund
4 for Northern California. Within fourteen (14) days of this Order,
5 Plaintiffs shall file a declaration calculating the amount of
6 interest and liquidated damages and explaining the basis for the
7 calculations. Interest should not accrue beyond September 14,
8 2010, the date Plaintiffs filed their Motion for Default Judgment.
9 Upon receipt and consideration of this declaration, the Court will
10 enter judgment in an appropriate amount. Failure to timely file
