JOINT AFFIDAVIT

THAT We, FEDERICO U. FONTELO, and BILLY PABRIGAL both of legal ages,
Filipinos, and a residents of Sitio Campaclan, barangay Poblacion, Sibulan, Negros
Oriental, after having been duly sworn to in accordance with law, do hereby depose and
manifest:

That we personally know ROWEL LITERAL and REGEN YBIOSA because we

are neighbors in sitio Campaclan, Poblacion, Sibulan, Negros Oriental and at the same
time working in the construction business of Joel’s Construction in an on and off basis,
and in short, we are only working if there is a construction going on and stop working if
said construction is finished and will be hired again if Joel has another house
construction;

That I, FEDERICO U. FONTELO, together with Rowel Literal were working

together in the construction of the house of Minerva F. Albon, sister of Joel Folio in
Campaclan, Poblacion, Sibulan, Negros Oriental and Rowel Literal has worked for only
two days up to September 20, 2006, and thereafter I did not see him reporting for work
again; though Joel Folio was inquiring where was Rowel Literal and I just told him that
he did not report for work;

That I, BILLY PABRIGAL, together with Regen Ybiosa were also working in the
construction of the house of Sofia Theresa Strong, located in Bantayan, Dumaguete City,
Negros Oriental starting around August 30, 2006; and that in the early morning of
September 25, 2006 we rode on the Dump truck at Joel Folio’s house in Campaclan,
Sibulan, Negros Oriental and while we were on our way to our work in Bantayan,
Dumaguete City, suddenly Regen Ybiosa requested the driver to stop the truck when we
reach at barangay Tubtubon, Sibulan, Negros Oriental, and he disembarked from the
dump truck without any message; that thereafter I did not see him anymore reported for
work in the construction until the present;

That lately, we learned that Rowel Literal and Regen Ybiosa filed a case for illegal
dismissal against Joel Folio and we were very much surprised because they were not
dismissed, but they were the ones who rather stop reporting for work;

That we executed this affidavit freely and voluntarily without any consideration
whatsoever, but just to affirm the veracity and truthfulness of our statement herein
