This Deed is entered into and executed by BALDOMERO BASUBAS, and HENRY B.
CABUHAY, both of legal age, Filipinos, married, and residents of Poblacion, Sibulan, Negros
Oriental,
WITNESSETH:
That there is a parcel of land known as Lot No. 95-D of the Cadastral Survey of Sibulan,
Negros Oriental registered in the names of BALDOMERO BASUBAS, VIRGENCITA
BASUBAS VDA DE DIVINAGRACIA, MICHAEL DIPUTADO and GUILLERMO
BASUBAS in an undivided share of One-fifth(1/5) each; and which parcel of land is more
particularly described as follows
That Virgencita Basubas Vda De Divinagracia and Beatriz Basubas have donated their
respective one-fifth (1/5) shares over the above-described parcel of land to Baldomero Basubas
in a document known as Deed of Extrajudicial Settlement and Partition with Deed of Donation,
under Doc. No. 454; Page No. 92; Book No. 14; Series of 2005 and notyarized by Atty. Rodrigo
V. Icao, Notary Public;
That the one-fifth (1/5) shares each of Michael Diputado and Guillermo Basubas over the
above-described parcel of land were also transferred to HENDRY B. CABUHAY in a Deed of
Sale known as Doc. No. 273; Page No. 56; book No. 14; Series of 2005, notarized by Atty.
Rodrigo Icao, Notary Public;
That the parties herein became the only co-owners of the aforementioned Lot No. 95-D
and in order to serve their interest better, they have agreed and caused the subdivision of the said
parcel of land into three sub-lots, namely Lot No.95-D-1; Lot 95-D-2; and Lot No. 95-D-3 which
are more particularly described as follows:
That, in order that the rights, interests, and participations of the parties over the said land
be better served, the First Party and the Second Party have mutually and voluntarily agreed to
officially partitioned and adjudicated unto themselves the above-described sub- lots into the
following manner:
1. Lot No. 2022-A, as above-described, shall belong to the FIRST PARTY; and,
2. Lot No. 2022-B, as above-described, shall belong to the rest of the co-owners known
as the SECOND PARTY
That further, the parties herein declare that the said parcel of land is not tenanted nor
worked upon by an agricultural lessee for the herein parties are the ones in possession of the said
parcel of land and that this transaction is in consonance with the provisions of the
Comprehensive Agrarian Reform Law of the Philippines.
