Filipino, married, with address at Junction Luna, Abulug, Cagayan, after having been sworn in accordance with law, hereby state that:
1. I am the owner of ALCANTARA COMMERCIAL, DB
ALCANTARA AGRI SUPPLY and DB ALCANTARA AGRI CONST SUPPLY (“Alcantara”) all located at Libertad, Abulug, Cagayan;
2. Defendant Victor Verzola (“Victor”) of legal age, married
with address at Poblacion Luna, Apayao;
3. ALCANTARA COMMERCIAL, DB ALCANTARA AGRI
SUPPLY and DB ALCANTARA AGRI CONST SUPPLY is engaged in the trading business of agricultural products and construction supply;
4. Between24 July 2014 to April 22, 2016, Victor started
purchasing construction supplies with Alcantara through credit;
5. Victor made partial payments but failed to settle the
principal amount of his purchases before due dates. As a consequence, the balance of his credit incurred surcharges of 3% per month and ballooned to Fifty Six Thousand Four Hundred Forty and Eight Centavos Pesos (P56, 440.08);
6. A Statement of Account in the amount of Fifty Six
Thousand Four Hundred Forty and Eight Centavos Pesos (P56, 440.08) dated 22 April 2016 is hereto attached to the complaint marked as Annex “A”;
7. A demand letter was sent to Balag on 23 February 2018
through mail with registry receipt ED 402 103 131 ZZ. a copy of the registry return receipt is hereto attached as “Annex B”; 8. To date the demand for payment seemed to have fallen on deaf ears as no payment was made at all.
I am executing this affidavit to attest to the truth of the
foregoing facts and for the purpose of filing the small claims complaint against Victor Verzola.
