ORDER

Upon consideration of the supplemental briefs, the requests to stay the


Certificate of Public Convenience and Necessity pending abeyance, and the Fed. R.
App. P. 28(j) letter advising the court that the Supreme Court granted the petitions for
writ of certiorari in United States Forest Service v. Cowpasture River Preservation
Association, No. 18-1584 (cert. granted Oct. 4, 2019), and Atlantic Coast Pipeline, LLC
v. Cowpasture River Preservation Association, No. 18-1587 (cert. granted Oct. 4,
2019), it is

ORDERED that these cases be removed from the October 16, 2019 oral argument
calendar and be held in abeyance pending further order of the court. It is

FURTHER ORDERED that the requests to stay be denied without prejudice to renewal
should construction or other relevant activity under the Certificate of Public Convenience and
Necessity be undertaken.
