5.))Plaintiff) ]inanced) and) supported) his) now) deceased) brother,)

Coco) Martyn’s) legal) education) at) Dr.) Vicente) Sotto) Law) School)
from)2007)to)2015;)

6.))On) March) 1,) 2015,) Plaintiff) received) a) call) from) the) now)
deceased)informing)him)that)after)eight)years)in)law)school,)the)
latter)had)passed)his)remaining)subjects,)all)with)a)2.75)mark,)
except) for) Taxation) I) and) Labor) II) which) are) handled) by) Atty.)
BIR)and)Atty.)LAB,)respectively;)

7.) On) March) 5,) 2015,) Plaintiff) received) another) call) from) the)
deceased) informing) him) that) he) had) obtained) the) passing)
grades)of)2.75)and)3.0)for)Labor)II)and)Taxation)I)respectively,)
which) he) acquired) through) conversation) with) the) two) above@
mentioned)professors;)

8.) On) March) 10,) 2015,) Plaintiff,) as) a) reward) to) his) now) deceased)
brother,)sent)P55,000)to)the)latter’s)bank)account)in)Chinabank,)
as) evidenced) by) a) copy) of) the) deposit) slip,) which) was) used) to)
pay)for)the)drinking)spree)session)of)the)latter)with)his)friends)
in)celebration)of)the)good)news)he)received;)

9.)On)March)15,)2015,)Plaintiff’s)parents)entered)into)a)Contract)of)
Loan)with)the)Development)Bank)of)the)Philippines,)secured)by)
a) Real) Estate) Mortgage) on) one) of) their) lots) located) in) Brgy.)
Utap,)Tacloban)City;)

10.)Part)of)the)proceeds)of)the)above)stated)Loan)was)used)to)pay)
for) the) rental) of) the) condominium) unit) to) be) used) by) the)
deceased)during)his)six@month)Bar)Exam)review)as)well)as)the)
review) fees) thereon,) amounting) to) P150,000) and) P60,000)
respectively;)

11.)On)March)27,)2015,)Plaintiff,)along)with)their)parents,)hosted)a)
send@off) party) for) his) now) deceased) brother,) amounting) to)
P100,000,) as) the) latter) embarks) on) to) his) review) classes) in)
Manila)on)April)2015;)

12.)On)May)15,)2015,)Plaintiff)and)his)other)siblings)deposited)in)
their) parent’s) bank) account) with) Chinabank) the) amount) of)
P120,000,)of)which)he)had)contributed)P50,000,)to)be)used)for)
a)surprise)party)for)their)now)deceased)brother)on)the)night)of)
the)latter’s)graduation;)

13.) On) May) 20,) 2015,) Plaintiff) purchased) for) his) now) deceased)
brother) a) designer) tuxedo) and) a) pair) of) Louis) Vuitton) shoes,)
amounting)to)P50,000)and)P35,000)respectively,)to)be)worn)by)
the)latter)in)his)graduation)day;)

14)On)May)30,)2015,)the)Plaintiff)and)his)other)siblings,)along)with)
their)now)deceased)brother,)]lew)to)Tacloban)City)from)Manila)
to)attend)the)graduation)of)the)latter)held)on)the)same)day;)

15.) On) the) day) of) the) graduation,) much) to) their) surprise,) their)
brother)Coco)Martyn)was)not)called)to)receive)his)diploma,)and)
upon) checking,) he) was) actually) not) listed) as) one) of) the)
graduates) in) the) invitation) which) they) received) on) the) day) of)
the)graduation)itself;)

16.)On)May)31,)2015,)Coco)Martyn)went)to)the)of]ice)of)the)school)
secretary) to) inquire) on) his) grades) and) found) out) that) he) was)
given) a) failing) grade) of) 5.0) each) for) Taxation) I) and) Labor) II)
contrary)to)what)his)professors)initially)told)him;)

17.)Coco)Martyn)stopped)attending)his)review)classes)and)was)not)
allowed) to) have) his) review) fees) and) condominium) rental)
refunded,)and)thereafter)exhibited)symptoms)of)depression;)

18.) On) August) 1,) 2015,) after) several) prior) consultations) with) Dr.)
John) Isiderio,) a) resident) psychiatrist) of) Saint) Michael) Hospital)
in) Tacloban,) Coco) Martyn) was) diagnosed) with) acute)
depression;)

19.)Plaintiff)paid)for)the)above@mentioned)consultations)as)well)as)
the) therapy) sessions) and) medications) prescribed) by) Dr.)
Isiderio,)amounting)to)a)total)of)P400,000;)

20.) On) the) fateful) night) of) October) 10,) 2015,) Coco) Martyn) was)
found) lifeless) in) his) room) at) around) eleven) o’clock,) and) upon)
autopsy)he)was)found)to)have)died)due)to)overdose)of)Marplan,)
a)potent)antidepressant);)

their) subjects) constitutes) primary) liability) on) the) part) of) the)
defendant@school,)DR.)VICENTE)SOTTO)LAW)SCHOOL,)it)being)
the) employer) of) said) professors) as) it) is) the) principal) in) the)
contract) of) education) entered) thereby) with) its) students,) as)
explained)by)the)Supreme)Court)in)the)case)of)University"of"the"

institution,"a"contract"of"education"is"entered"into"between"said"
institution" and" the" student." The" professors," teachers" or"
instructors" hired" by" the" school" are" considered" merely" as" agents"
